ORDINANCE NO. 4216 AN ORDINANCE AMENDINGARTICLE II OF CI{APTER 2 OF THE VILLAGE CODE OF MOUNT PROSPECT BE IT ORDAINED BY THE PRESIDENT A~D BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That Section 2.201.B entitled "Conduct of Business" of Chapter 2 of the Village Code of Mount Prospect, as amended, is hereby further amended by adding a sub-paragraph 4; so that hereinafter said Section 2.201.B shall be and read as follows: " 4. For purposes of the Article II, a majority shall be more than one-half (1/2) of the President and Board of Trustees then holding office. " SECTION TWO: That Section 2.201.C entitled "Conduct of Business of Chapter 2 of the Village Code of Mount Prospect, as amended, is hereby further amended in its entirety; so that hereinafter said paragraph C of Section 2.201 shall be and read as follows: " C. When a Board Member is Not Required to Vote. 1. As a general rule, no member of the Board of Trustees or the President shall vote on a question in which he has a direct, personal, or pecuniary interest. In such case, the office of such person casting such "present" or "pass" vote shall be deemed vacant. 2. While it is the duty of every member of the President and Board of Trustees who has an opinion on any question in which he has no direct, personal or pecuniary interest, to express it by his vote, such member cannot be compelled to do so. a. Such member may prefer to abstain from voting. b. In such instances, a vote "present" or "pass" shall be considered a vote on the prevailing side upon announcing the adoption or rejection or a motion on the floor. " SECTION THREE: That this Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
