CAF 2/12/92 ORDINANCE NO. 4402 AN ORDINANCE GRANTING A VARIATION FOR PROPERTY LOCATED AT 106 NORTH EMERSON' STREET WHEREAS, Marc A. Jensen (hereinafter referred to as Petitioner) has filed an application for a variation from Chapter 14 of the Village Code of Mount Prospect, Illinois, for property commonly known as 106 North Emerson Street (hereinafter referred to as Subject Property), legally described as: Lot 116 in Laudermilk Villa, being a subdivision in the southeast 1/4 of Section 34, Township 42 North, Range 11, East of the Third Principal Meridian in Cook County, Illinois; and WHEREAS, Petitioner seeks a variation from Section 14.102.B.2 to allow a detached garage to be constructed two feet six inches (2' 6") from the side lot line, rather than the required 5 feet; and WHEREAS, a public hearing was held on the variation requested being the subject of ZBA Case No. 4-V-92 before the Zoning Board of Appeals of the Village of Mount Prospect on the 23rd day of January, 1992, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 7th day of January, 1992; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect and the President and Board of Trustees of the Village have given further consideration to the variation being the subject of ZBA 4-V-92 and have determined that the best interests of the Village of Mount Prospect would be served by granting said variation. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property a variation from Section 14.102.B.2 to allow a detached garage to be constr~cted two feet six inches (2' 6") from the side lot line, as shown on the Site Plan attached hereto and hereby made a part hereof as Exhibit "A". SECTION THREE: Except for the variation granted herein, all other applicable Village of Mount Prospect Ordinances and regulations shall remain in full force and effect as to the Subject Property. SECTION FIVE: In accordance with the provisions of Section 14.604 of Chapter 14 of the Village Code, the variations granted herein shall be null and void unless permits are issued and construction begins within one (1) year from the date of passage of this Ordinance. SECTION SIX: This Ordinance shall be in full force and effect from BA 4-V-92 Page 2 of 2 and after its passage, approval and publication in pamphlet form in the manner provided by law.
