HomeMy WebLinkAboutOrd 4341 08/20/1991 ORDINANCE NO. 4341 AN ORDINANCE GRANTING VARIATIONS FOR PROPERTY COMMONLY KNOWN AS 503 SOUTH ELMHURST ROAD PASSED AND APPROVED BY THE PRESIDENT AND BOARD OF TRUSTEES the 20th · day of Auaust , 1991 Published in pamphlet form by authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 27th day of Auu~/st , 1991. vwL/ 08/14/91 ORDINANCE NO. 4341 AN ORDINANCE GRANTING VARIATIONS FOR PROPERTY COMMONLY KNOWN AS 503 SOUTH ELMHURST ROAD WHEREAS, Gary and Mary Parlakian (hereinafter referred to as Petitioner) has filed an application for a variation from Chapter 14 of the Village Code of Mount Prospect, Illinois, for property commonly known as 503 South Elmhurst Road (hereinafter referred to as Subject Property), legally described as: Lot 3 and the South half of Lot 2 in Block 5 in Prospect Park Subdivision No'. 1, being a Subdivision of the West half of the North 60 rods of the Southwest quarter of Section 12, Township 41 North, Range 11, East of the Third Principal Meridian, in Cook County, IllinOis and WHEREAS, Petitioner seeks a variation from Section 14.3016.A.1 to permit a circular driveway, and a variation from Section 14.1102.A to allow a front yard lot coverage of 53.8%, as allowed by the Village Code. WHEREAS, a public hearing was held on the variations requested being the subject of ZBA Case No. 44-V-91 before the Zoning Board of Appeals of the Village of Mount Prospect on the 25th day of July, 1991, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 9th day of July, 1991; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect and the President and Board of Trustees of the Village have given further consideration to the variations being the subject of ZBA 44-V-91 and have determined that the best interests of the Village of Mount Prospect would be served by granting said variations. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property a variation from Section 14.3016.A.1 to permit a circular driveway resulting in a front yard lot coverage of 53.8% rather than 35% as allowed in Section 14.1102.A. SECTION THREE: Except for the variations granted herein all other applicable Village of Mount Prospect Ordinances and regulations shall remain in full force and effect as to the Subject Property. SECTION'FOUR: In accordance with the provisions of Section 14.604 of Chapter 14 of the Village Code, the variations granted herein BA 44=V-91 Pag~ 2 of 2 shall be null and void unless permits are issued and construction begins within one (1) year from the date of passage of this Ordinance. SECTION FIVE: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
