Parking Meters. vfuenever in this section the following terms are used they shall have the meaning respectively ascribed to them below: Parking Meter: A mechanical device located upon a public street or sidewalk in a place regularly designed as a parking zone, as hereinafter defined, which device shall record a certain number of minutes by the use of clock mechanism determining the period of time for which parking privileges may be extended to the person so depositing a coin or coins. Parking Meter Zone: A certain designated and marked off section of a public street or parking lot for off-street parking within the marked boundaries where the vehicle may be temporarily parked and allowed to remain for such period of time as the parking meter allocated thereto may indicate. Vehicle: Any device by which any person or property may be transported upon a public highway, except those operated upon rails and permanent tracks. 1. The President and Board of Trustees shall cause parking meters to be installed in the parking meter zones as are established by this section, or which may hereafter be established and said Board of Trustees or such officer or person designated shall see that the same are maintained in good working order at all times. Said parking meters shall be installed within approximately twenty- four (24) inches of the outer curb line or side- walk line and in front of the parking spaces. 2. The payment for such parking meters and the installation under any contract or contracts heretofore entered into by the Village or hereafter to be entered into by the Village for the purpose of leasing, acquiring" instal- lation" operation, maintenance, supervision, regulation and use of the parking meters provided for herein" either for a trial period or otherwise, shall be only and solely from the receipts funds and revenues obtained from the operation of said parking meters" without in any manner obligating the Village to pay for the same from any other sources. 3. There are hereby established certain parking zones to be known as parking meter zones. Park- ing meters shall be installed to conform to the parking time limits as are hereby established" or which may hereafter be established. Except as hereinafter provided parking time limits on weekdays" except holidays, Saturdays and Sundays, shall be from the hours of 6:00 A.M. to 6:00 P.M. - 3 - On Saturday and Sunday the parking time limits shall be two (2) hours for which there shall be no charge; provided, however" this provision does not apply to any person paying the rates required for the parking meter on Saturday or Sunday. The follovling days shall be designated as holidays: January 1, May 30, July 4" Labor Day" Thanksgiving Day, and December 25. If any of these days shall fall on Sunday and be observed on Monday" then such Monday will be considered as a holiday for the purposes of this section. The Chief of Police shall cause signs to be posted in said area indicating the aforesaid regulations. 4. In the parking meter zones established as having a parking time limit of sixty (60) minutes, or one (1) hour, the deposit of certain coins shall establish the allowed parking time up to the maximum parking time limit, as follows: A. Upon the deposit of one (1) cent coin a parking time limit of ti'lelve (12) minutes shall be established. B. Upon the deposit of two (2) one (1) cent coins a parking time limit of Twenty-four (24) minutes shall be established. C. Upon the deposit of three (3) one (1) cent coins a parking time limit of thirty-six (36) minutes shall be established. D. Upon the deposit of four (4) one (1) cent coins a parking time limit of forty-eight (48) minutes shall be established. E. Upon the deposit of five (5) one (1) cent coins or one (1) five cent coin a parking time limit of sixty (60) minutes shall be established. 5. The Village Manager, in conjunction with the Parking Committee of the Village Board, shall have markings painted or placed upon the curb or upon the street adjacent to each parking meter for the purpose of designating the parking space for which said meter is to be used" or within a parking lot and each vehicle parking adjacent or next to any parking meter shall park within the lines or markings so established. It shall be unlawful to park any vehicle across any such line or marking or to park any vehicle in such a position that the same shall not be entirely within the area so designated by such lines or markings. 6. In the parking meter zones established as having a parking time limit of twelve (12) hours the deposit of certain coins shall establish the allowed parking time up to the maximum time limit as follows: A. Upon the deposit of one (1) five (5) cent coin a parking limit of one (1) hour shall be established. - 4 - C. Upon the deposit of two (2) five (5) cent coins a parking limit of two (2) hours shall be established. Upon the deposit of three (3) five (5) cent coins a parking limit of three (3) hours shall be established. B. D. Upon the deposit of four (4) five (5) cent coins a parking limit of four (4) hours shall be established. E. Upon the deposit of five (5) five (5) cent coins, or one (1) twenty-five (25) cent coin, a parking limit of twelve (12) hours shall be established. 7. The following are hereby established as twelve (12) hour parking meter zones; except as to such portions thereof as shall be reserved for bus stops" cab stands, driveways and spaces designated with "No Parking" signs and IILimited Time" signs: Those areas within the station grounds of the Chicago & Northwestern Railway presently used for parking purposes and located as follows: Between Northwest Highway and the Chicago & Northwestern Railway right-of-way between Emerson Street and a point 490 feet East thereof; Between Northwest Highway and the Chicago & Northwestern Railway right-of-way between Emerson and Main Streets; Between Northwest Highway and the Chicago & Northwestern Railway right-of-way between Main Street and a point approximately 640 feet west of Main Street. 8. The installation of parking meters in the twelve (12) hour zones shall be subject and pursuant to the provisions of the agreement and lease with the Chicago & North- western Railway Company relating to the installation of parking meters in such zones. 9. The Board of Trustees may from time to time, where due to traffic conditions it may be deemed necessary or advisable, designate areas within said parking meter zones where no parking will be permitted" or where parking will be limited to less than sixty (60) minutes, and cause such areas to be designated by IINo Parkingll signs or signs limiting the parking time. - 5 - 10. (a) It shall be the duty of the operator of any vehicle, upon parking said vehicle in any parking space adjacent to which a parking meter is installed, immediately to deposit or cause to be deposited the necessary coin or coins, as the case may be, for the time said vehicle is to occupy said parking space" and if necessary, to activate said meter. (b) It shall be the duty of the operator of the vehicle to remove immediately the vehicle from the parking space at the expiration of the maximum parking time limit for said space or prior to the display, within said meter, of the expired signal. 11. It shall be unlawful for any person to deposit or cause to be deposited an additional coin or coins to extend the parking time limit beyond the maximum parking time limits as established for parking meter zones. 12. ~fuen the words 11 coins II or cent pieces are used in this section they shall mean coins or pieces of the United States of America and it shall be unlawful for any person to deposit any slug or substitute for such coins or cent pieces. 13. Nothing herein contained shall be construed as prohibiting the parking of commercial trucks in the parking meter zones for the purpose of loading or unloading where it is not possible to load or unload in an alley; provided, however, that an operator of such truck shall not Qark in a parking meter zone longer than thirty (30) minutes. 14. Proof of registration of a motor vehicle and proof of violation of this section shall be construed as prima facie proof that the registered owner of such motor vehicle was the user or operator thereof at the time of the violation charged. 15. It shall be unlawful for any person to tamper with, open wilfully, break or destroy any parking meter or damage the post to which it is attached. 16. It shall be the duty of the Police Department of the Village of Mount Prospect to issue tags to all persons who violate the provisions of sections 4 and 6. Such tags may be delivered to the violator personally or may be affixed to the vehicle of the vio1ator* The said tags shall direct the violator to appear and present such tag at a designated place on or before a certain hour designated thereon. Nothing in this section shall be construed to abridge the power of a police officer to arrest any violator and take him into custody. 17. There is hereby established a parking meter fund, into which all receipts from parking meters shall be deposited. The net proceeds from the operation of parking meters, after payment of cost of mainte- nance and installation thereof, and after payment of maintenance, operation and supervision expenses, - 6 - shall be used for the acquisition, improvement and operation of off street parking facilities, as the President and Board of Trustees may from time to time authorize and direct. 18. Plans and specifications for the installation of parking meters in the Village shall be placed on file with the Village Clerk and shall be open for inspection by the public. 19. The estimated initial cost of the installation of parkin~ meters in the Village is SIXTEEN THOUSAND (16,,000) DOLLARS. No revenue bonds are to be issued or sold to pay for said meters, or any meters hereafter acquired, but the meters shall be acquired by the Village from the revenue derived or to be derived from such meters. Fifty (50%) percent of the revenue derived from said meters each year( installed in the Sixty (60) minute or one (1) hour parking meter zone, will be applied on the cost of installation of said meters until the same are paid in full. The percentage of revenue to be applied to the cost of installation of meters in the Twelve (12) hour zone shall be thirty three and one third (33 1/3%) percent of the gross revenue as provided in fue agreement and lease with the Chicago & Northwestern Railway Company consenting to the installation of meters in said Twelve (12) hour meter zones. 20. The Village consents as follows: A. That no revenue bonds will be issued to pay for such meters; B. That all rules and regulations to assure the maximum use or occupancy of such parking facilities shall be enacted and enforced; C. That the operation" maintenance and management of the parking meters shall be under the supervision of the Village Manager" or such other person shall see that said meters are kept in good working and operating order and are installed to the advantage of the Village; D. That all revenue from parking meters will be deposited in the Parking Meter Fund" and that a record shall be kept by the Village showing all revenue derived from parking meters. The Village Manager or other person appointed to act shall submit a monthly report to the Village Board showing all revenues derived from parking meters. The parking meter fund shall be audited as a separate fund at the time of the annual audit by the Village. - 7 - s. That the Villa~e will maintain the project in Good condition and will opera'ce 'che sane in an economical and efficient manner. 21. The villaGe ManaGer, subject to the approval 0; the President and Board o~ Trustees, shall designate such collector or collectors and nethods as are necessary to collect properly all coins deposited in the meter boxes. Such collector or collectors shall be only such err,ployees as a '.'e nmi OI' L~ay he~ceal~ter be dulv bonc5ed in a sum not less than ONE THOUSAND ($1:000) DOLLARS for the faithful performance or their duties. All moneys so collected shall be deposited with the Village Treasurer, who shall credit such collections to the pal'l:in::,; meter "uno .L'or the purposes set:~'orth herein. 22. NotwithstandinG any or the provisions or Section 18.801, any person,~j_rm OI' corporation 1:Iho violates subsections 12, 13, and 15 o~ this section shall be fined not less than One (~l) Dollar not more than THO Hundred ($200) Dollars for each offense. Section 3: I~ any section, part of section, sentence, clause or phrase or this ordinance shall be held inconstitutional or invalid the remaining provisions hereo~ shall nevertheless remain in full force and e~fect. Section 4: That this Ordinance shall be in full force and effect from and after its passa~e, approval and publication according to law. Section 5: That all ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed, reservinc how- ever, to the Village oC' r,lount Prospect any riQ;hts which have accrued to it a~ainst any perGon, firm or corporation under any ordinance or sections of ordinances 1;~lich may be and are hereby repealed.
