CAF/ 8/13/90 ORDINANCE NO. 4221 AN ORDINANCE GRANTING VARIATIONS FOR PROPERTY COMMONLY KNOWN AS 319 SOUTH BEVERLY LANE WHEREAS, Paul A and Barbara J. Maier (hereinafter referred to as- Petitioners) have filed an application for variations from Chapter 14 of the Village Code of Mount Prospect, Illinois, for property commonly known as 319 South Beverly Lane (hereinafter referred to as Subject Property), legally described as: Lot 14 in Hatlen Heights Unit No. 4, a Subdivision of part of the Northeast 1/4 of Section 10, Township 41 North, Range 11, East of the Third Principal Meridian, according to Plat thereof registered in the office of the Registrar of Titles of Cook County, Illinois on OctOber 17, as Document Number 1702082; and WHEREAS, Petitioners seek variations from S~ction 14.1102.B to permit a side yard setback of six feet (6') instead of the required 10' in order to construct a room addition; and WHEREAS, a public hearing' was held on the variations requested being the subject of ZBA Case No. 53-V-90 before the Zoning Board of Appeals of the Village of Mount Prospect on the 12th day of July, 1990, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 26th day of June, 1990; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation ko the President and Board of Trustees of the Village of Mount Prospect and the President and Board of Trustees of the Village have given further consideration to the variations being the subject of ZBA 53-V-90 and have determined that the best interests of the Village of Mount Prospect would be served by granting said variations. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property a variation from Section 14.1102.B to permit a side yard of six feet (6') in order to add an addition to the existing single family dwelling. SECTION THREE: Except for the variations granted herein all other applicable Village of Mount Prospect Ordinances and regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: In accordance with the provisions of Section 14.604 of Chapter 14 of the Village Code, the variations granted herein BA 53-V-90 Page 2 of 2 shall be null and void unless permits are issued and construction begins within one (1) year from the date of passage of this Ordinance. SECTION FIVE: This Ordinance shall be in full ~force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
