Prospect Manor Sub. being a sub. of part of the S. 3/4 of the W. 1/2 of Sec. 34, Twp. 42 N., R. 11, E. 3rd P.M. in Cook County, Illinois was duly published in the Mount Prospect Herald, a newspaper of general circulation in the Village of Mount Prospect; and WHEREAS, a public hearing was held by the Board of Appeals of the Village of Mount Prospect in the Village Hall on the 28th day of October, 1960, at the hour of 8:00 P.~l., and all persons who desired to be heard were heard and an opportunity given to all persons who desired to make remon- strances and objections with reference thereto; and WHEREAS, the Board of Appeals of the Village of Nount Prospect, subsequent to said hearing, recommended that a variation not be granted; and \~1EREAS, the corporate authorities of the Village of l"'lount Prospect, after considering the matter as aforesaid, DO HEREBY FIND AS FOLLOWS: 1. The petitioner and owner of said property is Victor A. Doyno. 2. That the aforesaid property is now zoned in the B-3 (Retail and SerVice) District. == .-. - 2 - 3. The applicant's petition is for a variation to permit the erection of a building without application of minimum rear yard requirements on the within-described pre- mises. 4. That in Case No. 57-20 a similar variation was granted pursuant to Ordinance No. 592 dated January 7, 1958. 5. That the granting of the variation will not decrease an adequate supply of light and air to adjacent property, will not increase congestion in public streets; will not increase the fire hazard; will. not endanger public safety; will not diminish or impair the values of property in the surrounding area; and will not in any manner impair the public health, safety, morals and welfare of the Village of Nount Prospect, NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF TI{E VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: Section 1: That there is hereby granted for the following-described property the right to erect a building without application of the minimum rear yard requirements on the following-described premises: Lots (11-12) in Block 22, Mt. Prospect Manor Sub. being a sub. of part of the S. 3/4 of the W. 1/2 of Sec. 34, Twp. 42 N., R. 11, E 3rd P.M. in Cook County, Illinois. Section 2: That the Zoning Plan of the Village of Mount Prospect as amended, be and the same is hereby amended to modify and conform to the instant variation. - 3 - Section 3: That this Ordinance shall be in full force and effect from and after its passage, approval and publication according to law. Section 4: That all ordinances or parts of ordi- nances in conflict herewith be and the same are hereby re- pealed, reserving however, to the Village of Eount Prospect any rights which have accrued to it against any person, firm or corporation under any ordinances or sections of the Zoning Ordinance which may be and are hereby repealed. DOYNO, of the Village of Mount Prospect (hereinafter referred to as "Doyno") and the VILLAGE OF J:I;OUNT PROSPECT, Cook County, Illinois (hereinafter referred to as "Village"), WIT N E SSE T H: ---------- ~1EREAS, Doyno is the owner of certain property located in the Village of Mount Prospect more particularly described as follows: Lots 11 and 12 in Block 22 Mount Prospect Subdivision being a subdivision of part of the South 3/4 of the West one-half of Section 34, Township 42 North, Range 11, East of the Third Principal Meridian in Cook County, Illinois and WHEREAS, Doyno has made application to the Village for a variation from the Zoning Ordinance of the Village to permit the~ection of a building without the application of minimum yard requirements in said Zoning Ordinance as to the aforesaid lots; and WHEREAS, the Village is desirous that any building erected thereon be so erected that any openings installed on the north side of such building for access to the alley shall not be larger than three-foot standard doors and shall not be adjacent to each other, and further, that a wood fence is to be extended at the expense of Doyno on the north side of the alley to screen the new building from the residential pro- perties lying north of said north boundary line of said pro- per ty , ."""~'"'~""''''''"''f'''''''"''-'~I''"""",''''''''<'''~',""~'''''''",'''''''!~"",,.~,,..;IO~'~""_"""""'"""""'_~""4'I."""I*'",..,~,>.".,...., "\-" - 2 - NOW, THEREFORE, For and in consideration of the mutual covenants herein contained, the parties hereto do mutually agree as follows: 1. Doyno does hereby agree that insofar as any building constructed on the aforesaid property there shall not have contained thereon on the north side of said bui1d- ing any opening larger than three-foot standard doors, which said doors shall not be adjacent to each other, and further that a wood fence is to be extended on the north boundary of the property described above so as to screen the subject property from the residential property to the north of the boundary line. 2. The Village agrees to grant a variation from the zoning ordinance in order to permit the construction of a building on the following-described property: Lots 11 and 12 in Block 22 Mount Prospect Subdivision being a subdivision of part of the South 3/4 of the West one-half of Section 34, Township 42 North, Range 11, East of the Third Principal Meridian in Cook County, Illinois, it being understood that the variation will permit the erection of a building without application of minimum rear yard require- ments as to said property. 3. This Agreement shall be binding upon the heirs, executors, assigns and successors of the respective parties hereto.
