HomeMy WebLinkAboutOrd 630 10/07/1958 ( ')" ORD INANCE NO. lC ,,':" AN ORDINANCE AMENDING THE VILLAGE OF MOUNT PROSPECT ZONING ORDINANCE AS AMENDED WHEREAS, the corporate authoriti.?~ Of. the Village of Mount Prospect on the ~tf/... day of &Cllti..t>1. , 1958, annexed to the Village of Mount Prospect the following- described property: The East 100 feet of the West 800 feet of the South 208 feet of lot "Dfl in Kirchoff's subdi- vision in Section 33, Township 42 North, Range 11 North of the Third Principal Meridian , and vrnEREAS, in connection with the annexation of said property and in the interests of public welfare, safety and health of the residents of the Village of Mount Prospect the corporate authorities of the said Village deemed it necessary to determine the proper zoning to be applied to said property when so annexed; and WHEREAS, a Notice of Public Hearing with respect to the question of establishing zoning of the aforesaid property was duly published in the Mount Prospect Herald, a newspaper of general circulation in the Village of Mount Prospect; and WHEREAS, a Public Hearing was held by the Board of Appeals of the Village of Mount Prospect in the Village Hall in the Village of Mount Prospect on the 29th day of August, 1958, at the hour of 8:00 P. M. pursuant to the provisions of the aforesaid Public Notice, and all persons who desired to be heard were heard, and an opportunity given to all persons who desired to make remonstrances - 2 - and objections with references thereto; and WHEREAS, the Board of Appeals of the Village of Mount Prospect, subsequent to said Public Hearing, recommended that if said property be annexed to the Village of Mount Prospect the aforesaid property be zoned in accordance with their recommendation and thereafter upon further con- sideration of said matter by a proper committee of the Board of Trustees of said Village, the corporate authorities of the Village of Mount Prospect do hereby find that it is in the public interest and will aid and promote the public safety, health and welfare of the residents of the Village of Mount Prospect to zone the property as hereinafter set forth: NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: Section I: That an ordinance entitled, flAn Ordinance classifying, regulating and restricting the location of trades and industries and the location of buildings designed for specified uses; regulating and limiting the height and bulk of buildings hereafter erected or altered, regulating and limiting the intensity of the use of lot areas and regulating and determining the area of yards, courts and other open spaces within and surrounding such buildings; establishing the boundaries of districts for said purposes; and prescribing penalties for the violation of its provisionsfl passed and approved December 4, 1923 and amendments thereto (and known as Ordinance No. 52) as amended, be further amended by classifying the following described real estate as a B-3 District: - 3 - B-3 District (Business-Retail and Service) The East 100 feet of the West 800 feet of the South 208 feet of lot IIDII in Kirchoff's subdi- vision in Section 33, Township 42 North, Range 11 North of the Third Principal Meridian Section 2: That the Zoning plan of the Village of Mount Prospect as amended, be and the same is hereby amended to conform to the above change. Section 3: That this Ordinance shall be in full force and effect from and after its passage, approval and publi- cation according to law. Section 4: That all ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed, reserving however, to the Village of Mount Prospect any rights which have accrued to it against any person, firm or corporation under any ordinance or sections of said Zoning Ordinance which may be and are hereby repealed. 1'-1" ,Qd~ PASSED this day of C> . ! WHERE~S,certain real estate hareinafter described is owned by the !10UNT PROSPECT VETZR~NS C~UB,Inc.,(an Illinois corporation not for profit)and their successors by their corporata name,which is situated in unincorporated territory, adjacent to the Village of Mount Prospect, Illinois,and W~REAS,Mount Prospect Veterans Club, Inc. deems it to be in the best interests of said corporation that said real estate be annexed to the Village of Hount Prospect, and 1WHERE~~,Article 7,Se0tion 11 of the Revised Cities and Villages Act provides that upon thA adoption of a resolution by th~ mecbers of the corporation Deco~ending annexation such real estste may be annexed by the adjacent municipaltty and WHEREAS,at a special meeting of the members of the corporation at which a quorum was present and voting,held o~ the 19th day of ~ay, A.D.1958,the directors were,by proper motion made, seconded and carried, authorized to seek annexation to the Village of Mount Pro- spect and PURSUMTT THERETO, it is hereby re solved by the directors of the Mount Prospect Veteran's Club,Inc. as follows: Section l:That the directors do hereby recommend and re- quest the annexation of the following described real estate which is adjacent and contiguous to the Village of Mount Prospect, Illinois,to-wit: The ~ast 100 feet of the West 800 feet of the South 208 feet of Lot liD" in Kirchoff's sub- division in Section 33,Township 42 North,Range 11 Bas-t' of t:le Third Principal Meridian. <:'>ection 2:That this resolution, a:9pee.ring ~_n the mj.nutes of tl}e corroration,is in full force and effect as of the date inscribed hereon.
