JUly , 1993. 6/28/93 CAF/ ORDINANCE NO. 4567 AN ORDINANCE GRANTING A VARIATION FOR PROPERTY COMMONLY KNOWNAS 402 SOUTH BUSSE ROAD WHEREAS, Gordon L. and Martha W. Verba (hereinafter referred to as Petitioner) have filed an application for a variation from Chapter 14 of the Village Code of Mount Prospect, Illinois, for property commonly known as 402 South Busse Road (hereinafter referred to as Subject Property), legally described as: Lot 2 in Hatelen Heights Estate Unit No. 1, a subdivisionof part of Lots 3, 4, 5 and 6 tdaken as a Tract in Owner's Division, being a subdivision of the southeast quarter (except the west half of the southwest quarter thereof) of Section 10, Towenship 41 North, Range 11, East of the Third Principal Meridian, according to plat thereof registered in the Office of the Registrar of Titles of Cook County, Illinois on May 13, 1957, as Document No. 1737769 and WHEREAS, Petitioners have submitted a request for a variation from Section 14.3016 of Chapter 14 to allow a thirty-two foot (32') wide driveway at the widest point, instead of permitted 21 feet, to be used as a parking pad/turn around; and WHEREAS, a public hearing was held on the variation requested being the subject of ZBA Case No. 38-V-93 before the Zoning Board of Appeals of the Village of Mount Prospect on the 27th day of May, 1993, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the llth day of May, 1993; and WHEREJlS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect and the President and Board of Trustees of the Village have given further consideration to the variation requested and have determined that the same satisfies the standards set forth in Section 14.605 of Article VI of Chapter 14 of the Village Code and the Board of Trustees further find that it would be in the best interests of the Village to grant the variation as specified herein. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property a variation from Section 14.3016 to allow a thirty-two foot (32') wide driveway at the widest point, as shown on the Site Plan attached hereto and hereby made a part hereof as Exhibit "A", subject to providing a landscape screening. SECTION THREE: Except for the variation granted herein, all other applicable Village of Mount Prospect Ordinances and regulations shall remain in full force and effect as to the Subject Property. BA 38-V-93 Page 2 of 2 SECTION FOUR: In accordance with the provisions of Section 14.604 of Chapter 14 of the Village Code, the variations granted herein shall be null and void unless permits are issued and construction begins within one (1) year from the date of passage of this Ordinance. SECTION THREE: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
