HomeMy WebLinkAboutOrd 643 11/25/1958 ORDINANCE NO. {,J.f.3 AN ORDINANCE REPEALING ORDINANCE NO. 633 AND AMENDING THE VILLAGE OF MOUNT PROSPECT ZONING ORDINANCE AS AfIlENDED WHEREAS, the corporate authorities of the Village of Mount Prospect by Ordinance No. 632 as amended by Ordinance No. 61ft-. annexed to the Village of Mount Prospect the following described property: .. The South 1653.37 feet of the East ~ of the South- west t (measured on the East line of said tract) of Section 35, Township 42 North, Range 11, East of the Third Principal Meridian (excepting from said tract that part thereof described as follows; commencing at the Southeast corner of the South- west t of Section 35, thence West along the South line of the said Southwest t for a distance of 1108.91 feet, thence North along a line which makes an angle of 90 degrees with the last described line for a distance of 33.0 feet to an intersec- tion with the North line of Central Road for a beginning; thence West along the North line of Central Road for a distance of 150.0 feet, thence North along a line which makes an angle of 90 degrees with the last described line for a dis- tance of 158.47 feet to an intersection with the Southerly Right of Way line of Rand Road (Route 12) thence Southeasterly along the said Southerly Right of Way line of Rand Road for a distance of 178.29 feet to a point on the West line of Mount Prospect Road extended North, thence South 62.11 feet along said West line to the point of beginning; and excepting from said tract that part thereof described as follows; commencing at the Southeast corner of the Southwest t of Section 35, thence West along the South line of the said Southwest t for a distance of 1318.91 feet, thence North along a line which makes an angle of 90 degrees with the last described line for a distance of 33.0 feet to an intersection with the North line of Central Road for a beginning; thence East along the North line of Central Road for a distance of 60.0 feet, thence North along a line which makes an angle of 90 degrees with the last described line for a dis- tance of 158.47 feet to an intersection with the Southerly Right of Way line of Rand Road (Route 12) thence Northwesterly along the Southerly Right of Way line of Rand Road for a distance of 71.27 feet to a point, thence South along a line which makes an angle of 57 degrees and 17 minutes with the last described line measured from Southeast to South for a distance of 197.02 feet to the point of beginning; and excepting from said tract that part of the East ~ of the Southwest t of said Section 35, which lies South of the Southerly line of Rand Road (Route 12) and West of a line -'. - 2 - described as beginning at a point on the South line of the said Southwest i 1318.91 feet West of the Southeast corner of said Southwest i; thence running North along a line which makes an angle of 90 degrees with the South line of said Southwest t to the Southerly line of Rand Road (Route 12)), A L S 0 The Southwest k of the Southwest ~ of Section 35, Township 42 North, Range 11, East of the Third Principal Meridian (excepting from said tract that part of the Southwest t of the Southwest t lying West of Rand Road) in Cook County, Illinois. , and WHEREAS, in connection with the annexation of said prop- erty and in the interests of pUblic welfare, safety and health of the residents of the Village of Mount Prospect, the corpor- ate authorities of the said Village deemed it necessary to determine the proper zoning to be applied to said property when so annexed; and \111EREAS, a Notice of Public Hearing with respect to the question of establishing zoning of the aforesaid property was duly published in the Mount Prospect Herald, a newspaper of general circulation in the Village of Mount Prospect; and WHEREAS, a Public Hearing was held by the Board of Appeals of the Village of Mount Prospect in the Village Hall in the Village of Mount Prospect on the 29th day of August, 1958, at the hour of 8:00 P.M. pursuant to the provisions of the aforesaid Public Notice, and all persons who desired to be heard were heard, and an opportunity given to all persons who desired to make remonstrances and objections with reference thereto; and WHEREAS, the legal description of lands to be zoned set forth in the petition to zone erroneously included a descrip- tion of certain land lying west of Rand Road, and by Ordinance No. 633 of the Village of Mount Prospect, the land - 3 - unintentionally included in said petition was zoned in accord- ance with said petition; and WHEREAS, a portion of the said land mistakenly included in the aforesaid petition and Ordinance No. 633 is not a part of the Village of Mount Prospect; and I\[}-IEREAS, it was and is the mutual intention of the cor- porate authorities of the Village of Mount Prospect and of the landowners submitting the aforesaid petition to establish a zoning classification only for land lying east of Rand Road; and \iHEREAS, at a regular meeting of the President and Board of Trustees of the Village of Mount Prospect on November 11, 1958 the aforesaid petitioners requested that the aforesaid description of land to be zoned be corrected; and WHEREAS, the Board of Appeals of the Village of Mount Prospect, subsequent to the aforesaid Public Hearing, recom- mended that the land to be annexed to the Village of Mount Prospect be zoned in accordance with their recommendation and thereafter upon further consideration of said matter by a proper committee of the Board of Trustees of said Village, the corporate authorities of the Village of Mount Prospect do hereby find that it is in the public interest and will aid and promote the public safety, health and welfare of the residents of the Village of Mount Prospect to zone the land hereinafter described as specified below, Nmv, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: Section 1: That Ordinance No. 633 of the Village of Mount Prospect, adopted on the 21st day of October, 1958, t - 4 - be and the same is hereby rescinded and repealed in its entirety. Section 2: That an ordinance entitled, "An Ordinance classifying, regulating and restricting the location of trades and industries and the location of buildings designed for specified uses; regulating and limiting the height and bulk of buildings hereafter erected or altered, regulating and limit- ing the intensity of the use of lot areas and regulating and determining the area of yards, courts and other open spaces within and surrounding such buildings; establishing the bound- aries of districts for said purposes; and prescribing penalties for the violation of its provisionsll passed and approved December 4, 1923 and amendments thereto (and known as Ordinance No. 52) as amended, be further amended by classifying the following described real estate as a B-1 District: B-1 District (Business-Shopping Center) The South 1653.37 feet of the East ~ of the South- west t (measured on the East line of said tract) of Section 35, Township 42 North, Range 11, East of the Third Principal r1eridian (excepting from said tract that part thereof described as follows; commencing at the Southeast corner of the South- west t of Section 35, thence West along the South line of the said Southwest t for a distance of 1108.91 feet, thence North along a line which makes an angle of 90 degrees with the last described line for a distance of 33.0 feet to an intersec- tion with the North line of Central Road for a beginning; thence West along the North line of Central Road for a distance of 150.0 feet, thence North along a line which makes an angle of 90 degrees with the last described line for a dis- tance of 158.47 feet to an intersection with the Southerly Right of Way line of Rand Road (Route 12) thence Southeasterly along the said Southerly Right of Way line of Rand Road for a distance of 178.29 feet to a point on the West line of Mount Prospect Road extended North, thence South 62.11 feet along said West line to the point of beginning; and excepting from said tract that part thereof described as follows; commencing at the Southeast corner of the Southwest ~ of Section 35, thence West along the South line of the said Southwest t ! - 5 - for a distance of 1318.91 feet, thence North along a line which makes an angle of 90 degrees with the last described line for a distance of 33.0 feet to an intersection with the North line of Central Road for a beginningj thence East along the North line of Central Road for a distance of 60.0 feet, thence North along a line which makes an angle of 90 degrees with the last described line for a dis- tance of 158.47 feet to an intersection with the Southerly Right of Way line of Rand Road (Route 12) thence Northwesterly along the Southerly Right of Way line of Rand Road for a distance of 71.27 feet to a point, thence South along a line which makes an angle of 57 degrees and 17 minutes with the last described line measured from Southeast to South for a distance of 197.02 feet to the point of beginningj and excepting from said tract that part of the East i of the Southwest i of said Section 35, which lies South of the Southerly line of Rand Road (Route 12) and West of a line described as beginning at a point on the South line of the said Southwest i 1318.91 feet West of the Southeast corner of said Southwest ij thence running North along a line which makes an angle of 90 degrees with the South line of said Southwest t to the Southerly line of Rand Road (Route 12)), and excepting therefrom that part of said tract lying in Rand Road, Central Road or West Gate Road, A L S 0 The Southwest ~ of the Southwest ~ of Section 35, Township 42 North, Range 11, East of the Third Principal Meridian (excepting from said tract that part of the Southwest i of the Southwest ~ lying Southwesterly of the Northeasterly Right of Way line of Rand Road) in Cook County, Illinois. Section 3: That the Zoning Plan of the Village of Mount Prospect as amended, be and the same is hereby amended to conform to the above change. Section 4: That this Ordinance shall be in full force and effect from and after its passage, approval and publica- tion according to law. Section 5: That all ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed, reserving however, to the Village of Mount Prospect any rights which have accrued to it against any person, firm or corpora- tion under any ordinance or sections of said Zoning Ordinance - 6 - .~ which may be and are hereby repealed.
