HomeMy WebLinkAboutOrd 642 11/25/1958 ,,;'~' : ORDINANCE NO. 6~ AN ORDINANCE Ar\1ENDING ORDINANCE NO. 632 OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS vrnEREAS, on August 11, 1958 a petition was filed with the Village Clerk of the Village of Mount Prospect requesting annexation to the Village of Mount Prospect of certain terri- tory described therein, said territory being contiguous to the Village of Mount Prospect but not within any municipality; and VIHEREAS, said petition recited therein that no ele.ctors resided on said territory and was signed under oath by the owners of record of all land within said territory; and VIHEREAS, on the 21st day of October, 1958 the President and Board of Trustees of the Village of Mount Prospect adopted Ordinance No. 632 providing for the annexation of the property described in the said petition; and vrnEREAS, the petitioners unintentionally included in the legal description of territory to be annexed, set forth in the said petition, a legal description of certain land lying west of the southwesterly line of Rand Road and said legal description was thereby incorporated into the aforesaid Ordinance No. 632; and HHEREAS, it was and is the mutual intention of the President and Board of Trustees and of the petitioners that only a certain portion of land lying west of the southwesterly right of way line of Rand Road be annexed; and WHEREAS, at a regular meeting of the President and Board of Trustees of the Village of Mount Prospect on November 11, 1958 the petitioners requested that the aforesaid mistake be - 2 - corrected by amendment of the said Ordinance No. 632; and 'HHEHEAS, the said petitioners request annexation of only that portion of the aforesaid territory described as follows: The South 1653.37 feet of the East ~ of the South- west i (measured on the East line of said tract) of Section 35, Township 42 North, Hange 11, East of the Third Principal Meridian (excepting from said tract that part thereof described as follows; commencing at the Southeast corner of the South- west l of Section 35, thence West along the South line of the said Southwest i for a distance of 1108.91 feet, thence North along a line which makes an angle of 90 degrees with the last described line for a distance of 33.0 feet to an intersec- tion with the North line of Central Road for a beginning; thence West along the North line of Central Road for a distance of 150.0 feet, thence North along a line which makes an angle of 90 degrees with the last described l~ne for a dis- tance of 158.47 feet to an intersection with the Southerly Right of 'Hay line of Rand Road (Route 12) thence Southeasterly along the said Southerly Right of Way line of Rand Road for a distance of 178.29 feet to a point on the West line of Mount Prospect Road extended North, thence South 62.11 feet along said West line to the point of beginning; and excepting from said tract that part thereof described as follows; commencing at the Southeast corner of the Southwest l of Section 35, thence West along the South line of the said Southwest ~ for a distance of 1318.91 feet, thence North along a line which makes an angle of 90 degrees with the last described line for a distance of 33.0 feet to an intersection with the North line of Central Road for a beginning; thence East along the North line of Central Road for a distance of 60.0 feet, thence North along a line which makes an angle of 90 degrees with the last described line for a dis- tance of 158.47 feet to an intersection with the Southerly Right of Way line of Rand Road (Route 12) thence Northwesterly along the Southerly Right of Way line of Rand Road for a distance of 71.27 feet to a point, thence South along a line which makes an angle of 57 degrees and 17 minutes with the last described line measured from Southeast to South for a distance of 197.02 feet to the point of beginning; and excepting from said tract that part of the East ;1- of the Southwest -t of said Section 35, which lies South of the Southerly line of Rand Road (Route 12) and West of a line described as beginning at a point on the South line of the said Southwest -~ 1318.91 feet \'Jest of the Southeast corner of said Southwest ~; and WHEREAS, the President and Board of Trustees of the Vil- lage of Mount Prospect have independently determined that the territory as described in the preceding WHEREAS clause herein is not within the corporate limits of any municipality, that it is contiguous to the present Village limits of the Village of Mount Prospect, that no electors reside thereon, and that the aforesaid petitioners constitute the owners of record of all of the land so described; and WHEREAS, it is in the best interests of the Village of Mount Prospect to amend Ordinance No. 632 by correcting the legal description of the territory to be annexed thereby, NOVI, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: Section 1: That Section 1 of Ordinance No. 632 be and the same is hereby amended to and shall hereafter read as follows: llSection 1: That the following-described property: The South 1653.37 feet of the East ~ of the South- west t (measured on the East line of said tract) of Section 35, Township 42 North, Range 11, East of the Third Principal Meridian (excepting from said tract that part thereof described as follows; commencing at the Southeast corner of the South- west i of Section 35, thence West along the South line of the said Southwest k for a distance of 1108.91 feet, thence North along a line which makes an angle of 90 degrees with the last described - 4 - line for a distance of 33.0 feet to an intersec- tion with the North line of Central Road for a beginningj thence West along the North line of Central Road for a distance of 150.0 feet, thence North along a line which makes an angle of 90 degrees with the last described line for a dis- tance of 158.47 feet to an intersection with the Southerly Right of Way line of Rand Road (Route 12) thence Southeasterly along the said Southerly Right of Way line of Rand Road for a distance of 178.29 feet to a point on the West line of Mount Prospect Road extended North, thence South 62.11 feet along said West line to the point of beginningj and excepting from said tract that part thereof described as followsj commencing at the Southeast corner of the Southwest t of Section 35, thence West along the South line of the said Southwest t for a distance of 1318.91 feet, thence North along a line which makes an angle of 90 degrees with the last described line for a distance of 33.0 feet to an intersection with the North line of Central Road for a beginningj thence East along the North line of Central Road for a distance of 60.0 feet, thence North along a line which makes an angle of 90 degrees with the last described line for a dis- tance of 158.47 feet to an intersection with the Southerly Right of Way line of Rand Road (Route 12) thence Northwesterly along the Southerly Right of Way line of Rand Road for a distance of 71.27 feet to a point, thence South along a line which makes an angle of 57 degrees and 17 minutes with the last described line measured from Southeast to South for a distance of 197.02 feet to the point of beginningj and excepting from said tract that part of the East i of the Southwest t of said Section 35, which lies South of the Southerly line of Rand Road (Route 12) and West of a line described as beginning at a point on the South line of the said Southwest i 1318.91 feet West of the Southeast corner of said Southwest tj thence running North along a line which makes an angle of 90 degrees with the South line of said Southwest t to the Southerly line of Rand Road (Route 12)), A L S 0 The Southwest i of the Southwest t of Section 35, Township 42 North, Range 11, East of the Third Principal Meridian (excepting from said tract that part of the Southwest i of the Southwest t lying West of Rand Road) in Cook County, Illinois, be and the same is hereby annexed to the Village of Mount Prospect, Cook County, Illinois, pursuant to the provisions of Section 7-6(a) of the Cities and Villages Act as amended.1f . . ,. . # . - 5 - Section 2: That the map attached to and made a part of Ordinance No. 632 is hereby amended to conform to the map attached hereto and made a part hereof. Section 3: That this ordinance shall be effective upon its passage and approval according to law. Section 4: That the Village Clerk of the Village of Mount Prospect 'is hereby authorized and directed to record with the Recorder of Deeds of Cook County, Illinois, a certified copy of this ordinance, together with an accurate map of the territory annexed, attached hereto and made a part hereof. I '\ 1.0 ~ .' t.\')w j.J. ~ ,1 ~ C:;J00' (jJ' In consideration of the zoning of the property "B..l" by the Village of Mount Prospect, Cook County, I11inois, pursuant to case No. 58-16 it is agreed and covenanted in the event that application shall not be made for a building permit as hereinafter provided, and said building permit not issued prior to NO'lember 1, 1]61, then the oitmers of said land agree and consent to any action taken by the Village Board of the said Village of Mount Prospect to rezone said land for the uses permitted under an "R_lll classification as set forth in the Zoning Ordinance of the Village of Mount Pros- pect in effect as of October 1, 1950; provided, however, that such action by the Board of 'r rustees of the Village of Ivlount Prospect shall be taken not later than February 1, 1962, after which date., if no such action is taken, this covenant shall be void. Said application for a. building permit shall be for the erection of a shopping center substantially in accordance with the plans submitted by the Petitioner at the public hearing in said case No. 58-16 and on file with the Village of l\1ount Prospect. Nothing herein contained shall impair the right of the owner or future owners of the land to apply to the Village of Mount Prospect at any time for variationa, Changes or ~nendments in the zoning ordinances applicable to said land, or~ in the event said land is re- f( zoned "R-l," to institute such proceedings as they desire" to ! vary, alter or amend the! zoning laws or ordinance affecting said land. The purpose of this covenant is solely to permit the Village of Mount Prospect, if it so deairea, within the time limits above set forth, to rescind the zoning granted purauant to caae No. 58...16 if a permit is not issued as aforesaid.
