ORDINANCE M-1ENDING THE VILLAGE OF HOUNT PROSPECT ZONING ORDINANCE AS ~iENDED 1VHEREAS, a Notice of Public Hearing with respect to the question of zoning the following-described property to B-3 (Business - Retail and Service) District use: That part of the Northwest quarter of the South- west quarter of Section 35, Township 42 North, Range 11 East of the Third Principal Meridian de- scribed as follows: Beginning at the Southeast corner of the Northwest quarter of the Southwest quarter of said Section 35; thence North, on the East line of the Northwest quarter of the South- west quarter, a distance of 429.86 feet; thence West, on a line parallel with the South line of the Northwest quarter of the Southwest quarter, a distance of 1136.88 feet, to the center line of Rand Road; thence Southeasterly, along the center line of Rand Road, a distance of 496.98 feet, to the South line of the Northwest quarter of the Southwest quarter; thence East, a distance of 889.90 feet, to the place of beginning (ex- cept that part of the premises lying in Rand Road), was duly published in the Mount Prospect Herald, a newspaper of general circulation in the Village of Mount Prospect; and WHEREAS, a Public Hearing was held by the Board of Appeals of the Village of hount Prospect in the Village Hall in the Village of Mount Prospect on the 28th day of October, 1960, at the hour of 8:00 P.M. pursuant to the provisions of the aforesaid public notice, and all persons who desired to be heard were heard and an opportunity given to all persons who desired to make remonstrances and objections with reference thereto; and TmlEREAS, the Board of Appeals of the Village of }lount Prospect, subsequent to said public hearing, recommended the aforesaid petition be denied; and - 2 - HaER:~AS, the corporate authorities of the Village of Mount Prospect, having further considered this matter, have determined that the property hereinafter described should be zoned as hereinafter specified in the public interest of the Village of Mount Prospect, Nm-J, TI-E~REFORE, BE IT ORDAINED BY THE PRESIDENT A!\;TD BOARD OF TRUSTEES OF TI-r~ VILLAGE OF l',OUNT PROSPECT, COOK COUNTY, ILLINOIS: Section 1: That an ordinance entitled, IIAn Ordinance classifying, regulating and restricting the location of trades and industries and the location of buildings designed for specified uses; regulating and limiting the height and bulk of buildings hereafter erected or altered, regulating and limiting the intensity of the use of lot areas and regulating and determining the area of yards, courts and other open spaces within and surrounding such buildings; establishing the boundaries of districts for said purposes, and prescribing penalties for the violation of its provisionsH passed and approved December 4, 1923 and amendments thereto (and known as Ordinance No. 52) as amended, be further amended by classifying the following-described real estate as B-3 (Business-Retail and Service) District use: That part of the Northwest quarter of the South- west quarter of Section 35, Township 42 North, Range 11 East of the Third Principal l'leridian de- scribed as follows: Beginning at the Southeast corner of the Northwest quarter of the Southwest quarter of said Section 35; thence North, on the East line of the Northwest quarter of the South- west quarter, a distance of 429.86 feet; thence West, on a line parallel with the South line of the Northwest quarter of the Southwest quarter, a distance of 1136.88 feet, to the canter line - 3 - of Rand Road; thence Southeasterly, along the center line of Rand Road, a distance of 496.98 feet, to the South line of the Northwest quarter of the Southwest quarter; thence East, a distance of 889.90 feet, to the place of beginning (except that part of the pre- mises lying in Rand Road). Section 2: That the Zoning Plan of the Village of Mount Prospect, as amended, be and the same is hereby amended to conform to the above change. Section 3: That this Ordinance shall be in full force and effect from and after its passage and approval according to law. Section 4: That all ordinances or parts of ordi- nances in conflict herewith be and the same are hereby re- pealed, reserving however, to the Village of Mount Prospect any rights which have accrued to it against any person, firm or corporation under any ordinances or sections of said Zoning Ordinance which may be and are hereby repealed.
