CAF/ 9/21/92 ORDINANCE NO. 4476 AN ORDINANCE GRANTING A VARIATION FOR PROPERTY LOCATED AT 50 SOUTH EMERSON STREET (MOUNT PROSPECT SENIOR CITIZEN CENTER BUILDING) WHEREAS, the Village of Mount Prospect (hereinafter referred to as Petitioner) has filed an application for variations from Chapter 14 of the Village Code of Mount Prospect, Illinois, for property commonly located at 50 South Emerson Street (hereinafter referred to as Subject Property), legally described as: Lots 8, 9, 10 and 11 in Busse and Wille's Resubdivision in Mount Prospect in the West Half of Section 12, Township 41 North, Range ll, East of the Third Principal Meridian, Cook County, Illinois and WHEREAS, Petitioner seeks a variation from Section 14.1803 to allow a maximum land coverage of 90.05%, instead of the permitted maximum of 75% and a variation from Section 14.3012 to allow 39 parking spaces, instead of the required 55 parking spaces, in order to construct an addition to the Senior citizen Center Building; and WHEREAS, a public hearing was held on the variations requested being the subject of ZBA Case No. 62-V-92 before the Zoning Board of Appeals of the Village of Mount Prospect on the 10th day of September, 1992, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 26th day of August, 1992; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect and the President and Board of Trustees of the Village. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant the following: 1. A variation from Section 14.1803 to allow a maximum land coverage of 90~05%, rather than the permitted maximum of 75%. 2. A variation from Section 14.3012 to allow 39 parking spaces, rather than the required number of 55 spaces. The variations granted herein shall be in accordance with the Site Plan attached hereto and hereby made a part hereof as Exhibit "A". SECTION THREE: Except for the variations granted herein, all other applicable Village of Mount Prospect Ordinances and regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: In accordance with the provisions of Section 14.604 of Chapter 14 of the Village Code, the variations granted herein shall be null and void unless permits are issued and BA 62-V-92 Page 2 of 2 construction begins within one (1) year from the date of passage of this Ordinance. SECTION FIVE: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
