RESOLUTION NO. 48-98
A RESOLUTION AUTHORIZING EXECUTION OF AN AGREEMENT
BETWEEN THE VILLAGE OF MOUNT PROSPECT AND METRICOM, INC.
WHEREAS, the Village of Mount Prospect is responsible for managing the use
of public right-of-way located within the corporate boundaries of the Village; and
WHEREAS, the street light poles are placed in the public right-of-way to provide
street lighting throughout the Village; and
WHEREAS, Metricom, Inc. is a retail provider of a wireless digital data
communications radio network known as Richochet, operated in accordance with
Federal communications Commission regulations; and
WHEREAS, the Village, as a member of the Northwest Municipal Conference,
has worked in conjunction with other members of the NWMC to create a model
right-of-way use agreement between Metricom, Inc.; and
WHEREAS, it has been determined that the best interest of the Village would be
served by entering into a right-of-way agreement with Metricom, Inc. for the
installation of a wireless data transmission system; and
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY,
ILLINOIS:
SECTION ONE: That the Mayor and Board of Trustees of the Village of Mount
Prospect do hereby authorize execution of an Agreement between Metricom, Inc.
and the Village of Mount Prospect for the purpose of permitting the use of the
Village right-of-way for the installation of a wireless data transmission system in
exchange for $60 per year per use of each street light pole owned by the Village,
for a term of nine (9) years commencing on the installation date, with automatic
renewals for three (3) successive terms of five (5) years each as set forth in the
Agreement, a copy of which is attached hereto and hereby made a part hereof as
Exhibit "A".

SECTION TWO: That this Resolution shall be in full force and effect from and
after its passage and approval in the manner provided by law.
