ILLINOIS WHEREAS, on April 2, 1957, The Exchange National Bank of Chicago as Trustee under the provisions of a trust agreement, Trust No. 5891, filed with the Village Clerk of the Village of Mount Prospect the following Petition: "To The President and Board of Trustees of the Village of Mt. Prospect, Cook County, Illinois "The undersigned, EXCHANGE NATIONAL BANK OF CHICAGO, as Trustee and not individually, under the provisions of a trust agreement, Trust No. 5891, respectfully represents that it has been informed that the following described territory, to- wit: tiThe West 386 feet of a parcel of land described as follows: That part of the South half (~) of the South West Quarter (t) of the South West Quarter (t) of Section 35, Township 42 North, Range 11, East of the Third Principal Meridian, lying West of Rand Road (excepting from said Tract the West 193 feet thereof), in Cook County, Illinois, is not within the corporate limits of any municipality, but is contiguous to the Village of Mt. Prospect, Illinois; "That said petitioner is the title holder of record of said land within such territory and description; that been informed that no electors reside therein; that same occupied and vacant, and that petitioner desires to have annexed to the Village Prospect. of all it has is un- the same of Mt. This Petition is signed by The Exchange National Bank of Chi- cago, not individually but solely as Trustee under a cer- tain Trust Agreement known as Trust No. 5891. Said Trust Agreement is hereby made a part hereof and any claims against said Trustee which may result from the signing of this Agree- ment shall be payable only out of any trust property which may be held thereunder, and said Trustee shall not be personally liable for the performance of any of the terms and conditions of this agreement or for the valid- ity or condition of the title of said property or for any agree- ment with respect thereto. Any and all personal liability of The Exchange National Bank of Chicago is hereby expressly waived "Your petitioner therefore re- spectfully requests that said land and territory may be an- nexed to the Village of Mt. Prospect, a mun~cipal corpora- tion. "Dated, Chicago, Illinois this 2nd day of April, 1957. KOBELINSKI, being first duly sworn, on oath deposes and says that he is the Trust Officer & Assistant Cashier of the EXCHANGE NATIONAL BANK OF CHICAGO, Trustee under the provisions of a trust agreement, Trust No. 5891, the above petitioner; that he has read the foregoing petition subscribed as aforesaid; that he knows the contents thereof, and that the same is true in substance and in fact, insofar as he has been informed. KOBELINSKI .; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have considered the question of annexation of the territory described in said Petition; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have independently determined that said property, comprising 5.857 acres more or less, is not within the corporate limits of any municipality, that it is contiguous to the present village limits of the Village of Mount Prospect, and that it has no electors residing therein, NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: Section 1: That the following described territory: liThe West 386 feet of a parcel of land described as follows: That part of the South Half (~) of the South West Quarter (i) of the South West '-'" , ; - 3 - Quarter (i) of Section 35, Township 42 North, Range 11, East of the Third Principal Meridian, lying West of Rand Road (excepting from said Tract the West 193 feet thereof), in Cook County, Illinois,ll be and the same is hereby annexed to the Village of Mount Prospect, Cook County, Illinois, pursuant to the provisions of Section 7-6(a) of the Cities and Villages Act as Amended (Ch. 24, Sec. 7-6(a), 1955 Ill. Rev. Stat). Section 2: That this Ordinance shall be effective upon its passage and approval according to law. Section 3: That the Village Clerk of the Village of Mount Prospect is hereby authorized and directed to record with the Recorder of Deeds of Cook County, Illinois, a certi- fied copy of this Ordinance, together with an accurate map of the territory annexed.
