CAF/ ORDINANCE NO. 4159 AN ORDINANCE GRANTING VARIATIONS FOR PROPERTY COMMONLY KNOWN AS 705 SOUTH BUSSE ROAD WHEREAS, Richard an Patricia Brock (hereinafter referred to as Petitioners) have filed an application for a variation from certain provisions of Chapter 14 of the Village Code of Mount Prospect, Illinois, for property commonly known as 705 South Busse Road (hereinafter referred to as Subject Property), legally described as: The North 200 feet of the South 400 feet of the West 200 feet of the Southwest 1/4 of the Southwest 1/4 of Section 11, Township 41 North, Range 11, East of the Third Principal Meridian, Cook County, Illinois and WHEREAS, Petitioners seek variations from Section 14.102 of Chapter 14 of the Village Code of Mount Prospect to permit an addition to the existing home four feet 6 inches (4' 6") from the existing garage, rather than the required 10 feet, and from Section 14.1002.A to allow a thirty-five and three-quarter foot (35.8') front yard setback instead of the required 40 feet; and WHEREAS, a public hearing was held on the variation requested being the subject of ZBA Case No. 13-V-90 before the Zoning Board of Appeals of the Village of Mount Prospect on the 22nd day of February, 1990 pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 7th day of February, 1990; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect and the President and Board of Trustees of the Village have given further consideration to the variations requested and have determined that the same satisfies the standards set forth in Section 14.605 of Article VI of Chapter 14 of the Village Code and the Board of Trustees further find that it would be in the best interests of the Village to grant the variations as specified herein. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT~ COOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property a variation from Section 14.102 to permit an addition to the existing home four feet 6 inches (4' 6") from the existing garage, rather than the required 10 feet, and from Section 14.1002.A to allow a thirty-five and three-quarter foot (35.8') front yard setback instead of the required 40 feet. SECTION THREE: Except for the variations granted herein, all other applicable Village of Mount Prospect Ordinances and regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: In accordance with the provisions of Section 14.604 of Chapter 14 of the Village Code, the variations granted herein shall be null and void unless permits are issued and ZBA 27-V-89 - CAF/ Page 2 of 2 construction begins within one (1) year from the date of passage of this Ordinance. SECTION FIVE: That this Ordinance shall be null and void and of no force and effect whatsoever until after its passage, approval and publication in pamphlet form, as provided by law, and such time as an accurate plan subdividing the subject property described herein is recorded with the Recorder of Deeds or Registrar of Titles of Cook County, whichever is applicable.
