HomeMy WebLinkAboutOrd 723 08/16/1960 ORDINANCE No.11/3 AN ORDINANCE GRANTING A VARIATION FROM THE VILLAGE OF MOUNT PROSPECT ZONING ORDINANCE AS AMENDED WHEREAS, a notice of public hearing on the question of granting a variation to permit a two-family residence use in an R-l (Residential) use district of the Mount Prospect Zoning Ordinance as amended, with respect to the property hereinafter set forth was duly published in the Mount Prospect Herald, a newspaper of general circulation in the Village of Mount Prospect; and WHEREAS, a public hearing was held by the Board of Appeals of the Village of Mount Prospect in the Village Hall in the Village of Mount Prospect on the 24th day of June, 1960 at the hour of 8:00 P.M. pursuant to the provisions of the aforesaid public notice, and all persons who desired to be heard were heard and an opportunity given to all persons who desired to make remonstrances and objections with reference thereto~ and WHEREAS, the Board of Appeals of the Village of Mount Prospect, pursuant to Section l6(b)(2) of said Zoning Ordinance, subsequent to said hearing, did by concurring vote of five members reconnnend that the variation not be granted; and WHEREAS, the corporate authorities of the Village of Mount Prospect, after considering the matter as aforesaid, do hereby find as follows: 1. That based upon the facts as presented to the Board of Appeals said property since on or about January 1, 1950 has been used as a two-family residence. - 2 - 2. That the said property is located in a R-l (Residential) use district which prohibits two-family occupancy and use for residences within said use district. 3. That in view of the previous use of the said pro- perty as a two-family residence and the style and nature of the building on said property to prevent the owner of said property from using the same as a two-family residence would impose an economic hardship upon the property owner. 4. That the use of the said property as a two family residence will not in any way impair the value of the adjacent proper ty , NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: Section 1: That the following-described property: Lot 12 in Bl 9 and Lot B in Hill Crest, being a sub of the NEt of the swt (except the North 2-7/8 acres thereof) of Sec. 34, Twp. 42 N, R 11, E 3rd PM; also theN 23.5 acres of the SEt of the SW~ (except the W 295.1 ft of the S 295.1 ft lying N of the S 543 ft of the E~ of the swt of said Sec 34, Twp. 42 N, R 11, E 3rd PM, in Cook County, Ill. be exempt from the provisions of Section 4 R-l District by the Village of Mount Prospect Zoning Ordinance, as amended, to permit the use of the residence thereon as a two-family resi- dence, and in all other respects the provisions of said Section 4 remain in full force and effect and shall be applicable to said property. Section 2: That the variation granted hereby apply only to the building now in existence on said property and upon the discontinuance of said use or the construction on said pro- perty the variation shall automatically cease. - 3 - Section 3: That the Zoning Plan of the Village of Mount Prospect, as amended, be and the same is hereby amended to modify and conform to the instant variation. Section 4: That this ordinance shall be in full force and effect from and after its passage, approval and publication according to law. Section 5: That all ordinances or parts of ordi- nances in conflict herewith be and the same are hereby re- pealed, reserving however, to the Village of Mount Prospect any rights which have accrued to it against any person, firm or corporation under any ordinances or sections of the Zoning Ordinance which may be and are hereby repealed.
