HomeMy WebLinkAboutOrd 768 07/18/1961 ORDINANCE NO. 768 AN ORDINANCE AUTHORIZING SALE OF CERTAIN PROPERTY OF THE VILLAGE OF MOUNT PROsPECT, COOK COUNTY, ILLINOIS WHEREAS, the corporate authorities of the Village of Mount Prospect have determined that the property' hereinafter is no longer necessary', appropriate, useful to, profitable to, or for the best interests of the Village of Mount Prospect; and WHEREAS, the corporate authorities find it in the best interests of the Village of Mount Prospect to sell the real estate legally' described as follows: That ~aT't of Block 1 in Busse and Wille I s Resubdi vision in the West "2 of Section 12, Township 41 North, Range 11 East of the 3rd Principal Meridian, described as follows: Commencing at a point in the east line of said Block 1, 165.59 feet north of the southeast corner of said Block 1, said southeast corner of said Block 1 being the point of inter- section of the east line of said block with the southwesterly' line thereof; thence north along the east line of said Block ;I., 149.98 feet, thence west along a line parallel to the north line of said Block 1 a distance of 154..50 feet to the point of beginning; thence continuing west along last described line, 97.44 feet to its intersection with a line parallel to and 141 feet northeasterly' of the southwesterly' line of said Block 1; thence southeasterly' along said line parallel to and 141 feet northeasterly' of the southwesterly' line of said Block 1 to a line drawn at right[ angles to the north line of said Block 1 through the point of beginning; thence north along said right angle line to the point of beginning, all in Cook County, illinois. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION 1: That a sale of the property described in Section 2 hereof be and the same is hereby' directed to be made under tems and conditions meeting the approval of the corporate authorities of the Village of Mount Prospect, in accordance with the statutes of the State of illinois. SECTION 2: That the Clerk of the Village of Mount Prospect be and she is hereby' directed to cause a public notice advertising for bids for such property' to be published once each week for three successive - 2 - weeks in the Mount Prospect Herald, and said notice shall be in sub- stantially' the following fonn: "PUBLIC NOTICE OF ADVERTISEMENT FOR BIDS ON SALE OF VILLAGE PROPERTY Public notice is hereby given that pursuant to the provisions of Ill. Rev. Stat. (1959), Ch. 24, Art. 59, and in accord with Ordinance No. 768 duly' adopted July' 18, 1961, by' the corporate authorities of the Village of MOl:lIlt Prospect, Cook County, Illinois, sealed bids for the purchase of the unimproved real estate legally' described as follows: That part of Block 1 in Busse and Wille's Resubdi nsion in the west ! of Section 12, Township 41 North, Range 11 East of the Third Principal Meridian described as follows: Commencing at a point in the east line of said Blockl, 165,59 feet north of the southeast corner of said Block 1, said southeast corner of said Block 1 being the point of intersection of the east line of said block with the southwesterly' line thereof; thence north along the east line of said Block 1, 149.98 feet, thence west along a line parallel to the north line of said Block 1 a distance of 154.50 feet to the point of beginning; thence continuing west along last described line, 97.44 feet to its intersection with a line parallel to the 141 feet northeasterly' of the southwesterly' line of said Block 1; thence southeasterly' along said line parallel to the 141 feet northeastly mf the southwesterly line of said Block 1 to a line drawn at right angles to the north line of said Block 1 through the point of beginning; thence north along said right angle line to the point of beginning, all in Cook County', illinois, will be received at the office of the Village Clerk, Village of Mount Prospect, Village Hall, 112 East Northwest Highway, Mount Prospect, Illinois, until 8:00 P.M. on August 15, 1961, and that all said sealed bids so received shall thereupon be opened at a regular meeting of the Village Board of the Village of Mount Prospect at its regular meeting place, 112 East Northwest Highway', Mount Prospect, Illinois, at 8:00 P.M. on August 15, 1961. All bids must be accompanied by' a cashier's or certified check made payable to the Treasurer of the Village of Mount Prospect in the sum of at least 10 per cent of the bid as a guarantee of good faith and for security for the performance of such bid, and as liquidated damages to the Village in case a successful bidder fails to tender to the Village the consideration specified in the bid within 30 day's after said bid is accepterl.. The Corporate authorities of the Village of Mount Prospect will furnish a warranty' deed with good and merchantable title. The corporate authorities of the Village of Mount Prospect reserve - 3 - the right to reject any' or all bids and to waive informalities in the bids and bidding. No bid shall be withdrawn after the opening of bids for a period of 30 days from the date of bid opening wi. thout the consent of such corporate authorities, The making of any' award is in the des- cretion of said corporate authorities. By' order of the Village Board of the Village of Mount Prospect. Dated this 19th day' of July', 1961 /C / r~ U /'-/~ /.cJ ~ "Village Clerkll SECTION 3: That bids received in response to said advertisements for bids shall be opened at the regular meeting of the President and Board of Trustees of the Village of Mount Prospect in the Village Hall in the Village of Mount Prospect on the 15th day' of August, 1961, at the hour of 8:00 P.M. SECTION 4: That within thirty' (30) days after a bid is accepted, the successful bidder shall tender to the Village the consideration specified in the bid accepted and upon receipt of such consideration the President and Clerk of the Village of Mount Prospect shall thereupon cause the necessary' legal papers to be issued in the name of the said Village to the successful bidder for the real estate successfully' bid upon. The corporate authorities of the Village of Mount Prospect will furnish a war:ranty' deed with a good and merchantable title.
