THE FIRE DEPARTI'iENT, OF TliE rlUNICIPAl. conE OF hOUNT PROSPECT OF 1957 AS l'J:;ZNDED iHIEREAS, the corporate authorities of the Village of hOU:,(lt Prospect believe it is in the pubJic interest and 'Vrtll promote the public ~lealth, safety and .;eneral welfare of the residents of the Village of Lount Prospect to amend Chapter 7. COOK COUNTY, ILLINOIS: Section 1: That Chapter 7. The Fire Department, of the Hunicipal Code of l:ount Prospect of 1957, As A-nended, be and the same is hereby amended to and shall hereafter read as follmvs: HSection 7.101 Establishment. There is herebv .I created a Fire Department \vhicll shall consist of the Fire Chief and such nlli-nber of other officers and firemen as may be from time to time authorized by the President and 30ard of Trustees. - Section 7.102 Offices Created. (a) There is hereby created the office of Fire Chief. The Chief of the Fire Department shall be appointed by the President and Board of Trustees, voting jointly, and his tenure in office shall depend on his good conduct and efficiency. He shall be re- moved only for just cause by the President and Board of Trustees. Section 7.103 Appointments. (a) Except for the appointment of the Fire Chief as provided for in Section 7.l02(a), all full time members of the Fire Department shall be appointed I ,.. r h. ....,.,,~.,+....._" , ~ t-, illll!<l''; - 2 - by the Board of Fire and Police Con~nissioners of the Village. (b) The membersh.ip of the Fire Department may be supplemented from time to time by lIpaid on call" firemen, the number, and appointment of which shall be detenained by the President and Board of Trustees upon recorrmendation of the Fire Chief. Section 7.104 Supervision Over Department Equi~nent. The Fire Chief shall have control of the Fire Department, its equipment, apparatus and facilities subject to the order and direction of the Village Hanager. ~ihenever any such fire apparatus needs repairing, said Fire Chief shall be responsible for and shall cause the same to be done without delay. Section 7.105 Cornrrrand at Fires. In case of a fire, the Fire Chief and his assistants shall rank in the order then in effect within the De- partment and the officer of highest rank at the fire shall take conm1and of the Fire Department and direct the management thereof for the suppres- sion of the fire in the best manner possible. Section 7.106 Duties. (a) Duties of the Chief. The Chief of the Fire Department shall be responsible under the Village Manager for the performance by the Fire Department of all of its functions. The Chief shall formulate a set of rules and regulations to govern the Department. Said rules and regulations shall be in conformity with the rules and regula- tions of the Board of Police and Fire Commissioners. The Chipf or an'y.. one dulv authorized bv him is ~ , ,j .J' hereby empowered to enter any and all buildings and premises at any reasonable hour for the purpose of making inspection and to serve written notice upon the owner or occupant to abate within any specified time any and all fire hazards that may be found. The Chief shall see that complete records are kept on all fires, inspections, apparatus, equipment of all types and shall report monthly to the Village Ivianager. (b) Duties of b:embers Generally. It shall be the function and duty of the Fire Department and every member thereof to extinguish fires of any and all types and to prevent the occurrence or spread of such fires. l-lhen it may be necessary for ,....4 ~" '1'l!'!1j~~m_~___, LJ - 3 - the protection of other property and to prevent the spread of the conflagration, the officer in command is hereby authorized to and may cause buildings to be removed, torn down or destroyed. Section 7.107 Membership. (a) Organization. The Fire Department may have any organization approved by the President and Board of Trustees and may hold meetings and engage in social activities with the approval of the President and Board of Trustees. The Secretary of the Fire Department, if any is elected or ap- pointed, shall keep a record of all meetings and activities of the Fire Department. (b) !lPaid on Calla Firemen. The Fire Chief may appoint such number of "Paid on Calllf firemen as are authorized by the President and the Board of Trustees provided that all such persons are male citizens residing within the Village of Hount Prospect and shall have been determined by the Fire Chief, after a medical examination, to be in a physi- cal condition to carry out the duties described. Any member who is a I1Paid on Call" fireman may be sus- pended or discharged at any time from the Department by the Fire Chief when he deems such action to be in the best interests of the Fire Department and the Village of Mount Prospect. Any member of the De- partment \\7ho is a "Paid on Call n fireman in atten- dance at a fire and who shall" neglect or refuse to obey the orders of the officer in cOrnITland at the fire, shall be subject to the penalties provided for in this Article. Section 7.108 Duty of Spectators at Fires. All spectators at fires shall obey the orders of any of the members of the Fire Department then on dutv. .I Section 7 .109 Police Pm\7er of hembers. All members of the Fire Department are hereby empowered to and shall have authority to arrest any person for any interference with the Fire Department in the performance of its duties or for the violation of any provisions of this Code or State law in connection with the fire. Section 7.110 Entering Fire House. It shall be and is hereby dec lared unlawful for any person or persons to enter the Fire Department house or any place where the equipment and apparatus of the Fire Department is stored, at any time except on business pertaining to the Fire Department or except ""'-'~"'~~I_~""!l..".I<1f~~,",'_Il;>llI,,_~"""'''''.!~_-'~''-~''-p,_,~....--..-,.,-,,,,,."~,,,.,,,,,, ,. - 4 - with authorization from the Fire Chief or officer in charge. Section 7.111 Use of Apparatus. ~11y persons authorized by the Fire Chief or officer in charge can use any fire engine, hose or any other apparatus belonging to the Village for any private purpose other than the extinguishment of fires. TtJ'l'lOever shall remove the same or any part thereof from its place of deposit or having control thereof, or shall perrrlit such engine, hose or other apparatus to be used for a private purpose as aforesaid, shall, upon conviction, be subject to the penalties provided in this P...rticle. Section 7.112 Compensation. All members of the Fire Department shall receive such compensation as from time to time is established by resolution of the President and Board of Trustees. Section 7.113 Penalty. Any person, firm or corporation violating any of the provisions of this Article shall be fined no less than Five ($5.00) Dollars nor more than Two Hundred ($200.00) Dollars for each offense. A separate offense shall be deemed committed on each and every day during or on which a violation occurs or continues." Section 2: That this Ordinance shall be in full force and effect from and after its passage, approval and publication according to law. Section 3: That all ordinances or parts of ordi- nances in conflict herewith be and the same are hereby re- pealed, reserving however, to the Village of Mount Prospect any rights which have accrued to it against any person, firm or corporation under any ordinances or sections of ordinances which may be and are hereby repealed.
