JANONIS FROM: PROJECT ENGINEER DATE: NOVEMBER 12,2008 SUBJECT: NEIGHBORHOOD TRAFFIC STUDY RECOMMENDATION FOR INTERSECTION TRAFFIC CONTROL, SP AND TURN RESTRICTION CHANGES FOR ZONES 3, 4 & 10 The Engineering Division transmits their recommendation to approve intersection traffic control, speed limit and turn restriction changes for Zones 3, 4 & 10 as part of the Neighborhood Traffic Study. The Residential Intersection Traffic Control Program and Residential Speed Limit Program are the two primary traffic initiatives that are included in the current Neighborhood Traffic Study. The Residential Intersection Traffic Control Program involves reviewing all neighborhood intersections to determine the proper traffic control. The Residential Speed Limit Program involves reviewing all Village-owned streets to determine the appropriate speed limit. Both programs are being implemented on a neighborhood by neighborhood basis using today's engineering principles. The Village has been divided into 18 neighborhoods or "traffic zones" for the purpose of implementing the programs. With the assistance of a consultant, KLOA Inc., the Engineering Division has completed the study of Zones 3, 4 & 10. The neighborhood of Zone 3 is bounded by Camp McDonald Road to the north, Elmhurst Road to the east, Kensington Road to the south, and the western Village limits. Zone 4 is bounded by Euclid Avenue to the north, Wolf Road to the east, Kensington Road to the south, and Elmhurst Road to the west. Zone 10 is bounded by the southern boundary of the Kensington Business Park to the north, Wolf Road to the east, Central Road to the south, and Rand Road to the west. Specific to Zone 3, the Village also reviewed the current turn restrictions along Rand Road. With the Village performing a traffic study in the neighborhood, it was decided that it would be an opportune time to evaluate access at the Village streets intersecting Rand Road. Similar to the study that was performed along Rand Road for another neighborhood last year, KLOA Inc. was asked to review the current access regulations at the two residential streets along Rand Road to determine what, if anything, could be done to improve access for those who live in the neighborhood while still minimizing cut through traffic. SUMMARY Residential Intersection Traffic Control Program A total of 111 intersections in the three zones were reviewed to determine the proper traffic control. A concern was raised by a resident at the Open House over the possibility of eliminating on-street parking spaces. The west side of Wheeling Road between Euclid Avenue and Kensington Road allows overnight permit parking for Boxwood residents. In order for a new stop sign to be installed on Wheeling Road at Cedar Lane, four parking spaces may need to be eliminated in order for the stop sign to be visible to motorists. Staff has committed to work with the Association to add an equal number of spaces on Boxwood Drive near the intersection that are eliminated on Wheeling Road. Should the new traffic control be approved for this intersection, the change will not be made until the new parking spaces have been constructed. Residential Speed Limit Program In addition to reviewing the intersections, the street system was reviewed to determine the appropriate speed limits in the three zones. The Engineering Division also evaluated the two schools within Zone 4, Euclid Elementary School and River Trails Middle School, and the one school within Zone 10, St. Emily, to determine those streets that should be posted a school speed limit zone. Along those streets there page3 of II Neighborhood Traffic Study November 12,2008 would be a 20 mph speed limit during school hours when children are present. At other times, the speed limit would be 25 mph. Section 18.605 of the Village Code covers school speed limit zones. Therefore, a separate ordinance is not required. A summary of the recommendations are indicated in the tables below. At Prospect Manor Avenue, various turn restrictions are in place while Wedgewood Lane allows full access at all times. The left turn prohibition from Rand Road onto Prospect Manor Avenue was approved in 1974. Records are limited but it may have been that Rand Road did not have a shared left turn lane at the time making left turns hazardous. Today, there is a shared left turn lane. The right turn prohibition (6:00am - 9:00am) from Rand Road onto Prospect Manor Avenue and the left turn prohibition (4:00pm - 7:00pm) from Prospect Manor Avenue onto Rand Road were approved in 1986. Records indicate residents of the Prospect Meadows Subdivision petitioned the Village for the turn restrictions to reduce cut through traffic in the neighborhood. page 4 of 11 Neighborhood Traffic Study November 12, 2008 With a shared left turn lane on Rand Road at Prospect Manor A venue, allowing left turns into the neighborhood would be safe and appear to benefit local residents as it would provide an additional point of access. Further, allowing left turns from Prospect Manor Avenue onto Rand Road during the evening hours would appear to benefit local residents without creating a significant amount of cut through traffic from arterial streets. With Prospect Manor A venue being the only access point at the north end of the neighborhood, local residents must travel south and through the congested intersection of Rand-83- Kensington before travelling north. The right turn prohibition from Rand Road onto Prospect Manor Avenue is recommended to remain during the morning hours in order to limit cut through traffic generated by motorists heading to Prospect High School. As most local residents are leaving the neighborhood in the morning, the turn restriction into the neighborhood would not be a significant inconvenience but would prevent high school traffic from using local streets. Wedgewood Lane does not appear to be an attractive cut through route and the low daily traffic volume seems to support this thought. While it is presumed some cut through traffic occurs, it is believed enacting turn restrictions would be more of a detriment to local residents rather than a benefit as Wedgewood Lane provides the only access off of Rand Road into the neighborhood. No turn restrictions - full access NO CHANGE Public Notification Once the studies were completed, the first piece of information sent to each of the 2500 properties within the three neighborhoods was a brochure. The brochure provided information about the traffic study and invited them to an Open House to learn about the proposed changes. A web page that included a 12 minute video explaining the programs was created on the Village web-site as an additional avenue to get information to the public. The Open House was held on October 20th at River Trails Middle School. Residents could come anytime between 6:00pm & 7:30pm. The Open House included the video about the programs and an area where page 5 of 11 Neighborhood Traffic Study November 12,2008 residents could see the recommended changes on display boards and talk with Staff. Residents could also fill out a Comment Card and provide Staff with feedback. All written comments received via the Open Houses, e-mail or regular mail are attached. Approximately 20 residents attended the Open House. Based on the traffic study performed by KLOA Inc. and the Engineering Division, we are recommending changes to Chapter 18 (Traffic) of the Village Code as detailed on the following pages. With the Village Board of Trustees' approval, the Engineering Division will then solicit bids from contractors to manufacture and install the necessary signs. The current schedule is to have the new signs installed in early 2009. However, they are on record with the Village. Zone 3 "Please consider the implementation of speed bumps on Forest between Prospect High School and Rand Road. Thank you for your time." Zone 4 "As a follow up to our conversation yesterday regarding the zone 4 stop sign program....you are proposing a new stop sign to be located on south bound Wheeling Rd. at Cedar. My major concern with this placement is that in order for that be effective it would require the village to eliminate several parking spaces along the West side of Wheeling road in an existing Zone parking area. The residents currently using these spaces would be negatively effected with the loss of any parking spaces in that area as we already suffer with a lack of parking spaces both there and throughout the neighborhood. Given the layout of the various zone parking allocations, to the various home owners associations and apartment buildings the impact on those home owners in the Red zone area ( area of discussion) would be dramatic. For every space removed a home owner would be forced to sell a vehicle they currently own....as there are no additional/surplus spaces available in the zone areas. In addition 1 feel it would have a negative impact on the property values. While 1 understand the concept...logic and wisdom of this placement at this location, 1 strongly oppose it's implementation based solely on the hardship it would create for our residents. If we can come up with some alternate....! believe you used the word" creative" solution to this proposed placement , which would forego the loss of ANY parking spaces 1 would be pleased to hear your suggestions. Let's hope the State of Illinois concurs." Zone 10 "1 want to let you know how happy we all are at our subdivision with the new proposed stop sign at Cardinal and Eric Ct. This is such a crazy intersection because many people drive to and from Aldis, and Menard, so this stop sign will slow them down, and minimizing any incident with our kids and the people that live here. We would hope that you could do more to prevent people making a right turn coming for those stores and cutting thru our subdivision, because there's still many people that do not respect the NO RIGHT TURN sign, that could be a gold mine of tickets." JANONIS, VILLAGE MANAGER FROM: DEPUTY POLICE CHIEF MICHAEL SEMKIU SUBJECT: RANDHURST SHOPPING CENTER PARKING & TRAFFIC ENFORCEMENT AGREEMENT DATE: NOVEMBER 13, 2008 Police Department Request The Police Department is requesting the Village enter into an agreement with Randhurst Shopping Center LLC, to enforce parking and traffic regulations throughout the parking lot facility of the Randhurst Shopping Center. Discussion For more then twenty-five (25) years, the Village has maintained a written agreement with the owners of the Randhurst Shopping Center to provide enforcement of all parking and traffic laws in accordance with Illinois Compiled Statutes 625 ILCS 5/11-209. Pursuant to said statute, municipalities may contract with the private owners of shopping center parking lots to enforce all municipal and state of Illinois parking and traffic regulations. Without such an agreement, municipal law enforcement agencies are significantly limited in the ordinances and state statutes they may enforce on privately owned property. Without a contractual agreement, the only violations enforceable by officers would be fire-lane violations, handicap parking violations, Village vehicle tag violations, and reckless driving and driver under the influence violations. By contracting with a private property owner, such violations as speeding, driving too fast for conditions, stop sign violations, and failure to yield to pedestrians or vehicles may be enforced by officers. Without a contractual agreement, these violations may not be enforceable by officers. In addition to the authority to fully enforce Village ordinances and state of Illinois statutes pertaining to vehicles, the agreement with Randhurst Shopping Center would allow the Chief of Police or his designee to provide input for additional traffic signs or markings necessary to increase safety and efficiency of traffic flow through the parking lot. The costs for additional signage would be the responsibility of the shopping center. Conclusion It is staffs' recommendation to contract with Randhurst Shopping Center LLC, to provide complete enforcement of Village traffic ordinances and state of Illinois traffic statutes. This contract has served the community well in the past, ensuring the Randhurst parking lot facilities are safe for both drivers and pedestrians. A RESOLUTION AUTHORIZING THE EXECUTION OF AN AGREEMENT BETWEEN THE VILLAGE OF MOUNT PROSPECT AND RANDHURST SHOPPING CENTER LLC, FOR REGULATING PARKING OF MOTOR VEHICLES AND CONTROL OF MOTOR VEHICLE TRAFFIC AT THE RANHURST SHOPPING CENTER, MOUNT PROSPECT, ILLINOIS WHEREAS, the Corporate Authorities of the Village of Mount Prospect have determined that it would be in the best interests of the Village to regulate the parking of motor vehicles and the control of motor vehicle traffic at the Randhurst Shopping Center LLC ("Center"); and WHEREAS, it has been further determined that it would be in the best interest of all concerned that the Village of Mount Prospect enter into an Agreement with Randhurst Shopping Center LLC for the enforcement of parking and traffic regulations on the parking area of the "Center" by the law enforcement personnel of the Village of Mount Prospect; and WHEREAS, 625 ILCS 5/11-209 provides that such an Agreement maybe entered into by the corporate authorities of a municipality (Village of Mount Prospect) and the lawful owner or lessee of a shopping center (Randhurst Shopping Center LLC.) The VILLAGE shall enforce all posted parking and traffic regulations on the parking area of the CENTER and OWNER hereby consents to the issuance of parking and traffic citations for any and all violations thereof in the parking area. 2. The VILLAGE, by its Chief of Police or a legally designated representative, shall make an inspection of the parking area of the CENTER with the Manager of the CENTER, or a designated representative, to determine what, if any, additional parking and traffic signs or markings are necessary for the safe and efficient movement of traffic and the implementation of such other appropriate regulations. The inspection will not occur, however, until the redevelopment of the CENTER has occurred, both parties acknowledging that there has been for many years a prior agreement, similar to this one, and that the present signage and markings are adequate for the CENTER as it currently exists. 3. It is understood that OWNER shall bear the cost of installation of such additional signs and markings on the parking area of the CENTER as are determined to be required pursuant to this Agreement and lor the ordinances of the VILLAGE. BACKGROUND: Since 1990 the Village has followed the practice of approving moderate annual increases in wat and sewer rates, as opposed to implementing large increases periodically. The annual rate increase under this program has ranged between 4-5%. In late 2007 the Village learned that the City of Chicago was planning to increase the cost of water purchased by the Village an average of 15% per year through 2010. Because of the late notice of the increase, we were not able to analyze what an appropriate rate increase would be for 2008. The Village moved forward with its regular programmed increase for the 2008 budget (5%) with the understanding that a water rate study would be performed in the first quarter of the year and rates would be adjusted accordingly. Staff presented results of the water rate study to the Village Board and Finance Commission at a workshop in April 2008. The study showed that existing rates were sufficient to cover operations and future annual increases would be set at 4%. In the end, water customers benefited by the decision to delay reacting to the City of Chicago proposed rate increases until better information was available. The next rate study will occur some time during 2013 assuming no extraordinary issues develop necessitating an earlier review. DISCUSSION: The following table illustrates the recommended rates as reflected in the proposed ordinance. Current Rate Proposed. No increase is proposed for the $5.00 per month sewer construction fee. If a Mount Prospect household uses 15,000 gallons of water over a two-month period, their bimonthly water and sewer usage fee would be $99.40, an increase of $4.20. No increase is being proposed for the monthly availability charge assessed customers outside of Special Service Area No.5. For most customers, those with a 5/8" water line, the charge will remain at $10. JANONIS, VILLAGE MANAGER DIRECTOR OF FINANCE TO: DATE: NOVEMBER 12, 2008 RESOLUTION FOR THE INCLUSION OF TAXABLE ALLOWANCES AS EARNINGS TO THE ILLINOIS MUNICIPAL RETIREMENT FUND (IMR SUBJECT: PURPOSE: To present for the Board's consideration a resolution to include taxable allowances as reportable earnings to the Illinois Municipal Retirement Fund (IMRF). BACKGROUND: Standard member earnings reportable to the IMRF do not include certain taxable allowances as determined by the Internal Revenue Service. Examples of allowances include automobile, uniform and travel allowances and moving expenses. For general Village employees covered by IMRF, automobile and uniform allowances are the most common received. Other types of income not considered in standard member earnings include contributions to Retirement Health Savings (RHS) plan and Section 125 plan. In order to have these two types of income treated as IMRF reportable wages the Village approved separate resolutions in 1986 (for Section 125 Earnings) and 2004 (for RHS Earnings). DISCUSSION: In February 2008, IMRF members received a general memorandum from Louis Kosiba, IMRF Executive Director that discussed the reporting of taxable expense allowances and requirements of the Illinois Pension Code. A copy of the general memorandum is included with this memo. The memorandum stated that an employer must elect by governing body resolution to report taxable expense allowances. A review of Village resolutions on file with IMRF showed the Village had no such resolution. A resolution is needed to be in compliance with the pension code. The adoption of this resolution will not impact the annual employer contribution as these allowances are already included in the calculation of the annual employer rate. RECOMMENDATION: It is recommended the Village Board approve the attached resolution allowing taxable allowances to be included as reportable earnings to the Illinois Municipal Retirement Fund. '- A RESOLUTION TO INCLUDE TAXABLE ALLOWANCES AS IMRF EARNINGS WHEREAS, the Village of Mount Prospect is a member of the Illinois Municipal Retirement Fund (IMRF) and as such operates in accordance with the rules and regulations of said IMRF; and WHEREAS, standard member earnings reportable to the IMRF do not include expense allowances; and WHEREAS, the governing body of an IMRF participating unit of government may elect to include in IMRF earnings all taxable expense allowances; and WHEREAS, the Mayor and Board of Trustees of the Village of Mount Prospect is authorized to include taxable expense allowances as earnings reportable to IMRF and it is desirable to do so. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That the Mayor and Board of Trustees of the Village of Mount Prospect does hereby elect to include as earnings reportable to IMRF taxable expense allowances. SECTION TWO: That this Resolution shall be in full force and effective from and after its passage and approval in the manner provided by law. Expense allowances, even if they are taxable income to the member, are generally not considered IMRF earnings. However, an employer may elect-by governing body resolution-to report taxable expense allowances as IMRF earnings. The governing body would complete IMRF Form 6.74, "Suggested Resolution to Include Taxable Expense Allowances as IMRF Earnings," available from the forms area of www.imrf.org. By resolution, the employer may include as IMRF earnings the following types of allowances: . Uniform allowances · Automobile allowances · Travel allowances · Moving expenses If the governing body does not adopt the appropriate resolution, expense allowances are not considered IMRF earnings and would not be reported to IMRF. Please note: non-taxable expense reimbursements are not included as earnings and are not to be reported to IMRF. This is true even if an employer elects to make taxable expense allowances reportable.
