CAF/ 07/10/90 ORDINANCE NO. 4209 AN ORDINANCE GRANTING VARIATIONS FOR PROPERTY COMMONLY KNOWN AS 203 NORTH RUSSEL STREET WHEREAS, Thomas and Rosemary Groenwald (hereinafter referred to as Petitioners) have filedan application for variations from Chapter 14 of the Village Code of Mount Prospect, Illinois, for property commonly known as 203 North Russel Street (hereinafter referred to as Subject Property), legally described as: Lot 13 in Block 6 in Hillcrest, being a Subdivision of the Northeast quarter of the Southwest quarter (except the North 2 7/8 acres thereof) in Section 34, Township 42 North, Range 11, East of the Third Principal Meridian, also the North 23.5 acres of the Southeast quarter of the Southwest quarter, except the West 295.1 feet of the South 295.1 feet lying North of the South 543 feet of the East half of the Southwest quarter of said SEction 34, Township 42 North, Range 11 East of the Third Principal Meridian, in Cook County, Illinois and WHEREAS, Petitioners seek variations from Section 14.102.B.2 to permit a three foot (3') rear yard setback and a one foot six inch (1' 6") side yard setback and, a variation from Section 14.1102.E to permit a lot coverage of 47.5%; and WHEREAS, a public hearing was held on the variations requested being the subject of ZBA Case No. 43-V-90 before the Zoning Board of Appeals of the Village of Mount Prospect on the 14th day of June, 1990, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 29th day of May, 1990; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect and the President and Board of Trustees of the Village have given further consideration to the variations being the subject of ZBA 43-V-90 and have determined that the best interests of the Village of Mount Prospect would be served by granting said variations. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property a variation from Section 14.102.B.2 to permit a three foot (3') rear yard setback and a one foot six inch (1' 6") side yard setback and, a variation from Section 14.1102.E to permit a lot coverage of 47.5%, providing for the construction of a new detached garage. The existing gravel driveway shall be paved in conjunction with the garage construction. SECTION THREE: Except for the variations granted herein all other applicable Village of Mount Prospect Ordinances and regulations BA 43-V-90 Page 2 of 2 shall remain in full force and effect as to the Subject Property. SECTION FOUR: In accordance with the provisions of Section 14.604 of Chapter 14 of the Village Code, the variations granted herein shall be null and void unless pez~its are issued and construction begins within one (1) year from the date of passage of this Ordinance. SECTION FIVE: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet fozq~ in the manner provided by law.
