CAf/ ORDINANCE NO. 4206 AN ORDINANCE AMENDING'ORDINANCE NO. 2414 PROVIDING FOR AN AMENDMENT TO THE PLANNED UNIT DEVELOPMENT FOR PROPERTY COMMONLY KNOWN AS HUNTINGTON SQUARE APARTMENTS LOCATED WITHIN HUNTINGTON COMMONS WHEREAS, Huntington Limited Partnership (hereinafter referred to as Petitioner) has filed a petition for a Special Use with respect to property commonly known as Huntington Square Apartments and located at 1200 - 1380 South Elmhurst Road (hereinafter referred to as the Subject Property); and WHEREAS, the Subject Property is legally described as follows: That part of Lot 1 in Kenroy's Huntington, being a Subdivision of part of the EAst 1/2 of Section 14, Township 41 North, Range 11, East of the Third Principal Meridian described as follows: Commencing at the southeast corner of said Lot 1; thence south 88 degrees 59 minutes 01 seconds west, 673.17 feet along the south line of south Lot (being also the north line of the Commonwealth Edison Company right-of-way); thence south 79 degrees 30 minutes 45 seconds west, 215.00 feet along the southeasterly line of said lot; thence north 10 degrees 29 minutes 15 seconds west, 340.087 feet, perpendicularly to said southeasterly line; thence northeasterly 121.285 feet along the arc of a circle of 247.00 feet radius, convex to the southeast and whose chord bears north 24 degrees 32 minutes 55 seconds east; thence south 83 degrees 56 minutes 26 seconds east, 180.00 feet; thence south 48 degrees 42 minutes 16 seconds east 50.627 feet to a point of a line 352.00 feet (measured perpendicularly) north of and parallel with the south line of said lot; thence north 86 degrees 59 minutes 01 seconds east 251.328 feet along said parallel line; thence north 79 degrees 37 minutes 13 seconds east, 105.22 feet to a point 325.00 feed (measured perpendicularly) west of the east line of said lot; thence north 10 degrees 22 minutes 47 seconds west, 192.872 feet; thence north 9 degrees 45 minutes 52 seconds east, 117.236 feet; thence north 4 degrees 48 minutes 29 seconds west 158.00 feet; thence north 85 degrees 11 minutes 31 seconds east, 335.119 feet to a point of tangency; thence easterly 20.672 feet along the arc of a circle of 33.00 feet radius, convex to the north east and whose chord bears south 76 degrees 51 minutes 45.5 seconds east, to a point on the aforementioned east line of said lot; thence south 0 degrees 04 minutes 30 seconds west 849.591 feet along said east line to the place of beginning, in Cook County, Illinois and WHEREAS, a public hearing was held on the request for Special Use (designated as ZBA Case No. 38-SU-90) before the Zoning Board of Appeals of the Village of Mount Prospect on the 14th day of June, 1990, pursuant to proper legal notice having been published in the Mount Prospect Herald on the 8th day of May, 1990; and WHEREAS, the Zoning Board of Appeals has submitted its findings on the proposed Special Use to amend the Planned Unit Development to the President and Board of Trustees; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have determined that the best interests of the BA 38-SU-90 Page 2 of 2 Village of Mount Prospect will be served by the granting the request being the subject of ZBA 38-SU-90. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That the recitals set forth hereinabove are incorporated as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: That that portion of Exhibit ~ , being the Site Plan, attached to Ordinance No. 2414, passed and approved April 19, 1973, identified as "A" on Exbibit ~ and pertaining to the apartment complex immediately west of Elmhurst Road and south of Huntington Commons Road be and the same is hereby amended by substituting a new Exhibit for that apartment complex idetified herein, which substituted Exhibit is attached hereto and made a part hereof as Exhibit "X". The amendment being the subject of this Ordinance permits the construction of 86 garages for the benefit of the residents of Huntington Square Apartments, which garages shall be constructed using face brick on all four sides of the structures. A landscape plan shall be submitted for approval by the Planning and Zoning Department. SECTION THREE: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
