AN ORDINANCE TO AMEND THE VILLAGE OF MOUNT PROSPECT ZONING ORDINANCE AS AMENDED WHEREAS, a Notice of Public Hearing with respect to the question of amending the Village of Mount Prospect Zoning Ordinance as amended by amending Section 16 (A) , was duly pub- lished in the Mount Prospect Herald, a newspaper of general circulation in the Village of Mount Prospect; and WHEREAS, a Public Hearing was held by the Board of Appeals of the Village of Mount Prospect in the Village Hall in the Village of Mount Prospect on the 20th day of November, 1959, at the hour of 8:00 P.M. pursuant to the provisions of the aforesaid public notice, and all persons who desired to be heard were heard and an opportunity given to all persons who desired to make remonstrances and objections with refer- ence thereto; and WHEREAS, the Board of Appeals of the Village of Nount Prospect, subsequent to said public hearing, reconunended that said amendment be approved, NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF NOUNT PROSPECT, COOK COUNTY, ILLINOIS: Section 1: That an ordinance entitled, "An Ordi- nance classifying, regulating and restricting the location of trades and industries and the location of buildings designed for specified uses; regulating and limiting the height and bulk of buildings hereafter erected or altered, regulating and limiting the intensity of the use of lot areas and regu- lating and determining the area of yards, courts and other open spaces within and surrounding such buildings; establishing - 2 - the boundaries of districts for said purposes; and prescribing penalties for the violation of its provisions," passed and approved December 4, 1923 and amendments thereto (and known as Ordinance No. 52) as amended, be further amended by amending Section l6(A) to hereafter read as follows: H(A) CREATION AND MEMBERSHIP. A Board of Appeals is hereby authorized to be established. When used in this Section the word · Board' shall be construed to mean Board of Appeals. The said Board shall consist of seven (7) members appointed by the President by and with the consent of the Board of Trustees. The members of the Zoning Commission in office at the time of the adoption of this amendment shall serve as members of the new Board for the period of time remaining in their current terms and until their successors are appointed and qualified. At the expiration of the respective terms of office of the present members or for any vacancy on said Board, the members of the Board hereafter shall be appointed for terms of five (5) years. The term of office shall expire on the fifteenth (15th) day of Mayor until their successors shall have been duly appointed and qualified. The President by and with the consent of the Board of Trustees shall appoint one of the members of the Board to serve as Chairman. The Chairman shall be appointed to serve until May 15th of the following year. There- after the Chairman shall hold office as Chairman for a period of one (1) year and may be re-appointed as Chairman. The Chairman shall serve until his suc- cessor has been duly appointed and qualified. All members of the Board shall serve without compensa- tion except that for any special meeting of said Board there shall be paid from the fees received for said special meeting the amount of $10.00 to the Chairman and $5.00 to each member of the Board of Appeals present at said special meeting. Members of the Board shall be subject to removal by the Presi- dent by and with the consent of the Board of Trustees for cause and after a public hearing. The Board shall select one of its members to be a Vice Chairman and may select any resident of the Village of Mount Pros- pect to serve as Secretary. The Secretary shall keep the minutes and maintain the records of the Board." Section 2: That this Ordinance shall be in full force and effect from and after its passage and approval ac- cording to law. - 3 - Section 3: That all ordinances or parts of ordi- nances in conflict herewith be and the same are hereby re- pealed, reserving however, to the Village of Mount Prospect any rights which have accrued to it against any person, firm or corporation under any ordinance or sections of said Zoning Ordinance which may be and are hereby repealed.
