"II AN ORDINANCE AMENDING THE VILLAGE OF MOmrr PROSPECT ZONING ORDINANCE AS AMENDED WHEREAS, a Notice of Public Hearing with respect to the question of rezoning the following-described property from R-l (Single Family Residence) District to B-3 (Business-Retail and Service) District and to the question of granting a variation in the latter classi- fication to permit the installation and operation of an electrical distribution center on such property: Lots Fifty-three (53), Fifty-four (54) and Fifty-five (55) in Maplewood Heights, being a subdivision of the East Fifteen (15) chains of that part liing North of the railroad of the Southeast quarter (4) of Sec- tion Twelve (12), (except the Southerly Sixty-six (66) feet for road); also of Block Twenty-six (26) in Busse's Eastern Addition to Mount Prospect in the East half (!) of Section Twelve (12), Township Forty-one (41) Range Eleven (11) East of the Third (3rd) Principal Meridian in Cook County, State of Illinois, was duly published in the Mount Prospect Herald, a news- paper of general circulation in the Village of Mount Prospect; and WHEREAS, a Public Hearing was held by the Board of Ap- peals of the Village of Mount Prospect in the Village Hall in the Village of Mount Prospect on the 28th day of March, 1958, at the hour of 8:00 P.M. pursuant to the provisions of the aforesaid Public Notice and all persons who desired to be heard were heard, and an opportunity given to all persons who desired to make remonstrances and objections with refer- ence thereto; and WHEREAS, subsequent to said Public Hearing, the Board of Appeals of the Village of Mount Prospect, pursuant to Section 16 (B) of the Mount Prospect Zoning Ordinance as - 2 - amended, recommended that the said property be rezoned as aforesaid and that the variation requested be granted; and WHEREAS, the corporate authorities of the Village of Mount Prospect, after considering the matter as aforesaid, do hereby find as follows: 1. That an electrical distribution center 10- cated on the property described above is necessary as a public service; 2. That it is in the public interest, welfare, health and safety to permit the construction and opera- tion by the Public Service Company of an electrical distribution center in the aforesaid property rezoned B-3. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: Section 1: That an ordinance entitled, "An Ordinance classifying, regulating, and restricting the location of trades and industries and the location of buildings designed for specified uses; regulating and limiting the height and bulk of buildings hereafter erected or altered, regulating and limiting the intensity of the use of lot areas and regulating and determining the area of yards, courts and other open spaces within and surrounding such buildings; establishing the boundaries of districts for said purposes, and prescribing penalties for the violation of its provisions" passed and approved December 4, 1953, and amendments thereto (and known as Ordinance No. 52) as amended, be further amended by re-elassifying the following- described real estate as follows: - 3 - From R-l (Single-Family Residence) to B-3 (Business- Retail and Service): Lots Fifty-three (53), Fifty-four {54} and Fifty-five {55} in Maplewood Heights, being a subdivision of the East Fifteen (15) chains of that part Iring North of the railroad, of the Southeast quarter (4) of Sec- tion Twelve (12), {except the Southerly Sixty-six (66) feet for road} also of Block Twenty-six (26) in Busse's Eastern Addition to Mount Prospect in the East half (i) of Section Twelve (12), Township Forty-one (4l) Range Eleven {II} East of t he Third {3rd} Principal Meridian in Cook County, State of Illinois. Section 2: That the zoning ordinance of the Village of Mount Prospect as amended be and is hereby further amended to permit the construction and operation by the Public Service Company of an electrical distribution center on the foregoing property. Section 3: That the zoning plan of the Village of Mount Prospect as amended, be and the same is hereby modified to conform to the above changes. Section 4: That this ordinance shall be in full force and effect from and after its passage, approval and publica- tion according to law. Section 5: That all ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed, reserving, however, to the Village of Mount Prospect any rights which have accrued to it against any person, firm or corporation under any ordinances or sections of the zoning ordinance which may be and are hereby repealed.
