CAF 10/23/91 ORDINANCE NO. 4360 AN ORDINANCE GRANTING A VARIATION FOR PROPERTY LOCATED AT 219 SOUTH LEONARD LANE WHEREAS, George Karahalios (hereinafter referred to as Petitioner) has filed an application for a variation from Chapter 14 of the Village Code of Mount Prospect, Illinois, for property commonly known as 219 South Leonard Lane (hereinafter referred to as Subject Property), legally described as: Lot 2 in Barsccchi's Subdivision, being a subdivision of part of the Northwest Quarter of Section 10, Township 41 North, Range 11, East of the Third Principal Meridian, according to plat thereof registered in the Office of the Registrar of Titles of Cook County, Illinois, on November 9, 1977, as Document Number 2980386; and WHEREAS, Petitioner seeks a variation from Section 14.102.B.2 to allow a two foot 6 inch (2' 6") sideyard setback, rather than 5' required, to accommodate a shed; and WHEREAS, a public hearing was held on the variation requested being the subject of ZBA Case No. 60-V-91 before the Zoning Board of Appeals of the Village of Mount Prospect on the 26th day of September, 1991, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 10th day of September, 1991; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect and the President and Board of Trustees of the Village have given further consideration to the variations being the subject of ZBA 60-V-91 and have determined that the best interests of the Village of Mount Prospect would be served by granting said variations. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property a variation from Section 14.102.B.2 to allow a two foot 6 inches (2' 6") sideyard setback in order to accommodate a shed. SECTION THREE: The variation granted herein is conditioned on the Petitioner providing some form of landscaping that would screen the shed from the neighbor to north. SECTION FOUR: Except for the variation granted herein, all other applicable Village of Mount Prospect Ordinances and regulations BA 60-V-91 Page 2 of 2 shall remain in full force and effect as to the Subject Property. ~ECTION FIVE: In accordance with the provisions of Section 14.604 of Chapter 14 of the Village Code, the variations granted herein shall be null and void unless permits are issued and construction begins within one (1) year from the date of passage of this Ordinance.. SECTIO~ SIX: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
