CAF/ 6/11/91 ORDINANCE NO. 4326 AN ORDINANCE GRA~TING VARIATIONS FOR PROPERTY COMMONLY KNOWN AS 18 SOUTH MAIN STREET WHEREAS, Village of Mount Prospect (hereinafter referred to as Petitioners) has filed an application for variations from Chapter 21 of the Village Code of Mount Prospect, Illinois, for property commonly known as 18 South Main Street (hereinafter referred to as Subject Property), legally described as: Lot "E" and Lot "F" in Laudermilk's Subdivision of Lots three (3), four (4), five (5), six (6) and seven (7) in Block Seven in Mount Prospect, being a Subdivision in Section 12, Township 41 North, Range 11, East of the Third Principal Meridian in Cook County, Illinois and WHEREAS, Petitioner has submitted a request for a variation from Section 21.601.A.1 to allow a seven foot (7') high along the north side of the lot line to extend 15.8 feet from the front lot line, rather than the permitted 6 foot height 30' from the front lot line and a variation from Section 21.602.D to allow a fence to be made of chain link, rather than wood as required; and WHEREAS, a public hearing was held on the variation requested being the subject of ZBA Case No. 29-V-91 before the Zoning Board of Appeals of the Village of Mount Prospect on the 23rd day of May, 1991, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 7th day of May, 1991; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect and the President and Board of Trustees of the Village have given further consideration to the variations being _the subject of ZBA 29-V-91 and have determined that the best interests of the Village of Mount Prospect would be served by granting said variations. NOW, THEI~EFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT'PROSPECT, COOK COUNTY, ILLINOIS: -SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property variations from Section 21.601.A.1 allowing a seven foot (7') high along the nQrth side of the lot line extending 15.8 feet from the front lot line, and a variation from Section 21.602.D allowing a chain link fence SECTION THREE: Except for the variations granted herein, all other applicable Village of Mount Prospect Ordinances and regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: This Ordinance shall be in full force and effect BA 29-V-91 Page 2 of 2 from and after its passage, approval and publication in pamphlet form in the manner provided by law.
