CAF/ 07/10/90 ORDINANCE NO. 4?07 AN ORDINANCE GRANTING VARIATIONS FOR PROPERTY COMMONLY KNOWN AS 2016 HOPI LANE WHEREAS, Iris Ann Malato (hereinafter referred to as Petitioner) has filed an application for a variation from Chapter 14 of the Village Code of Mount Prospect, Illinois, for property commonly known as 2016 Hopi Lane (hereinafter referred to as Subject Property), legally described as: Lot 1 in Resubdivision of Lots 98 and 99 in the Resubdivision of Lots 1 to 129, inclusive (except Lot 87), in Forest Manor Unit No. 4, being a subdivision in the Southwest Quarter (1/4) and the Southeast Quarter (1/4) of section 25, Township 42 North, Range 11, East of the Third Principal Meridian, according to Plat of said Resubdivision registered in the Office of the Registrar of Titles of Cook County, Illinois, on May 9, 1968 as Document Number 2386913 and WHEREAS, Petitioner seeks a variation from Section 14.3016.A.1 to permit a circular driveway resulting in an lot coverage of 40% in a required front yard; and WHEREAS, a public hearing was held on the variations requested being the subject of ZBA Case No. 41-V-90 before the Zoning Board of Appeals of the Village of Mount Prospect on the 14th day of June, 1990, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 29th day of May, 1990; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect and the President and Board of Trustees of the Village have given further consideration to the variations being the subject of ZBA 41-V-90 and have determined that the best interests of the Village of Mount Prospect would be served by granting said variations. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property a variation from Section 14.3016.A.1 to permit a circular driveway resulting in a lot coverage of 40% in a required front yard, as indicated on the site plan attached hereto and hereby made a part hereof as Exhibit "A". SECTION THREE: Except for the variations granted herein all other applicable Village of Mount Prospect Ordinances and regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: In accordance with the provisions of Section 14.604 of Chapter 14 of the Village Code, the variations granted herein BA 41-V-90 Page 2 of 2 shall be null and void unless permits are issued and construction begins within one (1) year from the date of passage of this Ordinance. SECTION FIVE: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
