CAF/ 5/11/93 ORDINANCE NO. 4553 AN ORDINANCE GRANTING VARIATIONS FOR PROPERTY COMMONLY KNOWNAS 1308 LAMA LANE WHEREAS, James and Barbara Handschiegel (hereinafter referred to as Petitioners) have filed an application for variations from Chapter 14 of the Village Code of Mount Prospect, Illinois, for property commonly known as 1308 Lama Lane (hereinafter referred to as Subject Property), legally described as: Lot 60 in Tree Farm Estates, being a subdivision of part of the South 1/2 of the Northeast 1/4 of Section 25, Township 42 North, Range 11, East of the Third Principal Meridian, according to the plat thereof recorded as document number 24113330 and registered in the Office of the Registrar of Titles of Cook County, Illinois as Document LR 2968157 in Cook County, Illinois; and WHEREAS, Petitioners requested the following: 1. A Special use to permit a garage designed to house more than 2 vehicles, 2. A variation from Section 14.1102.B to allow a side yard setback of 3 feet, instead of the minimum allowed 6.5 feet, 3. A variation from Section 14.3016 to allow a driveway width of 27 feet, instead of the maximum allowed 21 feet, and 4. A variation from Section 14.1102.A to allow a front yard lot coverage of 38%, instead of the maximum allowed 35%; and WHEREAS, a public hearing was held on the Special Use being the subject of ZBA Case No. 26-SU-93 and the variations being the subject of ZBA Case No. 27-V-93 before the Zoning Board of Appeals of the Village of Mount Prospect on the 22nd day of April, 1993, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 6th day of April, 1993; and WHEREAS, the Zoning Board of Appeals did consider the requests stated herein and have forwarded their recommendation to the President and Board of Trustees of the Village of Mount Prospect. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant a variation from Section 14.3016 to allow a driveway with a width of twenty-seven feet (27'), rather than the permitted 21', and a variation from Section 14.1102.A to allow a front yard lot coverage of 38%, instead of the maximum allowed 35%. BA 27-V-93 Page 2 of 2 SECTION THREE: Except for the variations granted herein all other applicable Village of Mount Prospect Ordinances and regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: In accordance with the provisions of Section 14.604 of Chapter 14 of the Village Code, the variations granted herein shall be null and void unless permits are issued and construction begins within one (1) year from the date of passage of this Ordinance. SECTION FIVE: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
