COI~ICATIONS AND.PETITIONS, C~TIZENS TO BE HEARD~_~ STORM WATER Clarence Bobikewiez, 1114 Meadow Lane, asked for an update on the problem he brought up at the last meeting relative to water run-off in his rear yard and cleaning culverts.' Mr. Janonis stated that members of ~taff had visited the site and spoke to Mrs. Bobikewiez. It was noted that the culverts were the reSPOnsibility of the individual homeowners, however Public Works crews will flush out debris. CHILDP~ENS FIRE Mayor Farley proclaimed the week of May 3 - 7, 1993 SAFETY FESTIVAL as CHILDREN'S FIRE SAFETY FESTIVAL WEEK, to be held at Randhurst. CANCER CONTROL Mayor Farley proclaimed the week of April 17 - 25, WEEK 1993 as CANCER CONTROL. WEEK in the Village. CLASS "R" LIQUOR A request was presented from the new owners of the LICENSE: establishment known as Boo I1 Restaurant, 1144 South JA/~G SOO Elnuhurst Road, to continue operation under the · existing Class "R" liquor license. It was noted that the new name for this establishment will be Jang Soo Restaurant. Trustee Busse, seconded by Trustee Clowes, moved to authorize the restaurant located at 1144 South Elmhurst Road, formerly known as Boo Il, now known as Jang Soo Restaurant, to continue operation under the e.xisting'Class'"R"' liquor license. OLD 'BUSINESS ZBA 8-SU-93 and ZBA 8-SU-93 and ZBA 9-V-93, 1216 Crabtree Lane ZBA 9-V-93 An Ordinance was presented for first reading that would grant a special Use to a.llow a garage to house a commercial vehicle with a licensed weight of more than 8,000 lbs and a variation to allow an accessory structure with a height of 12' 6", instead of the maximum 12 feet. The Zoning Board of A~peals recommended granting these requests by a vote of 5-1. Several questions were asked by a resident opposing these requests. The Petitioner was asked to respond to the concerns prior to the next meeting of the Village Board. Page 2 - April 21, 1993 This Ordinance will be presented for second reading on May 4th. ZBA 15-V-93, 717 North Forest Avenue ZBA 15-V-93 An Ordinance was presented for first reading that 717 N. FOREST AVE would grant a 3 foot interior sideyard setback, · instead of.the 5 foot minimum allowed, and a · variation to allow a driveway width of 22' 6", instead of the maximum 21 feet alloWed. ZBA 16-Z-93 and ZBA 17-V-93, 1026 Linneman Road ZBA 16-Z-93 & An Ordinance was presented for first reading that 2ZBA 17-V-93 would rezone the subject property from R-X to R-1. 1026 LINNE~ The Zoning Board of.Appeals recommended granting this request by a vote of 6-0. Also requested are modifications from the Development Code (Chapter 16) to waive the requirement to install sidewalks, curb and gutter, street·lighting and s-treet paving. The Plan Commission recommended granting these-modifications· by a vote of 7-0, subject to' the. Petitioner executing a Restrictive Covenant agreeing to install the 'improvements when required by the Village. ZBA 20-Z-93 and ZBA 20-Z-93 and ZBA 21-SU-93, 1000 Central Road ZBA 21-SU-93 /%n Ordinance was presented for first reading that 1000 CENTRAL ROAD would rezone the subject property from I~l (Light Industrial) to R-3 (Apartment Residence). The Zoning Board of Appeals.reco~ended granting this request by a vote of 4-2. Also presented for first readings was an Ordinance granting a Special Use to allow a Planned Unit Development consisting of 9 single family homes and 54 townhomes on this 8.76 acre site. The Zoning Board of A~peals reco~ended granting this request by a vote of 4-2. An Ordinance amending the official Comprehensive Plan .to reflect the R-3 zoning was also presented for first reading. The Plan Commission recommended granting this amendment by a vote of 7-0. Page 4 - April 21, 1993 An Ordinance was presented for first reading that would grant modifications from the Development Code (Chapter 16) relative to right-of-way width and setback.distance between a structure and detention area. The Zoning Board of Appeals recommended granting these requests by a Vote of 7-0. These Ordinances will be presented fo~ second readings. at the May 4th meeting of the Village Board. Trustee Hoefert arrived at this point in the meeting. ZBA 10-Z-93 and ZBA 11-SU-93, 412 - 414 E. Rand Road ZBA 10-Z-93 & The Petitioner is requesting the. subject property ZBA 11-SU-93 rezoned from B-2 to R-3 and a Special Use in the 414 E.RAND RD nature of a Planned Unit Development consisting of 11 townhomes on this 1.21 acre site at Hill Street and Rand Road. The Zoning Board of Appeals recommended granting these requests by a vote of 6-0. It was noted that this property was the subject of a rezoning request last year when the Petitioner was granted B-3 zoning in order to construct an office building.' The Petitioner stated that he thought the single family home owners in the area would prefer a different use therefore he is proposing this development. The following residents expressed concern about the proposed development: Bill Mundo, 522 Hill Street Ed Kowalski, 513 Eastman James Buscemi, 504 Eastman Bill Kurczodyna, 518 Hill Street John Dougherty, 520 Hill street MarSha Kurczodyna, 518 Hill Street Some of the concerns expressed were as follows: Detention Traffic congestion Asphalt-driveways instead of concrete Undergroundutilities Remove medianon Rand Road at Hill Street Density Landscaping Brick on 4 sides of building not just on front There was discussion as to what areas of input neighbors should have fordevelopments. Trustee Wilks offered to meet with the developer and neighbors in an effort'to work out the final areas of concern. Trustee Corcoran, seconded by Trustee Wilks, moved to concur with the recommendation of the Zoning Board of Appeals and grant the request to rezone the subject property from B-2 to R-3, being the subject of ZBA 10-Z-93. RELEASE EXECUTIVE A .Resolution was presented that would indicate SESSION MINUTES which, if any, minutes of Executive Sessions could be released from confidentiality. RES.NO. 15-93 Trustee Hoefert, seconded by Trustee Busse, moved for passage of Resolution No. 15-93.. A RESOLUTION DETERMINING WHETHER MINUTES OF EXECUTIVE SESSION MINUTES MAY BERELEASED Upon roll call: Ayes: Busse, Corcoran, Clowes, Floros, Hoefert, Wilks Nays: None Motion carried. AMEND CH. 2. An Ordinance was presented for first reading that would amend Article II of Chapter 2, entitled "Rules of Order". This'Ordinance clarifies and defines the various votes necessary in specific instances, sets forth the procedure involved with a veto and over-riding a veto, as well as general house-keeping. There was discussion~ as to whether the Village President actually has veto power, and that if such language were to be returned to theCode if that would constitute a change in the form of government. .It was suggested that if the interpretation was that having veto power was a change in operations, the question should be put. to the voters of the Village. Trustee Wilks asked that the Ordinance include language that would put the question to the voters as to whether the Village President should have a veto power. It was the opinion of the members of the Board that the Village should encourage the General A~sembly to adopt legislation clarifying this issue, however, if no legislation is presented or pending by November, 1996, the question of whether the Village President shOuld have the veto power should be put to the voters in the form of a referendum, as suggested by Trustee Wilks. This Ordinance, as amended, will be presented May 4th for second reading. AMEND CH. 4 An Ordinance was presented for first reading that would, in accordance with the proposed amendments to Chapter 2, establish an extraordinary vote when waiving the bidding procedure for the purchase of specific equipment. An Ordinance was presented for first reading that, AMEND CH. 8 in accordance with the proposed amendments to Chapter 2, would amend Article V entitled "Other Regulations" of Chapter .8 of the Village Code as it pertains to entering into an agreement with property owners outside the corporate limits of the Village. This Ordinance will be presented May 4th for second reading. A Resolution Was presented declaring the results of ELECTION of the General Election held A~Dril 20, 1993 for Mayor, 3 Trustees and 3 Library Trustees. Trustee Hoefert, seconded by Trustee Corcoran, moved RES.hD~16-93 for passage of Resolution No. 16-93 -A RESOLUTION DECLARING THE RESULTS OF. THE CONSOLIDATED ELECTION HELD APRIL 20, 1993. An Ordinance was presented for first reading that would adopt the annual budget for fiscal year 1993/94. Page 9 - April 21, 1993 PUBLIC.HEARING PUBLIC HEARING BUDGET 1993/94 Mayor Farley called a Public Hearing to order at 10:36 P.M. The purpose of this Public Hearing was to consider the adoption of the annual budget for the Village for fiscal year 1993/94. Mayor Farley noted that the proposed budget reflects an increase of 2.68% for a. ·total of $·46,462,370.00 which amount does not include the· .amount bUdgeted by the Mount Prospect Public Library Board. ~-~ There was no participation from the audience. Mayor Farley declared the Public Hearing closed at 10:43 P.M. ORD.NO. 4538 'Trustee Clowes, seconded by Trustee Hoefert, moved for passage of Ordinance No. 4538 AN ORDINANCE ~OPTING AN ANNUAL BUDGET FOR THE VILLAGE OF MOUNT PROSPECT FOR THE FISCAL YEAR COMMENCING MAY 1, 1993 TO A~RIL 30, 1994 IN LIEU OF PASSAGE OF AN APPROPRIATION ORDINANCE Upon r011 call: Ayes: Busse, Clowes, Corcoran, Floros, Hoefert, Wilks Nays: None Motion carried. BOND ISSUE An Ordinance was 'presented for second reading that 1993A & 1993B would authorize the issuance of $2,160,000 General Obligation Bonds, Series 1993A and $7,840,00. General Obligation Bonds, Series 1993B. ~. Mr. Jepson noted that bond bids had been opened earlier that day and due to the interest rate on those bonds, the Village would realize a savings of approximately $444,000 over the life Of·the bO~ds. Trustee Wilks, seconded by Trustee Hoefert, moved to accept the bid from Harris Bank for the 1993 Series bonds, reflecting an interest rate of 4.469%. Mr. Janonis asked the Board to consider an item ITEM NOT not listed on the agenda, noting that it had come LISTED: to the attention of staff earlier in the day that IEPA LOAN the IEPA required a Resolution authorizing the DOCL74ENTS Village Manager to sign loan application documents relative to the storm water projects in the Village. It was noted that an Ordinance was passed last year authorizing the Mayor to execute these documents, then a Resolution was adopted authorizing the Village Manager to execute the documents, all consistent with directions from the IEPA, however, in order to be consistent, it is the recommendation of the IEPA that a Resolution be adopted giving one person, the Village Manager, authorization for executing loan. application documents. The subject of discussion would be the proposed improvement of Linneman Road. The Village Manager also stated that the committee of the Whole Meeting Will be held April 27th, with discussion to be the results of the TEEN Committee relative to parental responsibility and tagging kegs of beer. EXECUTIVE SEssION Mayor Farley noted that an Executive Session would be necessary'in order to discussion Personnel.
