CAF/ 10/23/91 ORDINANCE NO. 4364 AN ORDINANCE AMENDING ORDINANCE NO. 4187 GOVERNING PROPERTY GENERALLY LOCATED AT 400 EAST BLUE JAY COURT WHEREAS, Blue Jay Builders (hereinafter referred to as Petitioner) has filed a petition to amend Ordinance No. 4187, being an Ordinance authorizing a Special Use in the nature of a Planned Unit Development with respect to property commonly known as 500 East Blue Jay Court (hereinafter referred to as the Subject Property) and legally described as follows: Orchard Field Townhomes Subdivision being a subdivision of part of the Southeast Quarter of the Northeast Quarter of Section 34, Township 42 North, Range 11, East of the Third Principal Meridian in Cook County, Illinois; and WHEREAS, Petitioner seeks an amendment to the Site Plan of the Planned Unit Development being the subject of Ordinance No. 4187 to allow patios to encroach ten feet (10') into the required 20' perimeter yard; and WHEREAS, a public hearing was held on the request for amendment (designated as ZBA Case No. 65-SU-91) before the Zoning Board of Appeals of the Village of Mount Prospect on the 26th day of September, 1991, pursuant to proper legal notice having been published in the Mount Prospect Herald on the 10th day of September, 1991; and WHEREAS, the Zoning Board of Appeals has submitted its findings on the proposed Special Use to the President and Board of Trustees; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have determined that the best interests of the Village of Mount Prospect will be attained by granting the request in ZBA 65-SU-91. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOlS: SECTION ONE: That the recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the village of Mount Prospect. SECTION TWO: That Ordinance No. 4187 entitled "An Ordinance Granting a Special Use in the Nature of Planned Unit Development for Property Located 400 East Rand Road" is hereby amended by attach.ing a new Site Plan, a copy of which Amended Site Plan is attached hereto and hereby made a part hereof as Exhibit "A", and subject to the following conditions: 1. Petitioner shall install a six foot (6') high board-on- board fence along the north property line as a screen for the existing homes on Highland Avenue. 2. The Petitioner shall submit a revised landscape plan for approval by the Department of Planning and Zoning. 3. The patios encroaching into the perimeter yard shall be BA 65-SU-91 Page 2 of 2 no larger than eight feet by twelve feet (8' x 12'), leaving a twelve foot (12') rear yard. SECTION THREE: That this Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
