AN ORDINANCE AMENDING THE IMPLEMENTATION DATE OF THE AMUSEMENT
TAX CONTAINED IN CHAPTER 8, ARTICLE XXVI, "AMUSEMENT TAX ON PLAYS
OF VIDEO GAMING TERMINALS" OF THE VILLAGE CODE OF MOUNT
PROSPECT, ILLINOIS
WHEREAS, the Village of Mount Prospect (the "Village") is a home rule
municipality, having all of the powers and authority granted to such municipalities
pursuant to Article VII, Section 6 of the Illinois Constitution of 1970, including the right to
exercise any power and perform any function pertaining to its government and affairs;
and
WHEREAS, the Illinois Video Gaming Act, 230 ILCS 40/1, et seq., as amended,
regulates the operation, licensing, and administration of video gambling; and
WHEREAS, the Village desires to impose a tax upon the amusement of playing a
video gaming terminal within the Village ("Push Tax"); and
WHEREAS, the President and Board of Trustees of the Village of Mount
Prospect approved a Push Tax with Ordinance No. 6584, approved on the 31st day of
October, 2021 via reconsideration on November 2, 2021; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect
adopted Ordinance No. 6623 amending Chapter 8, Article XXVI, "Amusement Tax On
Plays Of Video Gaming Terminals" of the Village Code of Mount Prospect, Illinois to the
first day of May 2024.
WHEREAS, the Village desires to postpone further the implementation of said
Push Tax; and
WHEREAS, pursuant to the authority granted under the Illinois Municipal Code
and in accordance with home rule authority granted home rule municipalities, the
President and Board of Trustees of the Village of Mount Prospect approve the
amendments as set forth below.
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS:
„SggTION ONE:. That the recitals set forth hereinabove are incorporated herein
as findings of fact by the President and Board of Trustees of the Village of Mount
Prospect.
: The implementation date of the Push Tax approved by
Ordinance No. 6584 and contained in Chapter 8, Article XXVI, "Amusement Tax On
Plays Of Video Gaming Terminals" of the Village Code of Mount Prospect, Illinois, shall
be amended to the first day of May 2029.
SECTION THREE: This Ordinance shall be in full force and effect from and after
its approval, adoption, and publication in the manner provided by law, provided, however,
the tax provided for herein shall apply to and for all pushes on or after the first day of May,
2029.
