HomeMy WebLinkAboutRes 22-95 06/20/1995 RESOLUTION NO. 22-95 A RESOLUTION AUTHORIZING THE EXECUTION OF AN AGREEMENT BETWEEN THE VILLAGE OF MOUNT PROSPECT AND CEDA-NORTHWEST SELF-HELP CENTER, INC. WHEREAS, the Village of Mount Prospect is a recipient of funds under the Community Development Block Grant Program; and WHEREAS, it has been determined by the Mayor and Board of Trustees of the Village of Mount Prospect that CEDA-Northwest Self-Help Center, Inc. shall provide a Transitional Living Program in the corporate boundaries of the Village of Mount Prospect; and WHEREAS, the program proposed by CEDA-Northwest Self-Help Center, Inc. and approved herein, complies with the requirements of the Department of Housing and Urban Development with respect to benefitting low- and moderate-income persons. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That the Village President of the Village of Mount Prospect and the Village Clerk are hereby authorized to execute a contract for Community Development Block Grant implementation, which contract is between the Village of Mount Prospect and CEDA-Northwest Self-Help Center, Inc. a not-for-profit corporation, said contract is attached to this Resolution. SECTION TWO: That this Resolution shall be in full force and effect from and after its passage and approval in the manner provided by law. ATTEST: Mayor Pro Te~fi Village Clerk AGREEMENT This Agreement is entered into this ~ dayof ~ ,1995, byandbetweenthe Village of Mount Prospect, a body politic of the Stato,"of Illinois (hereinafter referred to as the "VILLAGE" and the CEDA Northwest Self-Help Center, Inc. (hereinafter referred to as the "CORPORATION"), an Illinois Not-for-Profit Corporation. SECTION I Statement of Purpose As a grantee of Community Development Block Grant funds (hereinafter referred to as CDBG funds) by the U. S. Department of Housing and Urban Development (hereinafter referred to as HUD), the VILLAGE elects to contract for services with the CORPORATION for operation ora program to assist near homeless and homeless low- and moderate-income residents of the Village of Mount Prospect as oi~tlined in the Scope of Services attached herewith as Exhibit "A". SECTION H Amount of the Grant The VILLAGE does hereby contract for services with the CORPORATION up to a maximum of $6,000.00 and the CORPORATION agrees to abide by the provisions and regulations of the 1974 Housing and Community Development Act, as amended under which said contract is made, and ~o use said contract funds for the purposes set forth in Section I hereof and as conditioned by the provisions of Section III next. · The VILLAGE's contractual obligation as identified in Section I shall be limited to the maximum amount specified in Section II, to the actual amount invoiced by the CORPORATION, and only to the extent such amount is received from HUD for such purposes. SECTION IH Conditions of Contract A. Indemnification. The CORPORATION agrees to indemnify and save and hold harmless the VILLAGE and each and evexyone of its officers, agents, employees, servants, attorneys, insurers -1- and successors from any and ail claims, demands, causes of action, expenses, injuries, losses or damages of whatever kind, character of description the VILLAGE may suffer as a result of any cause, matter, act, or omission arising out of the failure of the CORPORATION, or those acfmg under it, to conform to the statues, ordinances or other regulations or requirements of any govemmentai authority, in connection with the CORPORATION's performance under this Agreement. The CORPORATION agrees to defend against any claims brought or actions filed against the VILLAGE With respect to the subject of the indemnity contained herein, whether such claims or actions are rightfully or wrongfully brought or filed. In case of such a claim brought or such an action filed, the VILLAGE agrees that the CORPORATION may employ attorneys of its own selection to appear and defend the claim or action on behalf of the VILLAGE, subject to reasonable approval by the VILLAGE, at the expense of th~ CORPORATION. The CORPORATION, at its option, shall have the sole authority for the direction of the defense. B. Non-discrimination. The CORPORATION, performing under this Agreement, shall not · discriminate against any worker, employee, or applicant or any member of the public, because of race, creed, color, sex, age or national origin. Such affirmative action shall include, but not be limited to the following: employment, upgradir~g, demotion or transfer, termination, recruitment or recruitment advertising, layoff or termination rates of pay, other forms of compensation, selection for training including apprenticeship. The CORPORATION agrees to post in conspicuous places available to employees and applicants for employment, notices setting forth the provisions of this non-discriminatory clause. This policy of non-discrimination and affirmative action shall be applicable with regard to both CORPORATION's internal personnel practices and its actions in the performance of this Agreement. The CORPORATION hereby certifies that I-9 forms are current and employment verification has been completed regarding all employees. The CORPORATION agrees and authorizes the VILLAGE and HUD to conduct compliance reviews or any other procedures to assure compliance with these provisions, subject to applicable laws and regulations concerning privacy with reasonable notice to the CORPORATION. C. Examination of Records. The CORPORATION will, at all times, give HUD, the Comptroller General of the United States, and the VILLAGE, through any authorized representative, access to, and the right to examine all records, books, papers or documents related to the contract, in accordance with state and federai law. Said records shall include verification of household income and information on race or national origin. Eligible households for this program must have incomes below those noted in Exhibit C. The CORPORATION may establish program income criteria below that noted in Exhibit C. D. Filing of Records. The CORPORATION shall file with the VILLAGE such duplicates of records covering such activities to be performed in whole or in part, as specified in Exhibit "A". -2- E. Availability 0fI.~w, Regulations and Orders, The VILLAGE shall, upon the request of the CORPORATION, provide it with copies of all laws, regulations and orders, including those cited in this contract, which regulate the operation of the Block Grant funded programs, or which might otherwise affect the performance of this Agreement. SECTION IV Compliance With Laws The CORPORATION shall, at all times, observe and comply-Mth all laws, ordinances or regulations of the Federal, State, County and local government which may in any manner affect the performance of this Agreement, and the CORPORATION shall be required to perform all acts under this Agreement in the same manner as the VILLAGE, as a contractor of the Federal Government, · is or would be required to perform such acts. SECTION V Submission to HUD Subsequent to the execution of this Agreement, the VILLAGE shall forthwith file all necessary documents with HUD and shall comply with all applicable rules and regulations necessary to facilitate acquisition of funds approved for this program by HUD. The CORPORATION shall not file any lawsuit against the VILLAGE or any of its officers or employees as a result of this contract, except that this Section shall not act as a bar to any lawsuits arising bom the negligent or willfuliy wrongful acts of the VILLAGE or any of its officers or employees. SECTION VI Billing and Reportin_~ Arrangements Pursuant to this Agreement, the VILLAGE will disburse CDBG funds to the CORPORATION on the following basis: 1. The VILLAGE shall allocate the $6,000.00 contract amount for the services stipulated in this Agreement. The CORPORATION shall submit no more than one invoice every two months for an amount equal to one-quarter of the contract amount. -3- Every month, the CORPORATION shall submit to the VILLAGE a Monthly Performance Report. Said report shall include available information on: a. Each Mount Prospect resident provided housing and other services during the month, showing the client's CORPORATION number, address, and type(s) of service rendered. Services may also include number of applications received and the number of applicants approved for the program from Mount Prospect residents. The first report shall be due on June 10, 1995. All othe~:s shall be submitted no later than the 10th &the month. 2. A final report shall accompany the CORPORATION's final billing and regular monthly report in December of 1995. This report will highlight the accomplishments of the program over the past eight months, summarize for the fiscal year, from'May 1, 1995 to December 31, 1995, the number of Mount Prospect residents served by type of assistances, and include the completion of Exhibit B herein attached. SECTION VII Length of Contract This Agreement shall be valid from May 1, 1995 through December 31, 1995 and may be terminated by either party upon thirty (30) days written notice. All costs associated with the completed tasks shall be billed to the VILLAGE and reimbursed upon presentation of all documentation required under Section VI. SECTION VIH Assignment The CORPORATION shall not assign this Agreement or any part thereof and the CORPORATION shall not transfer or assign any funds or claims due or to become due hereunder without the prior written approval of the Village Manager. Any transfer or assignment &funds pursuant to this Agreement, either in whole or in part, or any interest therein which shall be due to the CORPORATION shall be deemed of no force or effect and shall not be binding upon the VILLAGE. -4- Notices and Communications Notices and communications under this Agreement shall be sent registered or certified mail, postage prepared, to the respective parties as follows: to the VILLAGE: Mr. William J. Must sign CEDA/SELF MELP CONTRACT. F,) Participant with last permanent address in our area will be given preference. G.) Must have income. 2.] ~PLOYMENT RULES= A.) Any participant fired from his/her Job for poor performance may be asked to leave the program. B.) Any participant who is laid off will immediately report this to the Employment Specialist. C.) A participant may not quit a Job without the Employment Specialist's approval, or they may be asked to leave the program. A.) Participants must keep receipts of monies spent...every dollar must be accounted for. These are to be reviewed by the Financial Counselor at each meeting. B.) Parti~ipants must provide copies of ALL check stubs from ]oDs to the Financial Counselor. C.) There will be no borrowing or loaning of monies. D.) At least 30% of all income earned will be placed in a savings account controlled by the Financial Counselor. Any variation in this rule will require a signed agreement from both the Financial Counselor, and the Program Services Coordinator. E.) NO savings withdrawal may be made without the approval of both the Financial Counselor and the Program Services Coordinator. Leaving a message without to the appropriate staff person will be unacceptable. A.) Any costs assouiated with repairsthat were caused by participant neglect and/or replacement of living quarters, equipment and/or furnishings in theliving unit wlll become the participants responsibility, and will be deducted from their savings account prior to the conclusion of their program stay. B.) The participant will agree to maintain the living quarters in a clean, well maintained condition. This includes keeping the apartment vacuumed, dishes washed and put away, bathroom fixtures scrubbed, and clothes picked up. Any unusual costs for the cleaning, or repair of a unit at the participants departure will be deducted from the participants saving account prior to the final closing of the account by the Financial Counselor. C.) The participant will assume the financial responsibility for any EHI~GENCY SXTU&TION which has been created or caused by them requiring repair work on weekends, or after hours, of the cost of repair plus a l0 % administrative fee. This cost will be submitted to the Financial Counselor for reimburse~ent to the agency from the participants savings account. D.) All adult participant MUST attend the support group. E.) Any violation o~ these rules will be cause for immediate dlsmissal from the program, and a twenty- four hour vacate notice of the living unit. HOUSING BPBCIALIH~: This Staff position reports to the Prog~a? Services coordinator, and is the key intake assessment posltlon for the Transitional Housing Program. The participants are evaluated to make sure they meet all the basic requirements for the program, and if all requirements are met, are recommended to the Program Services Coordinator for consideration for the program. HOUSING ASSIHTANT~ This Staff position reports to the Program Services coordinator, and works in conjunction with the ~ousing Specialist to provide for intake assessment and recommendation for the program. This Staff position reports to the Rrogram Services coordinator, and provides the Job seeker with the necessary tools to be ~ompetitive in the Job market. Service may include resume preparation, job referral, and job training if necessary in order place the participant in the best position available that they are gualifled for. BUDGET AND FXNJ%NCIAL COUNSELOR~ ~./ The Budget and Financial Counselor reports to the Program Services Coordinator, and is responsible for developing a day-to- day budget, establishing ? savings plan, and providing financial consultation to the part,¢ipant. This position also maintains customer accounts for all participants in the housing program.
