The South 1653.37 feet of the East Half (~) of the Southwest Quarter (t) (measured on the East line of said tract) of Section 35, Township 42 North, Range 11, East of the Third Principal Meridian (excepting from said tract that part thereof described as follows: Commencing at the Southeast corner of the Southwest Quarter of Section 35, Thence West along the South line of the said Southwest Quarter for a distance of 1108.91 feet, thence North along a line which makes an angle of 9000' with the last described line for a distance of 33.0 feet to an intersec- tion with the North line of Central Road for a beginning; thence West along the North line of Central Road for a distance of 150.0 feet, thence North along a line which makes an angle of 9000' with the last described line for a distance of 158.47 feet to an intersection with the Southerly right of way line of Rand Road (Route #12) thence Southeasterly along the said Southerly Right of Way line of Rand Road for a distance of 178.29 feet to a point on the West line of Mt. Prospect Road extended North, thence South 62.11 feet along said West line to the point of beginning; and excepting from said tract that part thereof described as follows: Commencing at the Southeast corner of the South- west Quarter of Section 35 thence West along the South line of the said Southwest Quarter for a distance of 1318.91 feet, thence North along a line which makes an angle of 9000' with the last described line for a distance of 33.0 feet to an intersection with the North line of Central Road for a beginning; thence East along the North line of Central Road for a distance of 60.0 feet, thence North along a line which makes an angle of 9000' with the last described line for a distance of 158.47 feet to an intersection with the southerly right of way line of Rand Road (Route lt12) thence Northwesterly along the Southerly Right of Way line of Rand Road for a distance of 71.27 feet to a point, thence South along a line which makes an angle of 57017' with the last . -? - 2 - described line measured from Southeast to South for a distance of 197.02 feet to the point of beginning) , A L S 0 The Southwest Quarter (t) of the Southwest Quar- ter (t) of Section 35, Township 42 North, Range 11, East of the Third Principal Meridian (ex- ceptin~ from said tract that part of the South Half (2) of said Southwest Quarter (t) of the Southwest Quarter lying \Jest of Rand Road in Cook County, Illinois. , and WHEREAS, in connection with the annexation of said property and in the interests of public welfare, safety and health of the residents of the Village of Mount Prospect the corporate authorities of the said Village deemed it necessary to determine the proper zoning to be applied to said property when so annexed; and WHEREAS, a Notice of Public Hearing with respect to the question of establishing zoning of the aforesaid property was duly published in the Mount Prospect Herald, a newspaper of general circulation in the Village of Mount Prospect; and WHEREAS, a Public hearing was held by the Board of Appeals of the Village of Mount Prospect in the Village Hall in the Village of Mount Prospect on the 29th day of August, 1958, at the hour of 8:00 P. M. pursuant to the provisions of the aforesaid Public Notice, and all persons who desired to be heard were heard, and an opportunity given to all persons who desired to make remonstrances and objections with references thereto; and WHEREAS, the Board of Appeals of the Village of Mount Prospect, subsequent to said Public Hearing, recommended - 3 - by letter dated September 18, 1958, that if said property be annexed to the Village of Mount Prospect the aforesaid property be zoned in accordance with their recommendation and thereafter upon further consideration of said matter by a proper committee of the Board of Trustees of said Village, the corporate authorities of the Village of Mount Prospect do hereby find that it is in the public interest and will aid and promote the public safety, health and welfare of the residents of the Village of Mount Prospect to zone the property as hereinafter set forth: NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: Section 1: That an ordinance entitled, "An Ordinance classifying, regulating and restricting the location of trades and industries and the location of buildings designed for specified uses; regulating and limiting the height and bulk of buildings hereafter erected or altered, regulating and limiting the intensity of the use of lot areas and regulating and determining the area of yards, courts and other open spaces within and surrounding such buildings; establishing the boundaries of districts for said purposes; and prescribing penalties for the violation of its provisions" passed and approved December 4, 1923 and amendments thereto (and known as Ordinance No. 52) as amended, be further amended by classifying the following described real estate as a B-1 District: B-1 District (Business-Shopping Center) The South 1653.37 feet of the East Half (~) of the Southwest Quarter (t) (measured on the East - 4 - line of said tract) of Section 35, Township 42 North, Range 11, East of the Third Principal Meridian (excepting from said tract that part thereof described as follows: Commencing at the Southeast corner of the Southwest Quarter of Section 35, Thence West along the South line of the said Southwest Quarter for a distance of 1108.91 feet, thence North along a line which makes an angle of 9000' with the last described line for a distance of 33.0 feet to an intersec- tion with the North line of Central Road for a beginning; thence West along the North line of Central Road for a distance of 150.0 feet, thence North along a line which makes an angle of 9000' with the last described line for a distance of 158.47 feet to an intersection with the Southerly right of way line of Rand Road (Route #12) thence Southeasterly along the said Southerly Right of Way line of Rand Road for a distance of 178.29 feet to a point on the West line of Mt. Section 2: That the Zoning Plan of the Village of Mount Prospect as amended, be and the same is hereby - 5 - amended to conform to the above change. Section 3: That this Ordinance shall be in full force and effect from and after its passage, approval and publi- cation according to law. Section 4: That all ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed, reserving however, to the Village of Mount Prospect any rights which have accrued to it against any person, firm or corporation under any ordinance or sections of said Zoning Ordinance which may be and are hereby repealed.
