HomeMy WebLinkAboutOrd 635 10/14/1958 ORDINANCE NO. v AN ORDINANCE AMENDING THE VILLAGE OF MOUNT PROSPECT ZONING ORDINANCE AS AMENDED WHEREAS, the corporate authorities of the Village of Mount Prospect on the /11"'!~ day of (({-I;.It. v , 1958, annexed to the Village of Mount Prospect the following- described property: That part lying South of Rand Road of the Northwest Quarter of the Northeast Quarter of Section 34, Town- ship 42 North, Range 11, East of the Third Principal Meridian, also that part lying south of Rand Road of the Northeast Quarter of the Northeast Quarter of said Section 34 described as follows: Commencing at the Southwest corner of the said Northwest Quarter of the Northeast Quarter of Section 34; thence East along the South line of the said Northwest Quarter of the Northeast Quarter for a distance of 57~.43 feet for a beginning, thence North along a line and parallel to the North and South quarter line of Sec- tion 34 for a distance of 433.58 feet; thence East along a line and parallel to the South line of the Northwest Quarter of the Northeast Quarter of Section 34 for a distance of 533.91 feet to an intersection with the center line of Rand Road thence Southeasterly along the said center line of Rand Road for a distance of 85.01 feet to the point of tangency of a curve, thence continuing Southeasterly along the said center line of Rand Road being a curved line convex to the Northeast and having a radius of 3657.30 feet for a distance of 503.25 feet to an intersection with the South line of the Northeast Quarter of the Northeast Quarter of said Section 34, thence West along the South line of said Northeast Quarter of the Northeast Quarter and the South line of the Northwest Quarter of the Northeast Quarter for a distance of 92&.54 feet to the point of beginning in Cook County, Illi- nois, containing 7.181 acres more or less. ! -' ; and WHEREAS, in connection with the annexation of said property and in the interests of public welfare, safety and health of the residents of the Village of Mount Prospect the corporate authorities of the said Village deemed it necessary to determine the proper zoning to be applied to said property when so annexed; and -2- WHEREAS, a Notice of Public Hearing with respect to the question of establishing zoning of the aforesaid property was duly published in the Mount Prospect Herald, a newspaper of general circulation in the Village of Mount Prospect; and WHEREAS, a Public Hearing was held by the Board of Appeals of the Village of Mount Prospect in the Village Hall in the Village of Mount Prospect on the 28th day of February, 1958, at the hour of 8:00 P.K. pursuant to the provisions of the aforesaid Public Notice, and all per- sons who desired to be heard were heard, and an opportunity given to all persons who desired to make remonstrances and objections with references thereto; and WHEREAS, the Board of Appeals of the Village of Mount Prospect, subsequent to said Public Hearing, recommended by letter dated April 7, 1958 that if said property be annexed to the Village of Mount Prospect the aforesaid property be zoned in accordance with their recommendation and thereafter upon further consideration of said matter by a proper com- mittee of the Board of Trustees of said Village, the corporate authorities of the Village of Mount Prospect do hereby find that it is in the public interest and will aid and promote the public safety, health and welfare of the residents of the Village of Mount Prospect to zone the property as herein- after set forth: NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSP~T, COOK COUNTY, ILLINOIS: Section 1: That an ordinance entitled, "An Ordinance classifying, regulating and restricting the location of trades and industries and the location of buildings designed for specified uses; regulating and limiting the height and -3- bulk of buildings hereafter erected or altered, regulating and limiting the intensity of the use of lot areas and regulating and determining the area of yards, courts and other open spaces within and surrounding such buildings; establishing the boundaries of districts for said purposes; and prescribing penalties for the violati on of its provisions" passed and approved December 4, 1923 and amendments thereto (and known as Ordinance No. 52) as amended, be further amended by classifying the following described real estate into the following Districts: B-3 District (Business-Retail Service): That part of the Northwest Quarter of the Northeast Quarter and the Northeast Quarter of the Northeast Quarter of Section 34, Township 42 North, Range 11 East of the Third Principal Meridian, which lies South of Rand Road and Southeasterly of a line drawn from a point on the South line of s aid North- west Quarter of Northeast Quarter, 112D.73 feet East of the West line of said Northwest Quarter of the Northeast Quarter, to a point on the center line of Rand Road 320.0 feet Northwesterly of the South line of the Northeast Quarter of the Northeast Quarter (measured on an arc, convexed Northeast, and having a radius of 3657.30 feet) of said Section 34, and That part of the Northwest Quarter of the Northeast Quarter of Section 34, TownShip 42 North, Range 11, East of the Third Principal Meridian de- scribed as follows: Beginning at a point on the East line of the West 959.43 feet of said Northwest Quarter of the Northeast Quarter, said point being 130.0 feet North of the South line of said Northwest Quarter of the Northeast Quarter; thence East parallel with the South line of said Northwest Quarter of the North- east Quarter 19~.O feet; thence Southeasterly to a point, said point being 127.86 Northeasterly of the South line of the Northwest Quarter of the North- east Quarter and on a line drawn from a point on the center line of Rand Road 320.0 feet North- westerly of the South line of the Northeast Quar- ter of the Northeast Quarter of said Section 34 (measured on an arc, eonvexed Northeasterly, and having a radius of 3657.30 feet) to a point on the South line of said Northwest Quarter of the Northeast Quarter, 112ID.73 feet East of the West line of the Northeast Quarter of said Section 34; thence Northeasterly along aforesaid mentioned -LI- " line to its intersection with the center line of Rand Road; thence Northwesterly along the center line of Rand Road to its intersection with a line, said line being 433.58 feet North of and parallel with the South line of said Northwest Quarter of the Northeast Quarter; thence West along said parallel line to the East line of the West 959.}~3 feet of said Northwest Quarter of the Northeast Quarter; thence South along said East line to the point of beginning, in Cook County, Illinois, and Excepting from all of the aforesaid a strip of land in the North ! P-3 District (Off-street Parking - Unpaved) A strip of land in the North ! of the Northeast t of Section 34, Township 42 North, Range 11 East of the Third Principal Meridian adjacent to the Westerly right of way of Rand Road extending to a line 110 feet Westerly of the center line of Rand Road and running parallel with the center line of Rand Road from the South line of the Northeast t of the Northeast t of Section 34 Northeasterly to its intersection with a line 433.58 feet North of and parallel with the South line of the Northwest t of the Northeast t of Section 34, the Westerly line of said strip continuing to its intersection with the aforesaid line which is 433.58 feet North of and parallel to the South line of the said Northwest t, in Cook County, Illinois. Section 2: That the Zoning Plan of the Village of Mount Prospect as amended, be and the same is hereby amended to conform to the above change. Section 3: That this Ordinance shall be in full force and effect from and after its passage, approval and publi- cation according to law. Section 4: That all ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed, reserving however, to the Village of Mount Prospect any rights which have accrued to it against any person, firm or corporation under any ordinance or sections of said Zoning Ordinance which may be and are hereby repealed.
