CAF 10/28/92 ORDINANCE NO. 4489 AN ORDINANCE GRANTING A VARIATION FOR PROPERTY LOCATED AT 204 SOUTH SEE GWUN WHEREAS, Kenneth R. Zidek, (hereinafter referred to as Petitioner) has filed an application for a variation from Chapter 14 of the Village Code of Mount Prospect, Illinois, for property generally located at 204 South See Gwun (hereinafter referred to as Subject Property), legally described as: Lot 134 in Tow~ Development Company's We Go Park Unit #2, being a subdivision of the West Half o the Northeast fractional Quarter and the East Half of the Northwest fractional Quarter of section 11, Township 41 North, Range 11, East of the Third Principal Meridian also The South Half of the 20 foot vacated alley lying north of adjoining parcel 1 in Cook County, Illinois and WHEREAS, Petitioner seeks a variation from Section 14.1102.B.1 allow a five foot (5') setback along the interior side yard, instead of the minimum 7.5', in order to allow construction of a two car attached garage; and WHEREAS, a public hearing was held on the variation requested being the subject of ZBA Case No. 71-V-92 before the Zoning Board of Appeals of the Village of Mount Prospect on the 22nd day of October, 1992, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 6th day of October, 1992; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect and the President and Board of Trustees of the Village have given further consideration to the variation being the subject of ZBA 71-V-92 and have determined that the best interests of the Village of Mount Prospect would, be served by granting said variation. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property a variation from Section 14.1102.B.2 to allow a five foot (5') setback along the interior side yard, instead of the required minimum of 7.5' required, in order to construction a 2-car attached garage. SECTION THREE: Except for the variation granted herein, all other applicable Village of Mount Prospect Ordinances and regulations shall remain in full force and effect as to the Subject Property. SECTION FIVE: In accordance with the provisions of Section 14.604 of Chapter 14 of the Village Code, the variations granted herein shall be null and void unless permits are issued and construction BA 71-V-92 Page 2 of 2 begins within one (1) year from the date of passage of this Ordinance. SECTION SIX: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
