That Ordinance No. 553, commonly known as Mount Prospect Building Code of 1957, is hereby amended by adding the following provisions, to be designated as Chapter IX1! FALL o tJr SHELTERS: (1) Pe~mit required. No person shall construct a fallout shelter upon private property within the Village of Mount Prospect unless a permit shall be issued for said construc- tion. No fee shall be charged for said permit. (2) Application. Application for such permit shall be made to the Department of Buildings on forms provided for same by said Department. Such application shall be accompanied by plans and specifications, which shall be in accordance with the provi- sions herein provided and subject to the approval of the Archi- tectural Com.mittee and the Chief of the Pire Department of the Village of Mount Prospect. (3) Fallout shelters shall comply with the minimum specifications set forth by the office of Civil Defense Mobiliza- tion in their publication designated M P -15, dated June, 1959, and in compliance with figures 13, IB, 19, 20 and 21 and drawings SO-I, 5, 6 and 7. No fallout sllelter shall be constructed above yard grade nor in any portion of the lot or land area from which a building would be prohibited. (Lj-) Family fallout shelters shall be used for the sole purpose of protection from fallout during a national emergency, and for no other purpose. (5) In the event that the requirements set forth herein cannot be adhered to due to particular difficulties unique to the property upon which a fallout shelter is to be constructed and which thereby cause a hardship upon the applicant, then the Presi- dent and Board of r:Prustees, upon the recow.mendation of the Archi- tectural COlnmittee and the Fire Chief, may grant a specific vari- ance permitting the fallout shelter proposed, provided the same is constructed so as to provide protection to its occupants. Section 2. Any person who shall violate any provision of this ordinance or fails to comply with any of the requirements thereof, or who shall erect, construct, alter or repair a fall out shelter in violation thereof, shall be guilty of misdemeanor punishable by a fine of not less than $2.5.00 and not more than $200, and each day such violation is permitted to exist shall constitute a separate offense. ,._,..,."A..,..;,......,,,.,,--,.....,,~.~,,"'"~Wi^'....H"......",* .. The imposition of the penalties herein prescribed shall not preclude the Village Attorney from instituting an appropriate action or proceeding to prevent an unlawful erection, construc- tion, reconstruction, alteration, repair, conversion, maintenance or use or to restrain, correct or abate a violation, or to pre- vent the occupancy of a fallout shelter, or to prevent an illegal act, conduct, business or use in or about any premises. Section 3. This ordinance shall be in full force and effect from and after its passage, approval and publication ac- cording to law.
