HomeMy WebLinkAboutRes 17-98 03/18/1998 /10/98 RESOLUTION NO. 17-98 A RESOLUTION AUTHORIZING EXECUTION OF AN AGREEMENT BETWEEN THE VILLAGE OF MOUNT PROSPECT AND THE CAMP FIRE BOYS AND GIRLS METROPOLITAN CHICAGO COUNCIL FOR THE NEW HORIZONS PROGRAM WHEREAS, the Village of Mount Prospect is a recipient of funds under the Community Development Block Grant Program; and WHEREAS, it has been determined by the Mayor and Board of Trustees of the Village of Mount Prospect that the Camp Fire Boys and Gids Metropolitan Chicago Council shall provide a New Horizons Program originating in the Pickwick and Cottonwood Apartment Complexes, and possibly expanding through other areas in south Mount Prospect, all within the corporate boundaries of the Village of Mount Prospect; and WHEREAS, the program proposed by the Suburban Primary Health Care Council, Inc. and approved herein, complies with the requirements of the Department of Housing and Urban Development with respect to benefitting Iow- and moderate-income persons. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That the Mayor is hereby authorized to sign and Clerk directed to attest his signature on an agreement for Community Development Block Grant implementation, which Agreement is between the Village of Mount Prospect and the Camp Fire Boys and Girls Metropolitan Chicago Council, a not-for-pror~ corporate, a copy of which Agreement is attached hereto and hereby made a part hereof as Exhibit SECTION TWO: That this Resolution shall be in full force and effect from and after its passage and approval in the manner provided by law. Fields, Village Clerk AGREEMENT This Agreement is entered into this 18th day of March 1998, by and between the Village of Mount Prospect, a body public of the State of Illinois (hereinafter referred to as the "VILLAGE" and Camp Fire Boys and Girls Metropolitan Chicago Council, a not-for-profit corporation of the State of Illinois (hereinafter referred to as the "COUNCIL"). SECTION I Statement of Purpose As a grantee of Community Development Block Grant funds (hereinafter referred to as CDBG funds) by the U.S. Department of Housing and Urban Development (hereinafter referred to as HUD), the VILLAGE elects to contract for services with the COUNCIL for operation of a New Horizons Program in the Pickwick and Cottonwood Apartment Complexes as outlined in the Scope of Services attached herewith as Exhibit "A". SECTION II Amount of the Grant The VILLAGE does hereby contract for services with the COUNCIL up to a maximum of $5,000,00 and the COUNCIL agrees to abide by the provisions and regulations of the 1974 Housing and Cornm~mity Development Act, as amended under which said contract is made, and to use said contract funds for the purposes set forth in Section I hereof and as conditioned by the provisions of Section IH next. The VILLAGE's contractual obligation as identified in Section I shall be limited to the maximum amount specified in Section II, to the actual amount invoiced by the COUNCIL, and only to the extent such amount is received from HUD for such purposes. SECTION HI Conditions of Contract A. Indemnification. The COUNCIL agrees to indemnify and save and hold harmless the VILLAGE and each and everyone of it's officers, agents, employees, servants, attorneys, insurers and successors from any and all claims, demands, causes of actions, expenses injuries, losses or damages of whatever kind, character of description the VILLAGE may suffer as a result of any cause, matter, act, or omission arising out of the failure of the COUNCIL, or those acting under it, -I- to conform to the statues, ordinances or other regulations or requirements of any governmental authority, in connection with the COUNCIL's performance under this Agreement. The COUNCIL agrees to defend against any claims brought or actions filed against the VILLAGE with respect to the subject of the indemnity contained herein, whether such claims or actions are rightfully or wrongfully brought or filed. In case of such a claim brought or such an action filed, the COUNCIL agrees that the VILLAGE may employ attorneys of it's own selection to appear and defend the claim or action on behalf of the VILLAGE, subject to reasonable approval by the VILLAGE, at the expense of the COUNCIL. The COUNCIL, at it's option, shall have the sole authority for the direction of the defense. B. Non-discrimination. The COUNCIL, performing under this Agreement, shall not discriminate against any worker, employee, or applicant or any member of the public, because of race, creed, color, sex, age, or national origin. Such affirmative action shall include, but not be limited to the following: employment, upgrading, demotion or transfer, termination, compensation, selection for training including apprenticeship. The COUNCIL agrees to post in conspicuous places available to employees and applicants for employment, notices setting forth the provisions of this non-discriminatory clause. This policy of non-discrimination and affirmative action shall be applicable with regard to both COUNCIL% internal personnel practices and it's actions in the performance of this Agreement. The COUNCIL agrees and authorizes the VILLAGE and HUD to conduct compliance reviews or any other procedures to assure compliance with these provisions. C. Examination of Records. The COUNCIL will, at all times, give HUD, the Comptroller General of the United States, and the VILLAGE, through any authorized representative, access to, and the right to examine all records, books, papers or documents related to the contract, in accordance with state and federal law. D. Filing of Records. The COUNCIL shall file with the VILLAGE such duplicates of records covering such activities to be performed in whole or in part, as specified in Exhibit "A". E. Availability of Law. Re_rotations and Orders. The VILLAGE shall, upon the request of the COUNCIL, provide it with copies of all laws, regulations and orders, including those cited in tlfis contract, which regulate the operation of the Block Grant funded programs, or which might otherwise affect the performance of this Agreement. -2- SECTION IV Compliance with Laws The COUNCIL, shall at all times, observe and comply with all laws, ordinances or regulations of the Federal, State, County and local government which may in any manner affect the performance of this Agreement, and the COUNCIL shall be required to perform all acts under this agreement in the same manner as the VILLAGE, as a contractor of the Federal Government, is or would be required to perform such acts. SECTION V Submission to HUD Subsequent to the execution of this Agreement, the VILLAGE shall forthwith file all necessary documents with HUD and shall comply with all applicable rules and regulations necessary to facilitate acquisition of funds approved for this program by HUD. The COUNCIL shall not file any lawsuit against the VILLAGE or any of it's officers or employees as a result of this contract, except that this Section shall not act as a bar to any lawsuits arising from the negligent acts of the VILLAGE or any of it's officers or employees. SECTION VI Billing and Reporting Arrangements Pursuant to this Agreement, the VILLAGE will disburse CDBG funds to the COUNCIL on the following basis: I. The VILLAGE shall allocate the $5,000.00 contract amount for the services stipulated in this Agreement. The COUNCIL shall submit bi-monthly invoices to the VILLAGE with a bi-monthly performance report. This report shall include: a. Number of children participating in program for the reporting period; b. Number of hours of activity for children for the reporting period; c. Types of activities provided to children for the reporting period; -3- d. Number of trips taken and number of children on each for the reporting period; The first report shall be due on March 10, 1998. All other bi-monthly reports shall be due on the 10th of May, July, September and November of 1998. 2. A completed Exhibit B shall be submitted with the last bi-monthly invoice along with a summary of actual cost ihcurred over the entire year of operation of this program. The actual cost should be broken out by: a. Total salaries; b. Cost of transportation; c. Cost of office supplies, program supplies, food and drinks, registration, insurance, admission fees, custodial fees and memberships; d. Miscellaneous. Identify each. 3. The COUNCIL shall also have completed by the parents or guardians of each child an Application Form, using Exhibit C. This form may be part of the child's application for participating in the program. Said application shall indicate to the satisfaction of the Village, each participating child's household annual income as being below or above current HUD Section 8 Limits. Failure to submit a completed application to the Village for each participating child's household will violate the terms of this Agreement and cancel any pending and future payments due the COUNCIL from the VILLAGE. All exhibits, reports and invoices must be completed and sent to the Village of Mount Prospect no later than January 10, 1999. SECTION VII Len~h of Contract This Agreement shall be valid from January 1, 1998 through December 31, 1998 and may be terminated by either party upon thirty (30) days written notice. All costs associated with completed tasks shall be billed to the VILLAGE and reimbursed upon presentation of all documentation required under Section VI. -4- EC~ VIII Assignments The COUNCIL shall not assign the Agreement or any part thereof and the COUNCIL shall not transfer or assign any funds or claims due or to become due hereunder without the prior written approval of the Village Manager. Any transfer or assignment of funds pursuant to this agreement, either in whole or in part, or any interest therein shall be due to the COUNCIL shall be deemed of no force or effect and shall not be binding upon the VILLAGE. Emerson Mount Prospect, Illinois 60056 Dear Mike: Camp Fire Boys and Girls will be emending their '~New Horizons" program for the children in Mount Prospect. The target area will be the southside of Mount Prospect, reaching youth from the apartment complexes: Pickwick West, Alpine and Mt. Prospect Place. Camp Fire is open to boys and gifts from Kindergarten through High School. Our goal is to reach 80 - 100 children in the program year of 1998. "New Horizons" will offer enrichment and recreational activities to youth. We will have children participating in our on-going club program. Camp Fire club members work on various projects from national Camp Fke books, earning recognition and emblem awards for their accomplishments. They learn new skills, work on community service projects, go camping, have field trips, make arts & crafts and have fun together. These club members participate in program opportunities that are council-wide ... giving the kids a chance to see that they belong to a larger unit of Camp Fire Boys and Girls which extend throughout Cook, Lake and McHenry counties. We offer a club program at the RecPlex, which allows us to work with children that are available on Saturdays only. However, we anticipate bringing back our atter school club at Robert Frost School and are trying to find leadership to extend into Jolm lay School as well. This year we will extend our program options into the schools with some of our self-reliance courses. These programs teach children safety, peer-pressure skills and self-esteem. "A Git~ of Giving" is our service learning program. This program allows children to learn what it means to be a volunteer and how they can give back to their communities. Children identify needs of a particular community and address those needs by designing a service project. Taking 'ownership' of the project is what makes this course so successful for the kids. Children in any of our Camp Fire programs will receive direct mailings about other program opportunities and activities that they can be involved in. Funding for this program allows us to pay for reduced membership fees for youth and adults, emblems and award recognition, uniforms, supplies and materials, meeting rooms and bus service. We are also able to off-set the cost of trips and activities and pay for the volunteer and staff support to deliver this program.
