CAF 12/11/91 ORDINANCE NO. 4376 AN ORDINANCE GRANTING A VARIATION FOR PROPERTY LOCATED AT 902 FEEHANVILLE DRIVE WHEREAS, the Stimsonite Corporation (hereinafter referred to as Petitioner) has filed an application for a variation from Chapter 14 of the Village Code of Mount Prospect, Illinois, for property commonly known as 902 Feehanville Drive (hereinafter referred to as Subject Property), legally described as: Lot 307 in Kensington Center Resubdivision VIII, being a subdvision of Lots 303, 305 and 307 in Kensington Center Phase 3-A in part of the Northwest Quarter of Section 35, Township 42 North, Range 11, East of the Third Principal Meridian, Cook County, Illinois and WHEREAS, Petitioner seeks a variation from Section 14.2202 to allow an existing utility transformer to encroach by eight feet (8') into the required 30 foot front yard; and WHEREAS, a public hearing was held on the variation requested being the subject of ZBA Case No. 73-V-91 before the Zoning Board of Appeals of the Village of Mount Prospect on the 14th day of November, 1991, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 29th day of October, 1991; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect and the President and Board of Trustees of the Village have given further consideration to the variation being the subject of ZBA 73-V-91 and have determined that the best interests of the Village of Mount Prospect would be served by granting said variation. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property a variation from Section 14.2202 to allow a utility transformer to encroach eight feet (8') into the' required front yard, subject to the condition that appropriate landscaping be planted in order to screen the transformer. SECTION THREE: Except for the variation granted herein, all other applicable Village of Mount Prospect Ordinances and regulations shall remain in full force and effect as to the Subject Property. SECTION FIVE: In accordance with the provisions of Section 14.604 of Chapter 14 of the Village Code, the variations granted herein shall be null and void unless permits are issued and construction BA 73-V-91 Page 2 of 2 begins within one (1) year from the date of passage of this Ordinance. SECTION SIX: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
