HomeMy WebLinkAboutOrd 827 05/15/1962 lQ/5/l5/62 ORDINANCE NO. m AN ORDINANCE ANNEXING CERTAIN ~ROPERTIES LOCATED IN AN AREA COMMONLY KNOWN AS HATLEN HEIGHTS TO TEE VILLAGE OF MOUNT PROSPECT WHEREAS, a majority of the property owners or record, "owners of record of more than fifty percent of the land in the territory described, and a majority of the electors of said ter- ritory hereinafter desoribed and oommonly known as Hatlen Heights have sought to annex said area, hereinafter more fully described, to the Village of Mount Prospeot, and WHEREAS, said property owners and residents, to accom- plish said purpose, have filed a petition to annex as amended with the County Court of Cook county, case No. 62 CO 110, in ao- oordance with the statutes of the State of Illinois made and pro- vided, and WHEREAS, Judge Thaddeus V. Adesko, Judge of the County Court of cook County, did on April 11, 1962 enter an order, a certified copy of which is marked Exhibit 1, attached hereto and made a part of this ordinanoe by reference as if tully set forth, which order did find that the petition to annex the hereinafter described property, as amended, was signed by a majority of the property owners of record, owners of record of more than fifty percent of the land in the territory described~ and a majority of the elec;ors of the territory herein described and that said pe- tition as amended did oomply in all respeots with the laws of the state of Illinois, that the territory described in said petition as amended and referred to below was in faot contiguous to the Village of Mount Prospect and did duly certify the area to be annexed, and WHEREAS, a copy of said order was duly transmitted to ~ the Village Clerk of the Village of Mount Prospect in accordanoe with the statutes made and provided; ahe having reoeived same, and WHEREAS, it is deemed to the best interests of the Vil- lage of Mount Prospect that the property hereinafter desoribed and oommonly known as Hatlen Heights be annexed to the Village of Mount Prospeot, NOW~ THEREFOREt BE IT ORDAINED by the President and Board of Trustees of the Village of Mount Prospect, Cook County, Il1ino is : Seotion 1. That land and territory described in the above mentioned petition as amended and the above mentioned order, towit: All that land lying within the following desoribed boundaries: commending at the interseotion of the East line of Busse Road with the North line of the right of way of Lincoln street, thence West along the North line of Lincoln street to the West line of Hat1en Heights, unit #2, a Subdivision in the South half of the North- east quarter of Seotion 10, Township 41 North, Range 11 East of the Third Principal Meridian, thenoe Horta along said West line and along the West line of Hatlen Heights, unit #3, a SubdiviaiGn of part of the North- east quarter of Section 10, Township 41 North, Range 11 East of the Third Principal Meridian, to the South 1tne of Central .Avenu.e, thence Ea.st along the SGuth line of Central Avenue te the East line of said Hatlen Heights, thit 113, thence South along said East line to the North liDe of Hat1en Heights, Unit 12, a Subdivision 1m the South half of the Northeast ~uarter of Section lO, Township 41 North, Range 11 East of the Third Principal Meridian, thence East along 8a1d North line and along the North line of Hat1en Heights, unit #1 a Subdivi- sion in said quarter Seotion to a point 384.9 feet West of the center line of Busse Road, thence North along a line parallel to the ceater line of Busse Road to the exiatiag Village limits of the Village of Mount Pros- pect, being the center line of Central Avenue, thence East along the center line of Central Avenue to the East line of Busse Road, thenoe SGuth along the East liBe of Busse Road to the point of beginning, in Cook County, Illinois, excepting therefrom the North 2 aores of Lot HEn (except that part lying North of a line So feet South of and parallel to the North line of Section lG) in Kirohoff's SUbdiVision, being a SubdiviSion in Sec~ tions 10 and II of Township 41 North, Range 11 East of the Third Principal Meridian, according to the plat thereof recorded May 22, 1927 in Book 152 of Plats, page 1$, Cook County, IllinOis, which territory is contiguous to the Village of Mount Prospect, is Dot within the limits of any municipality, and which has sought annexation through petition to the County Court of Cook County, Case No. 62 CO llO, and which petition as amended has lead to the entry of an order by Judge Thaddeus V. Adesko on April 11, 1962, which order did duly find that the territory described in said petition as amended and described above was in fact contiguous to the Village of Mount Prospect, that said petition was signed by a majority of the property owners of reoor~ owners of record of more than fifty percent of land of the t.rritory~ and a majority of electors on the territory therein described, and that the pro- ceedings and petition as amended filed were in all respecta in full compliance with the statutes applicable thereto, particularly Illinois Revised statutes, Chapter 2~, Sections 7-1-2 through 7-1-5, and which order cert1:fied the area to b. annexed as above set forth4 ~ is hereby annexed to the Village of M(i)unt Prospect so that herearter said territory shall ~e included within the boundary lines and l~its of said Village of Mount Prospect, as is by law in such case made and provided. Section 2. That the Village Clerk of the Village of Mount Prospect is hereby directed to record a certirled copy of this ordinance together with an. acourate plat of surveyor said territory, to b. provided by the Village Engineer, with the Re- corder of Deeds of Cook County, Illinois. Seotion 3. That this ordinance shall be in full force and effeot from and after its passage, approval and the exp1ra- ti0n of thirty days from date thereof, in accordance with Seotion 7-1-5 of Ohapter 24 of the Illinois Revised statutes (Municipal Code 1961).
