HomeMy WebLinkAboutOrd 721 08/02/1960 ORDINANCE NO. 7ll AN ORDINANCE GRANTING A VARIATION FROM THE VILLAGE OF MOUNT PROSPECT ZONING ORDINANCE AS AM:ENDED WHEREAS, after notice of public hearing was duly published ~nd after such hearing was held the corporate authorities of the Village of J.'.Iount Prospect did by Ordinance No. 693 grant a variation to permit use of the below-described property for a dental office by Dr. Frank Powles, D.D.S; and HHEREAS, it was and is the mutual intention of the corporate authorities of the Village of Mount Prospect and of the applicant for variation, Dr. Powles, that the variation permit use of said property for professional offices; and WHEREAS, the aforesaid public notice and Ordinance No. 693 mistakenly referred to variation only for use as a dental office; and WHEREAS, a notice of public hearing on the question of granting a variation on the use of the following-described proper~y for professional offices: Lots 7 and 8, H. Roy Berry's Subdivision, Section 11/12, Twp. 41 N., R. 11 was duly published in the Mount Prospect Herald, a newspaper of general circulation in the Village of Mount Prospect; and WHEREAS, a public hearing was held by the Board of Appeals of the Village of Mount Prospect in the Village Hall on the 27th day of May, 1960, at the hour of 8:00 P.M., and all persons who desired to be heard were heard and an oppor- tunity given to all persons who desired to make remonstrances and objections with reference thereto; and - 2 - 1VHEREAS, the Board of Appeals of the Village of Mount Prospect, pursuant to Section 16 (b)(2) of said zoning ordinance, subsequent to said hearing, recommended that the variation requested be granted; and \~EREAS, the corporate authorities of the Village of Mount Prospect, after considering the matter as aforesaid, DO HEREBY FIND AS FOLLOWS: 1. The petitioner and owner of said property is Dr. Frank Powles, D.D.S. 2. That the aforesaid property is now zoned in the R-3 (Apartment) District, and pursuant to Section 6 of the Zoning Ordinance, the operation of professional offices, other than a dental office as authorized by the aforesaid Ordinance No. 693, is not permitted whereas under authorized use No.3, uses similar to a general hospital for humans is authorized. 3. The applicant's petition is for the purpose of permitting the erection of a professional building for profes- sional offices. 4. That it is in the public interest of the Village of Mount Prospect and in the best interests of the public health, safety and welfare of the residents of said Village to have available and adequate facilities in the Village for professional offices. 5. That it is in the public interest to grant a variation from the application of the Zoning Ordinance of the Village of Mount Prospect to permit the erection of a building - 3 - on the following-described property to be used solely as a professional building as petitioned and for no other purposes, NOW, THEREFORE, BE IT ORDAINEU BY THE PRESIDENT ANu BOARD OF TRUSTEES OF TIlE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: Section 1: That Ordinance No. 693 of the Village of Mount Prospect, adopted on the 1st day of September, 1959, be and the same is hereby resconded and repealed in its en- tirety. Section 2: That there is hereby granted for the following-described property the right to use said property for professional offices: Lots 7 and 8, H. Roy Berry's Subdivision, Section 11/12, Twp. 41 N., R. 11 Section 3: That any building erected thereon shall be used solely for professional office purposes and no other, except such purposes as are authorized by the R-3 District as set forth in Section 6 of the Zoning Ordinance or as may be hereafter amended. Section 4: That the Zoning Plan of the Village of Mount Prospect as amended, be and the same is hereby amended to modify and conform to the instant variation. Section 5: That this ordinance shall be in full force and effect from and after its passage, approval and publication according to law. Section 6: That all ordinances or parts of ordi- nances in conflict herewith be and the same are hereby repealed, reserving however, to the Village of Mount Prospect any rights which have accrued to it against any person, firm - 4 - or corporation under any ordinances or sections of the Zoning Ordinance which may be and are hereby repealed.
