J\./ ORDINANCE NO:j1~ AN ORDINANCE GRANTING A VARIATION FROM THE VILLAGE OF NOUNT PROSPECT ZONING ORDINANCE AS AMENDED WHEREAS, a notice of public hearing on the question of granting a variation to permit the erection of a building to be used for professional purposes in a R-3 (Residence Apartment) District of the Mount Prospect zoning ordinance as amended, with respect to the property hereinafter set forth was duly published in the Mount Prospect Herald, a newspaper of general circulation in the Village of Mount Prospect; and WHEREAS, a public hearing was held by the Board of Appeals of the Village of Nount Prospect in the Village Hall in the Village of Mount Prospect on the 29th day of July, 1960 at the hour of 8:00 P.M. pursuant to the provisions of the aforesaid public notice, and all persons who desired to be heard were heard and an opportunity given to all persons who desired to make remonstrances and objections with refer- ence thereto; and WHEREAS, the Board of Appeals of the Village of Mount Prospect, pursuant to Section l6(b)(2) of said Zoning Ordinance, subsequent to said hearing did vote to recommend that the variation not be granted; and WHEREAS, the corporate authorities of the Village of Mount Prospect, after considering the matter as aforesaid, do hereby find as follows: 1. The petitioner Bennett P. Trapani is the owner of the property hereinafter described. - 2 - 2. That the property hereinafter described is located in an R-3 (Residence Apartment) District, which said district prohibits the erection of a professional build- ing. 3. That in consideration of the existing uses near- by to the instant property and in consideration of the location of said property and its relationship to highways, streets and railroad, the Board of Trustees are of the opinion that the erection of a professional building is in the best interests of the residents of the Village of Mount Prospect, and will pro- mote the general welfare and health of the residents of said Village and will not endanger public safety or diminish or impair the value of property within the surrounding area, NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: Section 1: That the following-described property: Lots 43, 44, and 45 in H. Roy Berry's Colonial Manor being the NE 1/4 of Sec. 11 and the NW 1/4 of Sec. 12, all in Township 41 North, Range 11, East of the 3rd P.M. in Cook County, Ill. be exempt from the provisions of Section 6 R-3 (Apartment Residence) District of the Village of Mount Prospect Zoning Ordinance, as amended, insofar as permission is hereby granted to erect on said property a professional building, and in all other respects the provisions of the Village of Mount Prospect Zoning Ordinance shall be applicable to said property. Section 2: That the variation granted hereby apply only to the building to be built thereon and only for so long - 3 - as said building is to be used as a professional building, it being understood that said professional building will permit the housing of doctors', dentists', and offices of other similarly qualified professional people. Section 3: That the Zoning Plan of the Village of Mount Prospect, as amended, be and the same is hereby amended to modify and conform to the instant variation. Section 4: That this ordinance shall be in full force and effect from and after its passage, approval and publication according to law. Section 5: That all ordinances or parts of ordi- nances in conflict herewith be and the same are hereby re- pealed, reserving however, to the Village of Mount Prospect any rights which have accrued to it against any person, firm or corporation under any ordinances or sections of the Zoning Ordinance which may be and are here PASSED this 6'1/.. day of APPROVED this t Ii. day of 1960. , 1960. ct~ /' /~ ..~ 'jMdn-f{/ . 1lVV Village Presiden
