RESOLUTION NO. 30-93
A RESOLUTION AUTHORIZING EXECUTION OF AN INTERGOVERNMENTAL
AGREEMENT BETWEEN THE VILLAGE OF MOUNT PROSPECT AND
THE COOK COUNTY DEPARTMENT OF PUBLIC HEALTH
WHEREAS, the Northwest Municipal Conference Health Directors have
considered Intergovernmental Agreements with other public health
departments in order to provide a wide range of services to local
municipalities; and
WHEREAS, the Cook County Department of Public Health has the
ability to better respond to a specific incident, particularly as
it relates to food borne illness; and
WHEREAS, the Village of Mount Prospect is desirous of entering into
an Agreement with the Cook County Department of Public Health in
order to provide the ability of investigating food borne illnesses.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the Mayor and Board of Trustees do hereby
authorize execution of a Memorandum of Understanding between the
Village of Mount Prospect and the Cook County Department of Public
Health, a copy of said Memorandum of Understanding is attached
hereto and hereby made a part hereof as Exhibit "A". The purpose
of this Memorandum of Understanding is to provide cooperative
efforts as it relates to food borne illness.
SECTION TWO: That this Resolution shall be in full force and
effect from and after its passage and approval in the manner
provided by law.

Background Information on the "Memorandum of Understanding"
between Northwest Municipal Conference municipalities and the Cook
County Department of Public Health.
1. Background: NWMC area health departments operate at a disadvantage with the Cook
County Health Department.
Cook County municipalities in the NWMC area are unique among almost all
municipalities in the state of Illinois in that they have health departments staffed by
full time health professionals. Most municipalities rely upon county health
depm'ta~ents to handle most health issues.
The State Department of Public Health has designated county health departments
as the "recognized" health departments in Illinois. Their are a few municipal
departments that are also recognized (Evanston and Skokie in the NWMC area).
"Recognized" departments act as agents of the state. They are ultimately responsible
for carrying out health laws and protecting the public. Non-recognized municipal
health departments operate independently from this network of recognized
departments.
The Cook County Department of Public Health (CCDPH), as a "recognized health
department, is designated by the State as the agency responsible for investigating
incidents of possible food borne illness in Cook County. The CCDPH, however,
does not have the resources to investigate all possible incidents thoroughly and
quickly. The CCDPH has come to rely upon the non-recognized municipal health
departments to investigate reports in their own communities. The municipal health
departments do not mind this role, as it allows them to serve their citizens and
business establishments in an important way.
2. The Problem: Municipal health departments sometimes do not receive important health
information from the county.
~The relationship between the municipal and county health departments is one sided.
During incidents of food borne illness, the state regulations are written such that all
information flows to the county and all accountability is to the county. The county
does not need to supply information to local health departments. The municipal
health departments have held working relations should be more equitable, especially
considering municipal health departments in the NWMC area play such a large role
in assisting the CCDPH.
3. The Solution: The "Memorandum of Understanding" improves communications between
the county and local health departments.
The purpose of the Memorandum of Understanding is to improve working relations
between the CCDPH and municipal health departments during instances of possible
food borne illness. The Memorandum creates a two way flow of information
between the county and local health departments that will allow both to better
protect the public. Specifically:
1. The CCDPH is required to notify a municipal health department within
one working day of any complaint that is filed against an establishment in a
town. Previously there was no such requirement.
2. Notification shall be to the designated health official in the municipality
and shall contain sufficient information for the local health official to conduct
an effective investigation of the matter. Previously local health departments
often received incomplete information.
3. The CCDPH will mail reports to affected municipalities summarizing any
food borne illness investigations. Previously, these reports were not made
available to the municipalities.
4. Why does the county want this Agreement? To improve cooperation from local health
departments.
Despite the fact state regulations require local governments to assist the CCDPH
and provide information, many do not. The CCDPH is hoping the simple and more
even handed language in the Memorandum will motivate more local governments to
cooperate better with the CCDPH during instances of food borne illness.
5. Why should the Memorandum be accepted by our Board?
1. To improve your health departments ability to better respond to possible incidents
of food borne illness.
2. To better protect your citizens and business establishments.
3. To keep you better informed on what is occurring at eating establishments in your
community.
4. To take another step in improving county/municipal intergovernmental relations.
6. What do we do once the Memorandum has been accepted?
Notify Jan Kralovec at the Cook County Department of Public Health at 708-445-
2405, i010 Lake Street 300, Oak Park, Illinois 60301. Ms. Kralovec will assure the
Memorandum is directed to the correct person at the CCDPH for action. You will
also need to designate the individual on your staff who will be notified by the
CCDPH when a complaint is filed against an establishment in your town.
