J?~/ AN ORDINANCE VACATING A PORTION OF A PUBLIC STREET KNOWN AS PROSPECT AVENUE "WITHIN THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS WHEREAS, the following-described portion of a public street was established and dedicated by plat duly executed and recorded with the County Recorder of Cook County as Document No. 13473663 on ; and WHEREAS, the corporate authorities of the Village of Mount Prospect after investigation of the matter find there is no corporate need for said public street and there ca is no intent at the present time nor can it be determined ~ ..;:.... that there shall be any intent to use said public street in any public manner and there is no public benefit in CJ rv f".) continuing to maintain said public street; and WHEREAS, it would be in the best interests of the Village of Mount Prospect to vacate said public street in accordance with the plat of vacation attached hereto and incorporated herein, NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: Section 1: That a portion of a public street known as Prospect Avenue described as follows: The Northeasterly 66 feet (measured perpendicularly to the Southwesterly line of the Chicago and North Western Railway Company's Right of Way) of the following described tract of land: The West 200 feet of the East 450 feet of that part of the East half of the Southeast quarter of Section 33, Township 42 North, Range 11 - 2 - East of the 3rd Principal Meridian, lying South of the right of way of the Chicago and North Western Railway Company, which has heretofore been acquired by dedication in Document No. 13473663 recorded with the County Recorder of Cook County, Illinois, on be and the same is hereby vacated. Section 2: That attached hereto and incorporated herein as a part hereof is a Plat of Vacation describing the aforesaid portion of public street being vacated hereby. Section 3: That the Village Clerk of the VillageC3 of Mount Prospect be and is hereby authorized and directed N +--- C0 f'.J f'.) to cause this Ordinance to be recorded with the Recorder of Deeds of Cook County, Illinois. Section 4: That this Ordinance shall be effective from and after its passage and approval according to law. Section 5: That all ordinances or parts of ordi- nances in conflict herewith be and the same are hereby re- pealed, reserving however, to the Village of Mount Prospect any rights which have accrued to it against any person, firm or corporation under any ordinance or sections of ordinances which may be and are hereby repealed.
