'1 'J.. ~ AN ORDINANCE GRANTING A VARIATION FROM THE VILLAGE OF MOUNT PROSPECT ZONING ORDINANCE AS AMENDED WHEREAS, a Notice of Public Hearing on the question of granting a variation from minimum off-street parking faci1- ity requirements, Section 2 of Section 3, Districts, of the Mount Prospect Zoning Ordinance as amended, with respect to the property hereinafter legally described as follows: Lot 11 in Map1ewood Hts., being a Sub. of the E 15 chains of that part lying N of Railroad of SE~ of Sec. 12 (except the Southerly 66 ft. for road) also of B1. 26 in Busse's Eastern Add'n. to Mt. Prospect, in the E 1/2 of Sec. 12, all in Twp. 41 N, R 11, E 3rd P.M. was duly published in the Mount Prospect Herald, a newspaper of general circulation in the Village of Mount Prospect; and T~1EREAS, a public hearing was held by the Board of Appeals of the Village of Mount Prospect in the Village Hall in the Village of Mount Prospect on the 27th day of May, 1960, at the hour of 8:00 P.M. pursuant to the provisions of the aforesaid public notice, and all persons who desired to be heard were heard and an opportunity given to all persons who desired to make remonstrances and objections with reference thereto; and WHEREAS, the Board of Appeals of the Village of Mount Prospect, pursuant to Section 16(B)(2) of said zoning ordinance, subsequent to said hearing, did, by concurring vote of four members of said Board of Appeals, recommend in writing that the variation requested be granted; and <) \~EREAS, the corporate authorities of the Village " - 2 - of Mount Prospect, after considering the matter as aforesaid, do hereby find as follows: 1. That based on the facts presented to the Board of Appeals at the aforesaid public hearing, the parking space provisions of Section 3 of the said zoning ordinance insofar as such provisions apply to prohibit the building addition no greater than 29-1/2 ft. in depth by 39 ft. in width as petitioned would involve practical difficulties to the property owner in the proposed use of such property. 2. That the application of the aforesaid parking space provisions to require 25% of the lot area be devoted to such parking requirements would result in particular hardship to the owner of the property hereinabove described in view of the dimensions of the property and the particular conditions that exist on and surrounding said property and the size and type of building addition proposed to be built on said pro- perty. 3. That the construction of a building addition on the above-described property as petitioned satisfies the re- quirements for variation in harmony with the general purpose and intent of the zoning ordinance; and WHEREAS, the corporate authorities of the Village of Mount Prospect do desire to grant a variation as hereinafter set forth, which said variation is specifically limited as herein provided, NOT,.], THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: - 3 - Section 1: That the following-described property be exempt from the parking space provisions of Section 2 of Section 3, Districts, of the Village of Mount Prospect Zoning Ordinance as amended: Lot 11 in Map1ewood Hts., being a Sub. of the E 15 chains of that part lying N of Railroad of SE~ of Sec. 12 (except the Southerly 66 ft. for road) also of B1. 26 in Busse's Eastern Add'n. to Mt. Prospect, in the E 1/2 of Sec. 12, all in Twp. 41 N, R 11, E 3rd P.M. to the sole extent that the erection of a building addition no greater than 29-1/2 ft. in depth by 39 ft. in width as petitioned is hereby made permissible. Section 2: That the variation granted hereby apply only to any building permit applied for by the property owner of record as of the date of the passage of this ordinance and to building addition constructed thereunder. Section 3: That the Zoning Plan of the Village of Mount Prospect, as amended, be and the same is hereby amended to modify and conform to the instant variation. Section 4: That this ordinance shall be in full force and effect from and after its passage, approval and publication according to law. Section 5: That all ordinances or parts of ordi- nances in conflict herewith be and the same are hereby re- pealed, reserving however, to the Village of Mount Prospect any rights which have accrued to it against any person, firm or corporation under any ordinances or sections of the Zoning - 4 - Ordinance which may be and are hereby repealed.
