HomeMy WebLinkAboutOrd 796 10/10/1961 :> ORDINANCE NO. 796 AN ORDINANCE GRANTING A SPECIAL USE FOR GARAGE USE TO THE ILLINOIS BELL TELEPHONE COMPANY, A CORPORATION, FOR PROPERTY LOCATED AT THE NORTHWEST CORNER OF ROCKWELL STREET AND ARTHUR STREET AT THE REAR OF THE BRUNING PLANT, MOUNT PROSPECT , WHEREAS, the property hereinafter described is zoned I-I by the zoning ordinance of the Village of Mount Prospect, and WHEREAS, the Village of Mount Prospect on the FIFTH day of SEPTEMBER, 1961, passed and approved Ordinance No. 784, which ordinance created a special use provision in the Zoning Ordinances of the Village of Mount Prospect and provisions thereof permit a garage use in the I-I zoning classi- fication, provided that the requirements set forth in said ordinance are fully complied with by the owner of the property, and WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did conduct a public hearing on September 29, 1961 (Case No. 61-31) upon the applicatton of the Illinois Bell Telephone Company for a special use of the property hereinafter described for garage purposes, and WHEREAS, the Zoning Board of Appeals in their report of October 2, 1961 to the President and Board of Trustees did make the following findings: 1. The establishment, maintenance and operation of this special use will not be detrimental to or endanger the public health, safety, morals, comfort or general welfare. 2. This special use will not be injurious to the use and enjoyment of other property in the immediate vicinity for the purposes already permitted, nor substantially diminish and impair property values within the neighborhood. 3. The establishment of this special use will not impede the normal and orderly development and improvement of surrounding property for uses permitted in this district. 4. Adequate utilities, access roads, drainage, and/or other necessary facilities have been or are being provided. 5. Adequate measures will be taken to provide ingress and egress so designed as to minimize traffic congestion in the public streets. 6. This special use shall in all other respects conform to the applicable regulations of the district in which it is located. AND, WHEREAS, the President and Board of Trustees find that the report of the Board of Appeals, dated October 2, 1961, is true and correct in all respects, NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Mount Prospect, Cook County, Illinois: Page One SECTION 1: That the Illinois Bell Telephone Company, an Illinois corporation, is hereby granted a special use for garage purposes on property legally described as follows: That part of Lot A in Kirchhoff's Subdivision in Section 33, Township 42 North, Range 11 East of the Third Principal Meridian, which lies South of a line drawn from a point on the West line of said Lot A which is 1315.34 feet South of the Northwest corner of said lot to a point on the East line of said Lot A which is 931.07 feet South of the Northeast corner of said Lot A and lying North of a line 20 feet South of and parallel with the South line of the North half of the North half of the Southwest quarter of said Section 33, situated in Cook County, Illinois. SECTION 2: That the real estate and the Illinois Bell Telephone Company, an Illinois corporation, shall be subject to all the limitations and conditions of the zoning ordinances of the Village of Mount Prospect, including the provisions of Ordinance No. 784. SECTION 3: That any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not more than One Hundred ($100) Dollars for each offense, and each day that a violation is permitted to exist shall constitute a separate offense. SECTION 4: That this ordinance shall be in full force and effect -- from and after its passage, approval and publication, according to law. PASSED this TENTH day of October, 1961.
