HomeMy WebLinkAboutRes 42-93 10/19/1993 0/14/93 RESOLUTION NO. 42-93 A RESOLUTION TO EXERCISE THE POWER OF EMINENT DOMAIN IN ORDER TO ACQUIRE CERTAIN EASEMENTS WHEREAS, the Mayor and Board of Trustees of the Village of Mount Prospect have determined that it is in the best interests of the health, safety and welfare of the Village of Mount Prospect to acquire a certain easement over private property within the Village; and WHEREAS, the owner of the private property and the Village have not reached an agreement with regard to just compensation for the taking of the easement by the Village NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS SECTION ONE: That the Mayor and Board of Trustees of the Village of Mount ; Prospect do hereby exercise their home rule power. SECTION TWO: That the Village Manager of the Village of Mount Prospect is hereby authorized to institute, in the name of the Village of Mount Prospect, eminent domain proceedings in the Circuit Court of Cook County for the purpose of acquiring an easement over the property located at 1700 West Lincoln Street in Mount Prospect, Illinois, legally described as follows: A 10 foot permanent easement in part of Lot 55 of Hatlen Heights Unit NO. 4, being a subdivision of part of the Northeast Quarter of Section 10, Township 41 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois, as shown on Exhibit "A" attached hereto. SECTION THREE: The easement so obtained shall be used for the purpose of installing and maintaining certain public utilities as required by the Village of Mount Prospect. SECTION FOUR: That this Resolution shall acknowledge that upon submission of this matter to the Court's jurisdiction that the Court will determine the value of the easement to be acquired and the value of damage, if any, to the remainder. SECTION FIVE: That no fee interest in the private properties being the subject of this Resolution may be acquired by virtue of this Resolution. SECTION SIX: That this Resolution shall be in full force and effect from and after its passage and approval in the manner provided by law.
