HomeMy WebLinkAboutOrd 610 05/13/1958 ORDINANCE NO. t, / () AN ORDINANCE GRANTING A VARIATION FROM THE VILLAGE OF MOUNT PROSPECT ZONING ORDINANCE AS AMENDED WHEREAS, a Notice of Public Hearing on the question of granting a variation from the minimum rear yard require- ment, Section 15, Village of Mount prospect zoning ordinance as amended with respect to the west side of the north 90 feet of the property hereinafter legally described as follows: The South one-half of "Lot A" in Block 1 in Ernst Busse's Addition to Mount Prospect being a subdivision of the South 543 feet of the E. i of the S.W. i of Sect. 34, Township 42 N., Range 11, East of the Third Principal r-Teridian in Cook County, Illinois, was duly published in the Mount Prospect Herald, a news- paper of general circulation in the Village of Mount Prospect; and WHEREAS, a Public Hearing was held by the Board of Appeals of the Village of Mount Prospect in the Village Hall in the Village of Mount Prospect on the 28th day of March, 1958, at the hour of 8:00 P.M. pursuant to the provisions of the aforesaid public notice, and all persons who desired to be heard were heard and an opportunity given to all persons who desired to make remonstrances and objections with reference thereto; and WHEREAS, the Board of Appeals of the Village of Mount Prospect, pursuant to Section 16 (B) (2) of said zoning ordinance, subsequent to said hearing, recommended that the variation request be granted; and WHEREAS, the corporate authorities of the Village of Mount Prospect, after considering the matter as aforesaid, do hereby find as follows: - 2 - 1. That the application of Section 15, Minimum Rear Yard requirements, to the above-described property would involve practical difficulties to the property owner in the proposed use of such property based on the facts presented to the Board of Appeals at the aforesaid public hearing; 2. That the application of Section 15, Minimum Rear Yard requirements, to the above-described property would result in particular hardship to the owner of the property hereinabove described in view of the dimensions of the property and the particular conditions that exist on and surrounding said property and the size and type of building proposed to be built on said property. 3. That the over-all use of the above-described property for the erection of a building in the district zoned for business will not seriously interfere with the administration of the Village of Mount Prospect Zoning Ordinance; 4. That by permitting the construction of a building no larger than ninety (90) feet by one hundred and thirty (130) feet to be set back as petitioned will permit free access to the parking area in the front and will eliminate the possibility of front sidewalk congestion; 5. That the property owner has consented not to erect any building or structure on that portion of the said property lying within thirty (30) feet of the property line on the east side of the said property; and WHEP~AS, the corporate authorities of the Village of Mount Prospect desire to grant to the property owner of record as of the date of passage of this ordinance a variation - 3 - as hereinafter set forth, which said variation is specifi- cally limited as herein provided, NOt'J, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: Section 1: That the Hest side of the North 90 feet of the following described property be exempt from the application of Section 15, Minimum Rear yard Requirements, of the Village of Mount Prospect Zoning Ordinance as amended: The South one-half of "Lot A" in Block 1 in Ernst Busse's Addition to Mount Prospect being a subdivision of the South 543 feet of the E. i of the S.W. i of Sect. 34, Township 42 N., Range 11, East of the Third Principal Meridian in Cook County, Illinois. Section 2: That no building or structure shall here- after be erected on that portion of the said property lying within thirty (30) feet of the east property line of said property; Section 3: That the variation granted hereby apply only to the property owner of record as of the date of the passage of this ordinance and for any building permits applied for by said property owner. Section 4: That the zoning plan of the Village of Mount Prospect, as amended, be and the same is hereby modified to conform to the above variation. Section 5: That this ordinance shall be in full force and effect from and after its passage, approval and publica- tion according to law. Section 6: That all ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed, reserving, however, to the Village of Mount Prospect any rights which have accrued to it against any person, firm or - 4 - corporation under any ordinances or sections of the zoning ordinance which may be and are hereby repealed.
