HomeMy WebLinkAboutRes 25-96 09/17/1996 AF/ 9/13/96 RESOLUTION 25-96 a RESOLUTION AUTHORIZING EXECUTION Of AN AGREEMENT BETVVEEN THE VILLAGE OF MOUNT PROSPECT AND THE ILLINOIS DEPARTMENT OF TRANSPORTATION FOR PREEMPTION EQUIPMENT WHEREAS, the corporate authorities of the Village of Mount Prospect have determined that it would be in the best interests of the Village to participate with the State of Illinois Department of Transportation to upgrade the traffic regulatory preemption equipment at Golf and Meier Roads and at Golf and Busse Roads; and WHERi=AS, it has been further determined that it would be in the best interest of all concerned to enter into an Agreement to share the cost of the purchase and installation of the traffic regulatory preemption equipment at the two locations stated herein; and WHEREAS, the Agreement being the subject of this Resolution specifies the portion of the cost that will be paid by the Village of Mount Prospect as well as the timetable involved with the installation of this equipment. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That the Mayor is hereby authorized to sign and the Clerk is authorized to attest his signature on the Agreement between the Village of Mount Prospect and the Illinois Department of Transportation, being the subject of this Resolution, a copy of said Agreement is attached hereto and hereby made a part hereof as Exhibit "A". SECTION TVVO: That this Resolution shall be in full force and effect from and after its passage and approval in the manner provided by law. Fields Village Clerk THIS AGREEMENT entered into this 17th day of September A.D., 1996, by and between the STATE OF ILLINOIS, acting by and through its Department of Trausportation, hereinafter'called the STATE, and the Village of Mt. Prospect, of Cook County, of the State of Illinois, hereinafter called the VILLAGE. WHEREAS, the STATE, in order to facilitate the free flow of traffic and ensure safety to the motoring public as part of the Federal Governments Congestion Mitigation and Air Quality Improvement (CMAQ) Program, is desirous of improving the existing signalized intersections on IL 58 from New Wilke Road to Busse Road by installing coordination equipment (to be known as STATE Section 1994-090 TS), and by performing all other work necessary to coniplete the improvement in accordance with the plans and specifications; and, WHEREAS, the VILLAGE requests emergency vehicle pre-emption improvements at IL 58 ~ Meier Road and IL 58 ~ Busse Road in conjunction with said improvements; and, WHEREAS, the STATE agrees to include these upgrades to said improvement providing the VILLAGE agrees to the following: I. The STATE agrees to prepare plans and specifications, receive bids, award the contract, fiaruish engineering inspection during the construction, and cause the improvement to be built in accordance with the plans, specifications, and contract. The STATE shall pay or cause to be paid all construction and engineering costs. 2. The VILLAGE agrees to reimburse the STATE for 100% of all engineering and construction costs associated with the installation of emergency vehicle pre-emption improvements (construction: $12;000.00, plus preliminary and constmftion engineering (15%): $1,800.00). The total cost to the VILLAGE for these installations is estimated to be $13,800.00. 3. Upon award of the contract for this improvement, the VILLAGE will pay to the Department of Transportation of the STATE of ILLINOIS an amount equal to 95% of its obligation incurred under this agreement, and will pay to the Department of Transportation the remainder of its obligation in a lump sum, upon completion of the project based upon final costs. The VILLAGE agrees to pay additional monies for the cost of improving the emergency vehicle pre-emption provided the amount estimated herein proves to be insufficient to cover the said cost. . Upon acceptance by the STATE of the traffic signal work included herein, the responsibility for maintenance and energy shall continue to be as outlined in the Master Agreement executed by the STATE and VILLAGE on March 3, 1979. 5. The STATE'S Electrical Maintenance Contractor shall continue to maintain the emergency vehicle pre-emption equipment located at the traffic signal installation to be maintained by the STATE. The STATE'S Electrical Maintenance Contractor shall invoice the VILLAGE for the maintenaue~ costs related to the maintenance of the emergency vehicle pre-emption equipment. 6. The financial responsibility for the maintenance of the emergency vehicle pre-emption equipment shall be borne entirely by the VILLAGE. 7. The STATE retains the fight to control the sequence of liming of the traffic signals. 8. This agreement and the covenants contained herein shall become null and void in the event the contract covering the construction work contemplated herein is not awarded by July 1, 1998 9. This agreement shall be binding upon and inure to the benefit of the parties hereto, their successors and assigns. .VILLAGE af~.
