HomeMy WebLinkAboutOrd 4486 11/04/1992 ORDINANCE NO. 4486 AN ORDINANCE AMENDING CHAPTER 7 ENTITLED "SIGN REGULATIONS" OF THE VILLAGE CODE OF MOUNT PROSPECT PASSED AND APPROVED BY THE PRESIDENT AND BOARD OF TRUSTEES the 4th day of November , 1992 Published in pamphlet form by ~authority of the corporate ~iauthorities of the Village of Mount Prospect, Illinois, the 5th day of Nove~er , 1992. 10/15/92 ORDINANCE NO. 4486 AN ORDINANCE AMENDING CHAPTER 7 ENTITLED "SIGN REGULATIONS~ OF THE VILLAGE CODE OF MOUNT PROSPECT WHEREAS, Charles Vavrus (d/b/a as Charlie Club), hereinafter referred to as Petitioner, has filed a request to amend Chapter 7 (Sign Regulations) of the Village Code of Mount Prospect by creating a category for "off-premise" signs; and WHEREAS, the Sign Review Board did consider the request, being the subject of Sign Review Case No. 24-92 followiong due and proper notice having been published in the Mount Prospect Herald on April 10, 1992, at their regular meeting held on May 4, 1992, August 31, 1992 and September 14, 1992; and WHEREAS, the Sign Review Board has forwarded their recommendation to the President and Board of Trustees of the Village of Mount Prospect; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect has considered the proposed amendment to Chapter 7 and have determined that the best interests of the Village would be served by approving the proposed amendment. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That the recitals set forth hereinabove are incorporated as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: That Section 7.330 of Article III entitled "General Provisions" of Chapter 7 (Sign Regulations) of the Village Code of Mount Prospect, as amended, is hereby further amended by adding thereto paragraph E; so that hereinafter said Section 7.330 shall include the following: " E. Off-premise Business Identification Signs. The following standards shall apply: 1. The sign must direct attention to a business on a lot adjacent to the lot on which the sign is located. 2. The sign must be located on a lot which is adjacent to a major arterial street. 3. The number of free-standing signs permitted by this Article shall not be increased by the placement of the off-premise sign. 4. The lot on which the business to be benefitted by the off-premise sign must not have any frontage on an arterial street. 5. An easement or license must be granted allowing the placement of the off-premise sign. 6. The sign may contain changeable copy as provided for in Section 7.325.E of this Chapter. SECTION THREE[ That Section 7.701 of Article VII entitled hapter 7 Page 2 of 2 "Appeals, Variations and Special Uses" of Chapter 7 (Sign Regulations) of the Village Code of Mount Prospect, as amended, is hereby further amended; so that hereinafter said Section 7.701 shall be and read as follows: " Seo. 7,70~. Boope of Appeals, Variations and Speaial Uses. An appeal from a staff decision made in interpreting, applying and/or enforcing the regulations contained in this Chapter may be taken to the Sign Review Board. A variation may be requested from the height, area, and minimum distance requirements contained in this Chapter, provided that no variation shall exceed the maximum height, sign area, and distance requirements by more than twenty-five percent (25%). A special use may be requested to. permit an electronic message center, development identification signs, non-conforming wall signs and the equity option, and off-premise business identification signs. " SECTION FOUR: That this Ordinance shall ~be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
