CAF 5/13/92 ORDINANCE NO. 4432 AN ORDINANCE GRANTING A SPECIAL USE FOR PROPERTY COMMONLY KNOWN AS 309 NORTH WESTGATE ROAD WHEREAS, Mario Gambino (hereinafter referred to as Petitioner) has filed an application for a special use permit, as provided in Chapter 14 of the Village Code of Mount Prospect, Illinois, for property commonly known as 309 North Westgate Road (hereinafter referred to as Subject Property), legally described as: Lot 11 (except the North 165.36 feet thereof; and except the East 366 feet of that part lying South of the North 165.36 feet thereof) in C. A. Goelz' Prospect Gardens, being a subdivision of the West 1/2 of the West 1/2 of the Southeast 1/4 together with the East 2/3 of the North 3/4 of the Northeast 1/4 of the Southwest of Section 35, Township 42 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois and WHEREAS, Petitioner seeks a Special Use to allow a satellite antenna with a diameter of ten feet (10') ~ and WHEREAS, a public hearing was held on the special use requested, being the subject of ZBA Case No. 23-SU-92 before the ~Zoning Board of Appeals of the Village of Mount Prospect on the 23rd day of April, 1992, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 7th day of April, 1992; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect and the President and Board of Trustees of the Village have given further consideration to the special use request, being the subject of ZBA 23-SU-92, and have determined that the best interests of the Village of Mount Prospect would be served by granting said special use. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant a Special Use to allow a satellite antenna with a diameter of ten feet (10') located on the Subject Property, subject to placing the satellite dish at the same setback as the existing dog house, and provided that landscaping be planted a minimum of six feet (6') in height to screen the satellite dish. SECTION THREE: Except for the variation granted herein, all other applicable Village of Mount Prospect Ordinances and regulations shall remain in full force and effect as to the Subject Property. SECTION FIVE: This Ordinance shall be in full force and effect BA 23-SU-92 Page 2 of 2 from and after its passage, approval and publication in pamphlet form in the manner provided by law.
