ORDINANCE NO. ~ 63 AN ORDINANCE MiffiNDING THE VILL0,.GE OF MOUNT PROSPECT ZONING ORDINANCE AS AMENDED vrnEREAS, the corporate authorities of the Village of Mount Prospect on the 11th_day of November , 1958, annexed to the Village of Mount Prospect the following- described property: That part of the ijTest Half (H 1/2) of the South East Quarter (SE 1/4) of Section 27, Township 42 North, Range 11 East of the Third Principal Meridian lying East of a line dravm from a point in the North line of the West Half (W 1/2) of the South East Quarter (SE 1/4), aforesaid, 13.50 feet West of the Northeast corner thereof to a point 2369.80 feet South of said North line and 9.0 feet West of the East line of said West Half (W 1/2) of the South East Quarter (SE 1/4) except that part thereof falling in Euclid Avenue. and VlHEREAS, in connection with the annexation of said property and in the interests of public welfare, safety and health of the residents of the Village of f\10unt Prospect the corporate authorities of the said Village deemed it necessary to determine the proper zoning to be applied to said property when so annexed; and WHEREAS, a Notice of Public Hearing with respect to the question of establishing zoning of the aforesaid property was duly published in the Mount Prospect Herald, a newspaper of general circulation in the Village of Mount Prospect; and WHEREAS, a Public Hearing was held by the Board of Appeals of the Village of Mount Prospect in the Village Hall in the Village of Mount Prospect on the 30th day of - 2 - January, 1959, at the hour of 8:00 P. M. pursuant to the provisions of the aforesaid Public Notice, and all persons who desired to be heard were heard, and an opportunity given to all persons who desired to make remonstrances and objections with references thereto; and WHEREAS, the Board of Appeal~ of the Village of Mount Prospect, subsequent to said Public Hearing, recommended that the aforesaid property be zoned in accordance with their recommendation and thereafter upon further consider- ation of said matter by a proper committee of the Board of Trustees of said Village, the corporate authorities of the Village of Mount Prospect do hereby find that it is in the public interest and vlill aid and promote the public safety, health and welfare of the residents of the Village of Mount Prospect to zone the property as hereinafter set forth: NOVI, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: Section 1: That an ordinance entitled, !lAn ordinance classifying, regulating and restricting the location of trades and industries and the location of buildings designed for specified uses; regulating and limiting the height and bulk of buildings hereafter erected or altered, regulating and limiting the intensity of the use of lot areas and regulating and determining the area of yards, courts and other open spaces within and surrounding such buildings; establishing the boundaries of districts for said purposes; and prescribing penalties for the violation of its provisions" passed and approved December 4, 1923 - 3 - and amendments thereto (and known as Ordinance No. 52) as amended, be further amended by classifying the following described real estate as a B-3 District: B-3 District (Business-Retail and Service) That part of the West Half (W 1/2) of the South East Quarter (SE 1/4) of Section 27, Township 42 North, Range 11 East of the Third Principal Meridian lying East of a line drawn from a point in the North line of the West Half (w 1/2) of the South East Quarter (SE 1/4), aforesaid, 13.50 feet West of the Northeast corner thereof to a point 2369.80 feet South of said North line and 9.0 feet West of the East line of said West Half (W 1/2) of the South East Quarter (SE 1/4) except that part thereof falling in Euclid Avenue. Section 2: That the Zoning Plan of the Village of Mount Prospect as amended, be and the same is hereby amended to conform to the above change. Section 3: That this Ordinance shall be in full force and effect from and after its passage, approval and publication according to law. Section 4: That all ordinances or parts of ordi- nances in conflict herewith be and the same are hereby repealed, reserving however, to the Village of f10unt Prospect any rights which have accrued to it against any person, firm or corporation under any ordinance or sec- tions of said Zoning Ordinance which may be and are here- I by repealed.
